Staff would recommend that the existing R-2 zoning be
retained for the following reasons:
A.Thecurrent zoning is in compliance with the land
use plan.
B. The current zoning and use (duplexes} of the lots

area to the south of Dominik.
This application states that the proposed use of this
property-Is for a nationalfraternityor.ganization. A
fraternity or sorority is a conditional use intheR-5
zonin,g .dlstrictand would bea separate request for
consideration by the Planning and Zoning Commission.

Mr. Callawayexplaineqareazoning, pointed out existing land uses in the area,
adding that the LaIld Ut;~ Plan reflects the area to the north of Dominik as low
density'residentialw.ith high, density residential reflected to the "south ,of
Dominik. He$ta.tedstaff would recommend that the existing zoning be retained as
it is. In! compliance >with the land use. plan ,..and also serves i~sa buffer1>etween the
established residenti~larea to the north ofDominikandth.e.high density area to
the south of Dominik ~He" then pointed out that the application states the proposed
use forthisl'o.tis:fdr-afraterni ty, which requires a conditional use permit under
our zoning ordinaxtce;andwould be a separate request forccjnsideration by the P&Z
Commission. He reminded the Commission that only appropriate zoning for this lot
is being considered tonight.
Mr. Kaiser asked the location of the existing sorority and fraternity houses in
this area and Mr. Callaway located them on a map. The public hearing was opened.
Martha Cox,power of attorney for applicant/owner Homer Cox, came forward and
statedtllat this duplex has been used for a fraternity meeting place in the past ,
that it has been on the market as a duplex ,for tIle past 14 months and has not sold,
proving there is not a demand for duplexzQning, and apparently there is delnand for
this type of zoning as... it reflects the only potential buyer for this lot. She
stated there wouldbebotllexisting and nat,ural buffers to the east and west, and
furthermor,e, there is now a fraternity hous,e on DODlinik, just 4 blocks to tIle east.
Mr . MacGi Ivrayasked why there is a need foir a ZOB ingchange if this has already
been used for a fraternity Ineet ingplace, andMs . Cox stated the fraterni ty would
like to officially hang their' letters. Mr. MacGilvray then asked if Ms. Cox is

aware of the various uses allowed in an R-5district, adding that. at least a
fraternity house would have to comeback before this body, but that apartments
could also be developed.
Jerry Trost, 1206 AshburIlt came forward to request that the existing zoning be
retained. After Mr. Trost s.poke,Mr. MacGilvray and Mr. .Wendler stated they are
both acquainted with Mr. Trost, but had not previously spoken with him regarding
this matter.
No one else spQke. The public hearing was closed. Mrs. Stallings stated that
although she feels sorry that theCoxes have not been able to sell their property,
she sees that as 110 reason tochange< the zoning. She then made amotion to deny
this request. Mr. Dresser seconded the motion to deny which carried unanimously
(7~O) .
