This tract is part of a larger (13.65 acre ) tract. Tlle
applicant has n()tincluded all of - the tract in this rc~quest
in order to leave a buffer ofR-2 zoning adjacent to the
single family resident ialarea to the south (Brentwoo(:l).
This buffer is approximately 140' in depth. Thiswould
allow the development of one row of duplex lots along the
southern portion of the tract, ^betweenthe proposed R--5 area
and the existing single family residential area.
This area is reflected as medium density residential on the
land.use plan. The requested zoning is in compliance with
the land use plan.
The applicant owns an adjacent (to the west) 8.37 acre
tract.
The application refers to proposed fraternity house
development on this tract. Fraternities are conditional
uses intheR-5, R-6, and C-lzoning districts. This
request is for R-5zoningonthe subject tract. The
CommissionandCounci 1 shoulddet.ermine .theappropriate
zoning for this tract, considering all uses permitted in the
R-5district (see Section 7.7, page 7-7, Ordinance 1638).
Any proposed fraternity use at this location would be
considered by the Commission as a conditional use permit
requestata later date.
Staff recommends approval ofR.-,5 zoning as requested:
1. The requested zoning district complies with the land use
plan.
2. The applicant has provided an appropriate buffer to
minimizeconfl ict sw i th .1 owdensi t y residential areas.
The above recommendations reflect staff recommendation for
requested zoning. Any proposal for fraternity use will be
reviewed by the staff and Project Review Committee then
forwarded to the Commission.
P&Z ACTION: On 4-17-c8.6 theP&Z voted (5-1) to deny this request
to rezone 10.02 acres from R-2 to R-5. (Paulson again;not+;Df))
