(
AN ORDINANCE AMENDING THE ZONING ORDINANCE NO. 850,.REV1SING THE LANDSCAPING REGULATIONS.
WHEREAS,the City Council held a public hearing in the CIty Hall at 7:00 P'.M.on Thurs-
day, February 23, , 1984, on the questi on of amend ing the Zoni ng
Ordinance Nos 850;
AND WHEREAS, the City.Councll has determined to amend Ordinance No. 850;
THEREFORE, BE IT ORDAINED BY THE CITY COUNCil OF THE CITY OF COLLEGE STATION, TEXAS:
,The Zoning OrdInance No. 850 is hereby amended as follows:
7-De APPLICATION OF SECTION.
1. Except as otherwise provided below, the landscapIng requirements ()f this
SectIon shall apply to all land located in the City of College Stcition.

For the purposes of this section ',the following terms> shall have the spec i al

Canopv.Tret! -Anyself-supportingwooclyplantwi h one well defined trunk
and a distinct and definite formed crown which a tains a height of at least
30 feet.

Non-Canopy Tree - Any self-supporting woody plant with one or more trunks .
which attains a height of at least 15 feet.
ExistIng Tree - Any self-supporting woody plant, except Celtis occidental is
(Common Hackberry), wIth one well defined trunk six inches in diameter or
greater at one foot above the grQund.
Shrub" A woody perennial planting differing from a perennial herb by its
morewQodystem and fromatree~y its low stature and habit of branching
from the base.
Groundcover -A spreading plant including sods and grasses less than 18 inches
in heIght, whichtsused for er.osion control.
Barricadeareaforexlstingtrees-A protected>areaextenqing in a radius
seven feet from every protected tree that prevents intrusion by construction
equIpment and other vehicles.
Parktng- Interior-Parking rows which are not located on the periphery of
the proposed project s' te and further, where, none of. the parking spaces abut
any property llneassocjatedwith the proposed project site.
Parktng,',- PerIpheral-Parking rows consistIng ofindtvidual parking spaces
which abut the perIphery or property lines assocIated wIth the proposed
project sIte.
SIngle Parking Row: A sIngle row of spaces for the parking of
asl11ustratedlnFigure 1. Double Parking ,Row: Two p~rallel
rows of spaces for the parkIng of motor vehicles arranged so that when parked,
the front end of each motor vehicle faces the front end of another motor

Parkl'ng Space - A space used for the parktngof a motor vehicle, whe,re said
spacels not less than ntne(9}feetwlde,twenty(20) feet long and contains

7-0.3. PROCEDURES
(1) Whenslte planrevtew by thePrqJectRevtew Committee and/or the Planning
aridZontng Commission is required the site plan shall con-tain theinforma-
tion listed in the subsection below.
a. The location of existing boundary lines and dimensions of the tract.
b. The locatIon of existIng and proposed utility easements on or adjacent
to the lot and the locatIon of overhead power lines.
c. The locatlon~ size and type of proposed landscaping in proposed land-
scaped areas; and the slzeof proposed landscaped area. Botanical
nomenclature as well as common names must be listed.
· d. All canopy trees must be labelled as containerized or balled and bur-
lapped.

1. LandscapIng points are generated by either the square footage of the
development or the number of its parking spaces. The higher of the two
point totals will .be applied. The minImum number of points for any develop-
ment is" 500, points .

3. (a) Groundcover is required in parking lot islands, in swales and
drainage areas1 'in the 8 foot setback area provided by Section 7.0.7
and In all unpaved portions of street or highway right-of-way abutting

4. Everypr.oJect must expend a minimum of 50% of its point total on canopy
trees.
5. Landscaping must be reasonably dispersed throughout the development.
6. To receive 150 points for existing 6'1 caliper trees, a barricade with a
minimum radius of seven. (7) feet from every protected tree must bE~ installed
prtortogradtng and construction. The barricade must remain in place
untllall ground dIsturbing activities are completed. If the protected
tree(s) is located in a parking lot island the barricaded area must become
thetree(s)lsland upon project completion. No utilities or sprinkler
system may be located In thebarrlcaded area. This area shall not be
used as a' storage area or dumping area for paints, concrete, and ()ther
toxicantsdeleterloustoa tree's survIval during any phase of th.~ project.
7. Every development must employ either a sprInkler system or have a hose
connection within 150 feet of any landscapIng.
8. Replacement of dead landscaping must occurwithJn 45 days of notification.
Rep,lacement mater.lal must be of similar character and the same or higher
point total as the dead landscaping~
9. All landscapfngmust be completed before a Certlficateof Occup~ncy is
Issued. However,plantingof trees and shrubs between June 15th and
September 15th may be delayed until October 15th. During this three-month
perIod landscaped a'rea must have all groundcover in place before a Certificate
of Occupancy is Issued.
10. Eroded or otherwise displaced sollmust be removed from the R.O.W. abutting
thedeyelopment before the CertIficate of Occupancy will be issued.
7-0.5. LANDSCAPlNGGUIDE
1. The City Forester shall determine which types of generally used plants
arevfablein the College Station area, and shall/prepare a guide of
such plants, setting forththeJrgeneric and scIentific names. At
the request of t.he P 1 ann i ng Department, theCommlssi on ,or any app 1 i -
cant, the Forester wIll determine the viability of any other plant
variety proposed for utIlization upon a plan, or for inclusion in the
guide,
2. The Planning and Zoning Commissionmay'conslder and approve any other
plant variety not listed in the guide on the basis of viability in the

All mattersinvolvtng the preservation, pruning, plantIng and removal of trees
and shrubs in parks ,alongClty streets and in other public places shall be
the responsibilIty of the Community Appearance Committee and the City Forester.

7-D~11o REVIEW AND APPROVAL BY THE PROJECT REVIEW COMMITTEE
Any IndIvidual desIrIng to place structures and/or facilities in any Zoning

notify the indivIdual of the time', date and place for the plan to be reviewed
by the Project Review CommIttee .(PRC}.The deliberations of the PRC shall be
recorded and fIled lntheofficeoftheDlrectorof Planning. A copy lof the
report shall be sent to the Indivldual(s) seeklngapp.roval of the plan. The
PRCmayrecommend, and the Planning and ZonIng Commission may impose additional
cond i tions..and rnayfurth~r mod i fy the Literal terms of thisordi nance where
suchmodlflcati ons,orconditions ,a re re:asonably necessary to insure the
protection of public health, safety and general welfare,andwhere such condi-
tlonsormodlflcatlonsarereasonably required to implement the intention of
this ordinance, asreasonably'apparentfrom its terms, and do ,not impose a
disproportionate or arbitrary burden upon any particular property owner.
7-0.12. PENALT1ES
Any property owner failing to comply with the prOVISions of this ordin,ance
shall begutltyofa misdemeanor arid liable fora fine of not less than twenty-
'five dollars ($25.00) nor more than two hundred dollars ($200.00l. Each day
sU,chvlolation shall be permitted to exist shall constitute a separate offense.
7-0.13. VARIANCEANOAPPEAL,PROCESS
(
Any request fora variance to the requirements of thisordlnance or an appeal
ofthePRC'srecommendationswil1 be heard by the Planning and Zoning Commission.
The request shall be flledw.ith the Zonlng OffIcial, in writing, no later than
ten (10) days after thePRC meeting. The Planning and Zoning Commi ss ilon shall
corslder the request at a regularly scheduled meeting within twenty (20) days
of receipt of the request. The decisi.onbythe Planning and. Zoning Commission
sha 11 be sub] ecttoappeal by anapp licant or by the City pursuant to the
statutory andordtnancerequirements and provIsIons pe<rtaining toappe,als to
theZon~ngBoard of AdJustment.
7-0.14. REPEAL OF CONFLICTING ORDINANCES
Anyordinancelnconfllct:wfth this ordinance,or which is inconsistent with
the provisIons of this ordinance is hereby repealed to the extent necessary
to gIve thIs ordinanee ful:l force and effect.
7~0.15. SEVERABILITY
Should any action of this ordinance be declared by a court of record to be
unconstItutional or lnvalid, such decision shall not affect the validity of
the ordinance as a whole or any part thereof other than the part so declared
to be unconstitutIonal or Invalid.
