DEVELOPMENT <AGREEMENT
THIS AGREEMENT is made this the 19th day of September, 1984,
by and between the CITY OF COLLEGE STATION, represented by and
acting through its Zoning Official, Jane Kee, and JIM SUTTLES
INTERESTS, Applicant for building permit represented by Arthur
steinberg o.f Steinberg/Wallace & Associates, AlA. Theparties
agreea.s follows:
That Ordinance No. 850 of the Ordinances of the City of
College Station requires interpretation as to the meaning of
acc,essoryuse as that term is applied to additional buildings to
be used in an apartment complex. The Applicant desires to build
a structure with two leasing offIces, an adjacent living rooml to
the I,easing off ices,restrooms,boiler room and wash room. This'
structure is interpreted to be an accessory use under Section.

subordinate toa.ndserves a principal building or
use; (2) is subordinate in area, extent, or purpose

the principal use served; (4) is located within the
same zoning district as the principal use; (5) in
residential districts is not used for commercial
purposesandisnotrented.oroccupiedbypersons
other than bona fide servants employed on the
premises. and members of the family of theoccupant( s)
of theprimarystructuree. Examples of accessory
buildings,struct'ures, or uses include ,but are not
limited to",privategarages,g.reenhouses, living
quarters or family or servants, tool sheds or bath
houses. Persons are related within the meaning of
this section if they are related with th~ second
degree of .consanguinity or affinity.
As an accessory use, the parking requirement for this structure
has been met. Use of the structure asa "club", "party room",
etc. which allows individuals, including individuals outside of
lessees, to utilize the structure in such a manner as to not be
interp~eted as an accessory use and/or as requiring more parking
shall constitute a violation of the Ordinance. It is understood
that violations may be charged for each day of each such
violation. Further, the parties agree that upon presentation of

the Affidavit of the Zoning Official or Assistant Zoning Official
toaDistrict Court of Brazos County that a.ny one of the
provisions has not been complied with, the City shall be entitled
to a temporary injunction prohibi tingoccupation of thestru(~ture
except for owner' srepresentatives necessary for' security andl
maintenance. The Applicant hereby confesses judgment as to such
a temporary injunction. Arthur Steinberg, as architect and
agent, represent.s that he is authorized to execute this AgreE~ment
on behalf of the undersigned business entity in that he is the
ageotofthe Applicant and owner of the project.
The attached copy of the site plan for th.eMonticello
Apartment complex, the subject of the agreement herein, is
incorporated herein for all purposes.
