AN ORDINANCE AMENDING ORDINANCE NO 850, THE ZONING ORDINANCE FOR THE CITY OF COLLEGE STATION ,REVISING DEFINITIONS OF AND REAll SETBACKS FOR ACCESSORY BULDINGS, STRUCTURES AND USES. WHEREAS, The City COllncil l1eld a public hearing in the City Hall '-at 7:00 P.M. on Thursday, May 9, 1985, on the question of amending Ordinance No . 8'5'0; AND WHEREAS, The City Council has determined to amend Ordinclnce No. 850; THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY o Ii' COLLEGE STATION, TEXAS: Ordinance No .850 ,The Zoning Ordinance is heret..y amended ElS follows: I-D.' 1. ACCESSORY BUILDING , STRUCTURE OR USE : Abuilding, structure or use which (1) is subordinate to and serves the principal building, structu.reo'r use; (2) is subordinate in area or purpose to the principal building, structure or use served andmayb'e.. attached to ordet.ached from the principal building, ,structure or use; (3) contributes to the comfort, convenience or necessity of occupants of the principal use served; (4) is located wi thin the same zoning district as tIle principal use; (5) is not used in residelltial districts for commercial purposes and is not rented or occupied by persone~ other than bona fide servants employed on the premises or members of the family of the occupants of the principal building or structure'. Examples of accessorybui Idings,' .8 t ruct ures, or uses include, but are not limited to private garages, greenhousee~, living quarters for family or servants~, tool sheds or bath houses. Persons are related within the meaning of this section if they are related within the second degree of consanquinity or affinity. THE DISTRICT USE SCHEDULE-TABLE A note I is amended as follows: A minimum rear setback of 15 feet is required and a maximum building eave height of 8 feet 'is allowed for accessory buildings, structures or uses excluding living quarters, garages or carports. The si'ze of the accessory structure shelll not exceed 10% of the' area of the principal structure., A minimum rear setback bf 20 feet is required for accessory buildings,structllresor uses when used as garages or carports. A minimum rear setback as requir,ed by TABLE A for the distri.ct in which the accessory building, structure or use is located is required when used for living quarters for family or servants. The area of the accessory structure shall not exceed 25% of the 1 area of the principal structure. On lots with approved rear access all setbacks shall be measured from the nearest boundary of the access easenlent or alley. On all other lots the setbacks shall be measured from therE~ar property line. This ordinance shall become effective ten (10) days after tile date of approval and publication.
