staff Comments:
This tract has been the subject of. seven r,ezoning cases in
the past eleven years. Fiverequestshaveinclllded C-l
zoning. One action was ini tiatedby the City .and rezoned the
entiretractA-P. The. last request, filed by a previous
owner,resu,ltedin thecur.rent C-3andA-P zoning.
Neighborhood support or 'opposition ,appears, to have been a
major factor in allof,the previous requests.
The request currently before the Commission and Council is
the ,. result of,alengthynegot iat ion between the property
owners and the area residents. . Included in the agr.eement is
thereductionin.width. of an electrical, easement along the
north side of the property, a deed restricted 30' wide
"greenbeltUarea . along ,s ide the ,. elect rical easement and
relocation of an ex~s~ing,30' wide private access easement.
This. wil1provide70'jof easement, greenspace and access
way between th.eres~d.~ntial area and. any commercial
bui ldings. A plat ~'~flect ing these changes wi 11 be
pre'sented to the CODlmission and Council.
The requested zone cllange' represents an enlargement of an
existi'ng C-3 area. Tihe change to C-3from A-Pdoes not
representasubsrtantial increase in zoning intensity. Staff
would typically express concern about locati~n,g a C-3
district adjacenttp8. sin,glefami ly residential area. In
this case the applic~.nt and adjacent residents have worked
out apropo~al to address potential adverse impacts.
Staff recommends that any approval of this request be made
contingent upon the filing of the plat relocating easements
as proposed by the apiplicant and the area, residents.
