P&Z MINUTES: AGENDA ITEM NO. 8. 85-121: A public hearing on the question of rezoning Lots 21 & 22 Block 1 w. c. Boyett Addition subdivision from R-6 ~partments High Density to C-3 PlannedCoDDllercial. Applicant is Marie Boyett Vance. Mr. Callaway explained the request, pointing out that one of the subject lots is the location of the existing Kinko's Copies, that the lots are within the area of the proposed Northgatezoning district,and C-3 would be an appropriate zoning until the new zoning ordinance is adopted. He further pointed out that these lots received a variance to setback and parking requirements from the Zoning Board of Adjustment in 1978which would still be in effect since variances go with the land rather than to an applicant. He stated that the area in which these lots is located is reflected as. commercial on the Land Use Plan, that the requested zoning district is intended for use on lots or tracts which are appropriate for conunercial zoning but are too small for the C-l zoning district, that C-3 is compatible with area zoning and uses, therefore staff recommends approval of this request. The public hearing was opened. Karen Yancy came forward as a representative of the applicant/owner, and. further explained the request. Ed Yancy caIlle forwrd to add that the vacant lot as it nowexlsts serves as a place for; others' refuse. No one else spoke. The public hearing was closed. . Mrs. Stallings made a motion to recommend approval of this request. Mr. MacGilvray seconded the motion which carried unanimously (5-0). 2
