This request provides for establishing permanent zoning
(after annexation) of. a portion of the proposed Southwood
Valley Section 26.
The
Plan
proposed R-l zoning is in compliance with the'Land Use
and is consistent with area development. Staf~f

recommends approval oftheR-=1 portion of the request.
TheC-N district is intended to provide commercial sites for
convenience goods and servi ces ;in and adjacent to
res'idential'.areas. The ",district' ,is ",,1 imi ted to two acres 'in
area. C-N uses aren~t addressed by the land use plan due
to the small si.ze ofC-Ndistricts.
Staff has no objections. to C-Nzoning in this location. The
proposed site is .near the intersection of two major streets,
providing good accessibility to the residential areas to the
north,eastandwes.t.
The use and site devel,opment of C-N districts is subject to
approval of the Planning an.d Zoning Commission. The
applicant has left a "buffer strip"ofR-lzoning between
the proposed C-N area and the right-of-way of Rio Grande.
This. stripv8ries in width from approx. 50 to 80' and serves
to separate the C-N area from an established residential
area.
P&Z ACTION: On7-17-86P&Z voted under separate motions to
approve both the R-l andC-N requests by a vote of 6-0.

Mr. Callaway explained the request is to establish permanent zoning (following
annexation) of R-l & C-N. He located the 2 tracts of land, explained area zoning and
existing land uses, adding that the area is . reflected as low density residential on
the land use plan, and that the C-N zoning district is intended to pr()vide commercial
sites for convenience goods .and services in and adjacent to residentia1.areas and is
not addressed by the land use plan due to. the restricted (small) size of each
district. He finalized by stating that staff recommends approval of the R-l portion
of this request, and further that staff has no objections to the propos~d C-N zoning
location, as it is near the intersection of two major streets prpviding good
accessibility to the residential areas to the north,eastandwest.
Mr. Dresser asked about the remaining A-O tracts and Mr. Callaway informed him that
staff has received no requests for permanent zoning on that land, but that there is
noprob1em, and. is allowed by ordinance. Mr. Kaiser asked if this request is to be
considered as one request, or if it is two separate requests. Mr. Callaway replied
that it is one request for 2 tracts of "land.
The public hearing was opened. Dan Sears, representative of Area Progress
Corporation came forward to answer any questions, and informed the Commission that
the owner has not establisbe.d exactly what uses he wants for the remaining A-O land
in that area, therefore he has not submitted a rezoning request to date. He added
that the proposed C-N district would fill a need in a neighborhood.
Chuck Denby, a resident on Winecup came forward and asked exactly what businesses

would be allowed in a C-N districL. p,tr.May<> and Mr. Brochu explained the uses
allowed in that district, with Mr. MacGHvray adding that any C-N development would
require additional public hearings to consider not only the site plan, but include
review and approval of the use being proposed.
Mr. Kaiser stated that he would prefer that these two tracts be considered in
separatemotiQns. Mr. MacGilvraymadeamQtion to approve the request for R-l
zoning. Mrs . Sawtelle seconded the lnotionwhichwasapprovedunanimously (6-0).
Mr. Brochu then made amotion to approvetheC-Nportionofthe request; Mr. Dresser
seconded that motion whichalsocarriedunahimously (6--0).
