Staff Comments:
The lots described in this application do not correspond
with the latest plat of recordCsee enclosed plat). The
current plat reflects lotl,lotlB~ and lot 2 in this
subdivision. L.otl isc.urrently zoned C-,-l. It appears that
a portion of lot IB, approximately 2n' along the west side,
is also zonedC-l. The balance of lot IB :and all of lot 2
is zonedR-4.

The subject lots do not have direct access to any publ~c
street. Both lots front on a 24' wide,pri vate access
easement. A portion of this access easement is used for
commercial access at this time.
This area isrefle~tedas commercial and medium density
residential on the land use plan. An increase in depth of
commercial zoning off of Texas Ave. would be consistent with
the commercial development policies included in the
comprehensiveplan~
The currentR-4 zoning is considered. to be compatible witll
commercial zoning districts. These lots are bounded by C-I
zoning on three sides.
Staff finds both the current and requested zoning to be
appropriate at this location. The requested C-I zoning
would offer the following advantages:
A. Increase the de.pthof C-l in this area consistent with
area zoning patterns and in accordance with commercial
development policies.
B. Eliminate an "isolatedtt residential di.strict which is
bounded by commercial zoning on three sides and is only
accessible through a commercial area.
P&Z ACTION:
On 5-16-85 the P&Z voted unanimously (7~O) to recommend approval
of this request.

District C-l. Applicant is LewisJ. Kirkpatrick.
Mr. Callaway explained the request, pointing out there are discrepancies on lot
descriptions between those shown on the aPI)lication (which do reflect what is shown
on the tax rolls) and those on the staff report which are taken from the latest
plat of record. He referred to the copy of the resubdivision plat in the packet
whichreflectsa24 foot access easeIllent on which both lots front , andfro]IDWhich
they will take access. He explained that the area .is reflected as connnercial and
medium density residential on the land~~e>Plan,andthat an increase in the depth
of existing connnercial zoning offofTe~as Avenue would be consi.stent with the
commercial development ...policies incl11de~inthe comprehensive plan. He also
pointed out that existing R-4 zoningoD' the 2 western lots is considered to be
compatible witll cOlmnercial zoning districts which bound them on 3 sides.
Therefore, staff finds both the current zoning and the requested zoning to be
appropriat.e at this location, with connnercial zoning offering an advantage in that
it would increase tile commercial depth ,and would eliminate an isolated residential
district which is only accessible through a commercial area. Mr. Dresser asked. if
tile City would be concerned wi th the adequacy of the existing access if th.is

request is approved and Mr. Callaway replied that it would not since the access
width is 24 feet,addiIlg.that would be reviewed at site plan permit time.
The public hearing was opened. Mr. L.J.Kirkpatrickcameforward to answer any
questions. Mr. Dresser asked him if he is also the owner of the lot on Texas
Avenue an.dhereplied that he is, and that it is the location of Luther's Barbequeo
No one else spoke. The public hearing was closed.
Mr. MacGilvray said his only concern would be with access to the rear lots, and
since Mr. Kirkpatrick owns it all, that problem should be solvable.
Mr. MacGilvray then 'made amotion to approve the request to rezone Lot 1B ~md Lot 2
of the Kirkpatrlck Subdivision from R-4 toC-l.Mr.Dresser seconded the motion
which carried unanimously (7-0).
