requested zoning is compatible withexistinguses/zoning in this area, the
staff cannot support this request as the tract's current zonin<gis in
compliance with the city 'sLand Use Plan. He state'd that the Planning and
Zoning Commission recommended denial IIwithoutprejudicell (waiving the 180
day waiting period for resubmission) bya vote of 6--0.
Jim Jett, owner of the tract and applicant, stated that his plarlfor
developing the proposedA-P zoned tract abutting the creek inclt1des an
office complex andwould,be developed as a ,united plan with the bank tower
scheduled to be built on the existing A-P land which fronts on Ilarvey Road.
He explained that he is requesting t.hat these items be tabledtc) give the
Council an opportunity to view the Ri.chards Subdivision area and to
consid.erhisplansfordevelopment of these tracts as ..theHoll'enlan Street
- extension is constructed. He further requested that the rezonirlg process
take a more formal approach with more direction-from t.heCouncil.

indefinitely.
Councilman McIlhaney seconded the motion which was approvedunarlimously,

Assistant Director of Planning Callaway presented the item. He stated that.
this request concerns a7. 00 acre tract, 5.19 acres of which arE~inside the
city limits. He noted t.hat the change requested is from A..... 0 toC-lzoning.
He explained that the city Council returned this item to the Planning and
Zoning Commission for consideration of a.combinationof C-3!A-P zoning and
in accordance with the applicant 'sre<!uest, a 3 acre C-3 area on the
northern portion of the tract, with 61.2.19 acre A-Parea on the southern
portion of the tract, was considered by the commission on Febrl.la.ry 16,
1984. He furtherst.atedthat. the Commission recommended denial of the
C-3!A-P proposal by a vote of 6-1.

Charles.Ellison,iownerofthe tract, explained that he purchasecl the
property .two years.....ago for retail purposf;sand hoped that some t:ype of
zoning allowingt.hat. use could be approved.
