ITEM SUMMARY:
A request to rezone two one acre-tracts toC-N. Tracts are
located at the .1\1W- corner of the intersection. of Rhett Bulter and
Harvey Road. C-N zoning is intended to provide sites for
convenience goods and services in and adjacent to residential
areas.

Staff Comments:
The C-NNeigborhood Business district is intended to provide
commercial sites for convenience .goodsandservicesin and
adjacent t.oresidential.. areas. The district is limitecl to
two acres in ar.ea. C-N uses are not addressed by the land
use plan (due to.the small size of C-Ndistricts).

Staff has no objections .toC-N zoning at this location.
The proposed tracts are located in an area with a large
number of apartment units, with numerous duplex and single
family residential units inclose proximity.
All uses and site development within the C-N zoning district
are subject to approval by the <Planning and Zoning
Commission
P&ZACTION: On 5-1--86 theP&Z voted to recommend approval of
this rezoning request. (5-0-1 with Paulsonabstainin.g).

Mr. Callaway identified the 2 subjecttractsona wall map, informed the
commissioners that the tracts are vacant, with apartments to the east and west,
conunercialdevelopmenttothe south across Harvey Road, and vacant land to the north.
Additionally, he identified area zoning, pointing out that this area is reflected as
high density residential on the land use plan. He went on to explain that the C-N
Neighborhood Business. district is intended to provide commercial sites for
convenience goods and services in and adjacent to residential areas, but are not
addressed by the land use plan due to the .small size ofC-N districts (2 acre limit).
He stated that thi's request does not represent a substantial chaDge in . area zoning
intensity, that it is compatible with adjacent zoning districts and land uses, that
staff has no.objections to this request,andfurther,. that all uses and site
development within .a.. C-N.zoning district are subject to review and approval by the
Plan.ning and Zoning Commission before any construction can take place.
'Discussion followed regarding the exact location of these tracts afterwhich the
public hearing was opened.
Steve Andrews of Jerry Bishop & Associates came forward as representative of the
applicant, . Municipal Develt?pment · Group and ..offered. to i answer any questions. He
confirmed upon questioning that the owner of. these tracts is planning to repIat the
area > which is the reason for requesting.2 separate tracts. Noone else spoke and the
public hearing was closed. Mrs... Stallings made .amotionto approvethi~s rezoning
request ; Mr. Wendler seconded the motion . which carried 5-0-1 (Paulson albs tained
identifying himself as a member of the applicant firm).
