Staff Comments:
These lots frontoD Wellborn Road and are bounded by
commercial and high density residential uses. The current
single family zoning is not incompliance with the City's
plan or the Wellborn Road study. Sing-Ie family zoning is

not 'compatiblewit.h the adjacent commercial or high density
(R-6) zoning.
These lot-sdo not comply with the Commercial development
policies included within the plan with qrespect to depth.
The lots are "locked in" between Wellborn Road and developed
tracts; no additional depth is available.
The Wellborn Road Corridor Study recommended that the
residential lots along this portion of Wellborn Road be zoned
commercial ttprovided lots are consolidated (replatted) with
existing commercially zoned lots/tracts.tt (Wellborn Road
Corridor Study, p. 17)
Requiringarepla't consol idat_ing small lots with l~rgerlots
is . an effort to minimize the pro.blems associated with
numerous small commercial lots and provide for commercial
development that is more incompliance with the City's
commercial development policies. (Problems include
conflicting access points, lack of access from one lot to
another without entering traffic, etc.) These problems can
be addressed by consolidating the various lots into one lot,
or by providing access easements, etc. so as to allow several
lots to function as one. Anyreplat required (and access,
signage,orother restrictions imposed on such replat) would
be a later agenda item for the Commission and the Council.
Rezoning contingent upon replattinghas been approved by the
Council in nine commercial rezoning cases since 1982. (Case
numbers and details are on file in the Planning Division.)
Staff recommends approval of c-I zoning, contingent upon the
lotsbeingreplatted, in accordance with there'commendat ions
of the Wellborn Corridor Study.
P&Z ACTION: On 6-5-86 the P&Zvoted unanimously to approve this
rezoning request" contingent upon the replatting of
these lots, combining them with the adjacent Lot 2B
Block APetterak subdivision, which the applicant
also owns.

Mr. Callaway explained the request, located the tracts, pointed out area zoning and
exist ing .landuses,addingthat the area is reflected as commercial . and .. medium
density residential on the adopted land use plan, as well Bsthe fact that these
traQtsiwere 10Qated.in au. area recently studied.by a P&Zsubcommittee and that group
resomm~n~~d that lots in the area should be zoned commercial when consolidated into
largerparQels. He went on to point out that the lots front on Wellborn Road, and
arebouncl~~bycommercial and high density residential uses, thus the current single
family. zoning is not compatible with the adjacent uses, nor is the zoning in

compliance with either the adopted comprehensive plan or the subcommittee
recommendations following study of the area. He went on to say that the lots do not
comply with the commercial development policies included in the plan with respect: to
depth, and because the lots are locked in between Wellborn Road anddevelolpedt.raqts,
no additional depth ,is .available.
He explained that the Wellborn Road Corridor Study recommended that the residential
lots along this portion of Wellborn be zoned commercial "provided lots are
consolidated with existing commercially zoned lots/tractsU, further explai][)ing t:h1a.t
requiringareplat consolidating small lots with larger lots is an effort tominii~ize
the problems 'associated with numerous small cODDllercial lots and to provide for
cOIlDDercialdevelopment that is more in compliance with the city's commercial
development policies , at the same time providing a vehiclewhichwillaIlowpr()oli~s
of conflicting... access points, lack of access from one lot to another .without_ entering
trafic, sign~ge or~ther restrictions to be addressed (on a replat).
He then stat.edthat rezoning contingent upon replattinghas been approved 1by the
Council in at least ninecoDDllercial rezoning cases since 1982,therefore staff
recommends approval ofC-lzoning on the subject tracts contingent upon the lote;
being replatted in accordance with the recommendations of the Wellborn Corridor
Study.
Discussion followed concerning access to the existing high density apartments,. if a
remaining R-l zonedtractcouldbe developed, how to address that small tfleftoverr" R-l
tract in thefuture,with Mr. Callaway advising that theP&Z can initiate rezoning of
a tract of land if it deems it the appropriate action to take.
The public hearing was opened. Don Jones, a partner in the partnership which holds
title to the two subject tracts, came forward to state that. it is his opinion that
this .rezoning.would/accomplish 2 things: Thatof.cleaning up some vacant, unkept
lots with dilapidated buildings , and would also provide land to house much-need~.d
commercial services to an area where such services are lacking. Mr. Kaiser asked ,Mr.
Jones if he had studied staff's recommendation regarding rezoning contingent UP~1
replatting (consolidation) of.. the lots and Mr. Jones replied that thepartnersh~~ I ,is
prepared to replat Lot 2BBlock A of thepetterak Subdivision withLots 23 & 22!i~~ing
considered tonight, but he could not include Lot 2A Block A Petterak Subdivisio~' il#s
he does not hold title to it. He also pointed out that. the two subject lots ar~ iipot
really platted as shown on the drawing enclosed in the packets, but rather have i !~~en
sold in the past by metes and bounds. Access, joint access, and existing struc~qJJes
were discussed ,with Mr. Dresser stating that he would be reluctant to rezone the~e
two lots without the condition of thereplat referred to earlier in the discussion.
Janice Burke, manager of the Southgate Apartments came forward to ask how the suoject
rezoning.wouldaffect the apartment comp~ex and what impact commercial zoning wR11d
have on thecoJDI>lex. Mr. Kaiser .explaine;d the various uses which would be allo~e;a in
a C-l zoningdi~trict, adding to clarify!a misconception of Ms. Burke's that th~!
subject rezoning only affects the land M~. Jones'group owns, and if the P&Zde9~~es
to recommend rezoning of the small R-ltvact the apartment complex owns, she wo4~tl
have the opportunity to address that particular rezoning at that time. Mr. Bro~~H
further clarified by explaining that the isubject rezoning request being conside~i~ at
this meeting would not cause the apartment complex to lose any of its property.:' Jnd
it would still have complete control over- all the property under its ownership.!
No one else spoke. The public hearing was clos.ed. Mr. Dresser asked if these tracts
are rezoned, is there anything to preclude the. .use of the existing buildings fO~i
commercial uses to which Mr. Callaway- replied that with any change_of use,cert~i.n

building code regulations must be met which in this instance would most likely not be
cost effective. Mr. Kaiser asked if staff has any recommendation. for the remaining
small R~lzoned tract to which Mr. Callaway replied that although staff has no
recommendation for that lot at this time,. to changeit.toC-lwould not be helpful as
long as it is owned by the apartment complex,.althoughR-6zoningmightallowthe
complex have better use of the land. Mr....Wendlersaid .he .sees .no .needto change the
zoning of that sma.ll tract unless it changes ownership. Mr. Mayo pointed out that if
it were rezoned toR-6,itwollldresult in changing a non-conforming use to a
conforming use.
Mr.. MacGilvraystated that he believes that this rezoning request fits in with the
Wellborn Road study recommendations if it is made contingent upon replatting, and
then made amotion to approve the rezoning of Lots 22& 23 Hrdlicka subdivision from
R-l toC-lcontingent uponareplat of those lots combining them with Lot 2B Block A
Petterak subdivision. Mrs. Sawtelle seconded the motion which carried unanimously
(7-0).-

Attached is a copy of the Wellborn Road Corridor Study. This
report is the result of the efforts of a Planning and Zoning
Commission sllbcommittee study of the area bounded generally by
J e rs ey, We Ish,andF .M..2818.
The WellbornCor:ridorStudyCommittee worked with the planning
staff to conduct base studies of the area and identify current
trends and pressures in the area. The committee sought input
from owners of large ,un,developed tracts in the area. The City's
existing plans and policies were reviewed with respect to
application within the study area.
Recommendations for land use, zoning, and street extensions
within the study ares. were developed after completion of the
various studies. The study area was divided into seven
geographic areas and specific recommendations were made on an
area-by-area basis. (Area recommendations begin on page 11.)
The Planning and ZoningCommissionha.sendorsed the Study and its
recommendations. The Commission has recommended that the Council
amend the Clty'splanto incorporate the recommendations inclu.ded
in this report. Consideration of the Study and possible
amendment to the plan will be on the Council agenda in July.

Wellborn Road Corridor study
In 1985 the College station City Council and Planning and Zoning
Commission were presented severa.l rezoning requests having
definiteimpactsonexisting.andplanned land uses in the area
along Wellborn Road south of Jersey street. Development
pressures contrary to the City's plan indicated a need for
detailed study of the area.
On August 2'2, 1985 the Council, at the request of the Planning
and Zoning Commission, imposed a moratorium on rezoning in the
rlellborn Road corridor. The moratorium was imposed on the
portion of the corridor from F.M. 2818 to Jersey in order to
allow, the Planning and Zoning Commission adequate time to study
this area.
Planning and Zoning Co>mmission members Dan MacGilvary , Dav'id
Brochu and George Dresser were appointed to a special committee
for medtost u dyth isar e a a ndpr epa re9pe ci fi cre com men da t i on s
for .land use and <zoning along Wellborn Road. Thecommi ttee
findings and recommendations are presented in the attached
Wellborn Road Corridor study.
The Plann ingandZonin~gComrni s s ion has .endorsedthi s study a.nd
itsrecom,mendations. The Comrnissionhasrecommended that the
Coune i 1 adopt this >r.eport<andamendthe ,Ci ty's land use element
of the Ci.ty's comprehensive planinaecordance with the report
recommendations.
Formal presentation of the report.toCouncil is scheduled for
July 10, 1986. unti.lthe Council has had an opportunity to
consider adoption of the report recommendations and amendment of
the City's land use plan I would encourage the Council to llse
this report as a guide in evaluating development proposals within
the study area.

Subdivision~ The final plat has been completed, the filing fees
($75.00},tax cer.tificates obtained, ect.. 'The project, how.ever.,
can not be put on..the .P&Z agenqa until provisions have been made
to construct an 8"wate'r li nealongWellborn Road. Thi.s: wa ter'
line is necessary due to the lack of water. mains and fire
protection facilities fO.r the new lots b~ing platted. (It is
my understanding thatal.l .of the structures are currently being
served by a 2t1 line.) In talking'with you yesterday, I under-
stand that since you do not haveanend~userofthe tract at
present, you wish to delay these water line improvements until
such time a.s.necessary. This delay should in no way jeopardize
the future. platting c)f;th.e rezonfngof the tract. I am aware
thattherez:oning of the traptwas conditional upon the repl~t~
