THE STATE OF-TEXAS:
COUNTY OF BRAZOS
This declaration is made by the Chimney Hill Retail
Plaza Joint Venture (Chi~ey Hill), a Texas joint venture, being
the owner of Lot One (T)., Block One (1), CHIMNEY HILL RETAIL PLAZA
SUBDIVISION, a resubdivisionof Block One (1), Fed-Mart Development
Co~poration Subdivision according to plat-recorded ih Volume 331,
page 135, Deed Records of Brazos County, Texas.
WHEREAS, Chimney Hillproposes'to divid.e the said

Lot-One (1), Block One (1), CHIMNEY HILL RETAIL PLAZA SUBDIVISION
into three (3) separate lots; ,and
WHEREAS,. Chimney Hill desir~s to preserve' traf.fic
flow, parking availability, .j.ngress and egress in the event of
a transfer of ownership if anyone fl)or more of the three (3)
sepa.t<4ate lots;
IT IS HEREBY DECLARED by the said Chimney Hill, for
itself, its successors and assigns that the three (3) lots made
the subject hereof be impressed with, the following covenants which
shall run with the land.
No barriers or fences shall be erected which would im-
pede or interfere with the movement of automobile and pedestrian
traffic among the ~ubject lots. All tenants, owners, licensees,
business inviteesand employees with respect to all tracts shall
have the right to use the areas designated as parking areas (which
shall include all.entrances, exits, driveways and walks) with. res-
pect to all other tracts. It is stipulated that "parking!! is con-

Each owner of any tract shall be responsible for
the maintenance of all parking areas, as contemplated herein,
and shall keep such areas free of rubbish, vegetation, .obstruc-
tionsof every nature and shall provide adequate drainage and
lighting thereon. Further, all parking areas shall 'meet at
equal grades.
This declaration shall be in force fora period of
ten (10) years frorndatehereofand may be earlier revoked only
by revocation proper.lyexecutedby one hundred (100%1; percent
of the owners of the subject property and entered of record in
the Official Records of Brazos County, Texas.
