The requested zoning is in compliance with the land use .plan. Area densities were substantially lowered when 36.6 acres of R-4 zoning in this area were rezoned to R-1 in 1985 (85-117). ) 86-111 page 1 The applicant has referenced possible development of fraternity houses in the proposed R-5 area. The question to be considered by the Commission and Council is the appropr,iatezoningofthis tract. Any use for fraternity houses will be considered byth~ Commission as a Conditional Use Permit request. (Fraternity/sorority houses and meeting places a.re conditional uses in t,heR-5, R-6 and C-l zoning districts. Conditional use permits are subject to Planning and Zoning Commission approval in accordance with Sec. 14 of the Zoning Ordinance.) Staff recommends approval of the requestedR-5 zoning for the following reasons: 1. The proposed R-5 zoning is in compliance with, the City' s land use plan. 2. The pro:posed R-5 area is compatible with adjacent zoning districts and is well buffered from any low density residential areas. P&Z ACTION: On 6-5-86theP&Z voted unanimousl,y to recommend approval of this rezoning request. Applicant is Are.aProgress Corporat ion. Mr. Callaway explained this rezoning, located the subject land and area zoning, pointed out the subject land is vacant and is reflected as commercial, high and medium, density residential on the adopt,edlanduse plan, thus the request is in compliance. He added that area densities were substantially lowered when 36.6 acres ofR-4zoning in this arefi were rezone<;l in 1985 toR-I, and went onto state that staff recommends approval of the requested zoning because it is in compliance with the l~d use plan and is compatible with adjacent zoning districts and is well buffer~d from any . low density residential areas. Mr. Kaiser asked the density differ~n:cesbetween.. R-4 and R-5 zoning and Mr. Callaway replied R--4 allows up to 16 dwelling units per acrewhereasR-5 allows up to 24 dwelling units per acre. The public hearing was opened. Dan Sears, representative of Area Progress Corporation came forward to explain that his, company has been working with several fraternities to locate a suitable site for fraternity development, and this area seems to be the <best location which provides good access, good circulation and is located in an undeveloped area so when it begins to develop,thepeople will know exactly what is going to be there. He went on to explain platting plans and other area rezoning plans. Mr. Callaway pointed out that appropriate zoning of this tract is the only question to be considered with this request, and if fraternity/sorority. houses are planned in the future, conditional use permits will have to be approved and are subject to P&Zapproval in accordance with Section 14 of the Zoning Ordinance. 86-111 page 2 Noone else spoke.
