Re\,ised project plan, Old City Hall.
The Project Review Commi t,tee met on this date to review an
amendment to the approved site plan of the above referenced
project. The Committee approved the proposed addition of patio
overheads with the following-conditions:
1. A setback oflO feet from the front property line (along
Church St.) muit be observed.
2. Development of this type, adjacent to.a side street right-
of-way, would set a poor precedent for development in the
Northgat-e district. Due to th.e, particular condi t ions in
this case there are problems associated with the proposal.
Approval in this case should not be interpreted as approval
for similar proposals (esp.setbacks) at other corners in
the district.
3. If the addition brings the total area under cover to 5000
square feet or more building sprinkler requirements mus_t be
met.
4. Coordinate with Phil San Angelo to insure that there or no
conflicts with existing utilities.

Any property owner desiring a driveway approach

N. DESIGN STANDARDS
All engineering design of streets, sidewalks, driveway
approaches,> drainage structures, and utilities within
street right-of-way shall conform to city engineering
standards.
O. UNUSUAL CONDITIONS
The city engineer is hereby authorized to grant in writing,
variances from the strict application of the principles
ofthissubsectioniprovided that he first determines that
the following. conditions are. present:
(1) The exception or variance desired arises from
peculiar conditions not ordinarily existing. in
similar districts in the city, or due to the nature
of the business or operation on the abutting property.

(2) That the exception or variance desired is notaqainst
the public interest , particularly safety, convenience-,
and general welfare.
(3) That the granting of the permit for the exception
or variance will not adversely affect the rights of
adjacent property owners or tenants.
(4) That the strict application of the terms of this
section will not work unnecessary hardship on the
property owner or. tenant.

the meeting, but reviewed the plans and submitted comments which
are ,included in this report.
SUBJECT: Parking Lot Plan - O.ld City Hall -renovations and
addition of a parking lot for a restaurant at 101
Church Street. (88-406)
The P.R.C. met on this date to review the above project, and has
approved th~ proposed use afthis building, but-advised the
applicant that it cannot approve the site plan for the project as
proposed, and that the applicant has the option of appealing the
decision of the P.R.C. to the Planning and Zoning Commission
within 5 days of this decision.
The following requirements were listed bysta~f and theP.R.C.:
1. Furnish electric load data requirements to the Electric
Department as soon as possible. If existing service is
used, the meter does not have to bie changed; if the service
must be upgraded, coordinate changing the location of the
service and meter with Ray Havens.
2. Show all existing utility poles which are located on the
property.
3. There is a street light at the northwest corner of this
property. If its use is continued, it will be on a monthly
rental basis, and the developer will receive monthly bills.
Coordinate all electrical requirements with Ray Ha.vens.
4. If lighting istobe located in the parking lot, indicate to
Mr. Havens ifit istohavea.separatemeter, or if it will
be metered off the building.
5. \ Show the location of all existing utility easements and
existing utilities which are located on this property.
There lsan easement on the eastern property line which
covers an existing utility, (water line). More specific
information can be obtained from the Water & Sewer
Department.
6. Show the location of the property line(s) for this property.

along the western property line may be in the state right-
of-way.
7. Coordinate any water or sewer services for this facility
with .BillRiley.
8. Fire Marshal Davis asked that the exact location of the fire
hydrant be identified on the site plan, including the size
of the water main which serves this property and hydrant.
9. Indicate square footage of the building on the site plan.
10. Coordinate natural gas requirements with Kean Register of
Lone Star Gas Company.
11. Coordinate telephone servi.ce requirements wi th LaVern Akin
of GTE.
12. Indicate the dimensions of the fenced area where dumpster(s)
will be located. Mr. Brown stated that the City's
preference is that no gates are included on this screening
fence, : but if the developer includes gates, he shoul.d be
aware that they are a high maintenance item, and will be his
responsibility.
13. 4 parking spaces for the handicapped are required for the
total number of parking spaces being proposed.
14. City Engineer Pull.e.n pointed out-t-his plan does not include
many of the dimensions necessary to make a complete review
of this plan, but a dimension which will be required i.s the
exact location of'the proposed driveway access to this
property.
15. Standard a,ll-weather (paved) surface and permanent curbing
is required on t,his parking: lot.
16. Drainage Plan Submittal Requirements have been provided to
the applicant; compliance is required prior to issuance of a
Building Permit.
17. Exact location of the property line must be shown as it
relates to the right-of-way for Wellborn Road. If any of
the plantings for this project are located in the right-of-
way, the applicant is advised that permission for inclusion
of those plantings must be obtained from the Resident
Engineer of the State Department of Highways & Public
Transportation in Bryan. If the proposedplantings are
within the property lines for this property, Traffic
Engineer John Black will review for sight distance.
18. Director of Planning Callaway pointed out that because this
project is located within the Commercial-Northgate zoning
district, theP.R.C. is charged by ordinance to approve
several things, including

20. Fire Marshal Davis advised that because this is to be used
as a restaurant, an adequate number properly marked exits

21. The Zoning Ordinance requires erection of a 6i foot solid
screening fence betwee-nany commercial and resident ial uses.
The exis:ting cyclone fence does not meet that requirement.
The applicant was advised that appeal(s) to any of the
requirements can be made; certain items must be appealed to the
Planning and Zoning Commission and others to the Zoning Board of
Adjustment. Zoning Official Jane Kee will coordinate with the
applicant upon request.
Submit 10 copies of the revised site plan to the Planning
Division for approval, or for inclusion on the P&Z agenda as an
appeal to the P.R,C. decision. If the appeal is to be on the
agenda for theP&Z on 5-5-88, revised site plans must be received
in the Planning office before 5 P.M. on Friday, April 29th.

Since the meeting of May 5, 1988 where the Commission denied the
appeal of the Anz's to provide less than a C-lstandard parking
lot, the applicant has redrawn.... the plan and P.R.C. has reviewed
it again. The applicant has provided an all weather surface lot
with curbing and islands that meet ordinance.. requirements with
two exceptions:
1. There is no curb along the northern boundary of the lot
where it curves.
2. One double island on the interior row of parking does
not meet the 360 S.F. standard.
The P.R.C.advised the applicant that it had no problem with
these two exceptions but that the. full Commission would have to
review their position. Please refer to items 12. and 18. of the
P.R.C. report. Note that the P.R.C. recommended that a time
period of 18 months be allowed, after which full curbing wi-II be
installed.
Other items of theP.R.C. report are minor things that can be
handled prior to building permit and consist of locating utility
lines and easements, showing dumpster dimensions and correcting
millor dimensional errors. Other item,s involve coordinating fire
hydrant requirements, drainage plans and telephone;" gas and
electrical requirements with appropriate personnel.

Allparts of the building must be wi thin 3.00 feet of a fire
hydrant. Coordinate with Bennie Luedke regarding providing
adequate coverage for this property. If an addition to an
existing line is required, it must be 8u in size. The
developer is required to provide adequate coverage. Water
lines must be designed by a professional engineer and plans
submitted to and approved by the Engineering Division and
Water & Sewer Department prior to issuance of a Building
Permit.
If the applicant desires to make an appeal to this
requirement, coordinate with Fire Marshal Davis at the
Central Fire Station on Texas Avenue.
8. Coordinate natural gas requirements with Kean Register of
Lone Star Gas Company.
9. Coordinate telephone service requirements with LaVern Akin
of GTE.
10. Indicate the dimensions of the area where dumpster
will be located. Mr. Brown stated that the City's
preference is that no gates are included on this screening
fence,butif the developer includes gates, he should be
aware that they are a high maintenance item, and will be his

11. City Engineer Pullen pointed out that the proposed raised
deck walkway at the southwest corner of this project is
partially located ou.tside the property lines. Any request
for an encroachment may be made to the City Council. Mr.
0' Brien_, the applicant ' s representative indicated this
encroachment will be corrected.
12. Standard all-weather (paved) surface and permanent curbing
is required on this parking lot. The P.R.C. expressed its
agreement to the applicant's proposal for deleting the
curbing along the northern portion of this project for a
period of time not to exceed 18months, afterwhich, the
applicant will have to be in full compliance whi.chincludes
curbing around the entire perimeter of the project. Show
exact location of proposed curbing. The Planning and Zoning
Commission will make the final ruling.

14. The Zoning Ordinance requires a 6 foot solid screening fence
between any commercial and residential uses, in this case
from the northern corner of Lot 6 to the southern corner of
Lots 2 & 21. The existing cyclone fence does not meet that
requirement.
15. City Engineer Pullen advised that the driveway on Wellborn
Road does not comply with Citypo1icy, which would require a
300 foot setback from the intersection of Church & Wellborn.
He< stated that he would address.. this discrepancy after he
makes a study of the relevance of turning movements on
Church Street.
16. Show the dimension between the property line and the curbing
along Wellborn Road. AnS foot setback is required.
17. Recheck the radius on some of the islands. As shown, those
radii do not correspond with the dimensions of the islands.
18. The island dimension at the end of the double row of parking
is. not adequate to fully comply with ordinance requirements.
The P.R.C. recommends approval of this island as proposed,
but the Planning and Zoning Commission will make the final
ruling.
19. The existing parking on Lots 1 & 22 does not comply with '
requirements, but will not be addressed during this review.
Striping and signage on the spaces provided for the
handicapped will be required in this area.
The applicant was advised that his appeal will be taken to the
Planning and Zoning Commission for consideration on June 16,
1988.
When the applicant has prepared his final revised site plan, he
should submit 12 copies to theP1anning Division for approval
prior to continuing with step II of the Building Permit Process.
