WHEREAS,the City Council held a public hearing in the CIty Hall at 7:00 P'.M.on Thurs- day, February 23, , 1984, on the questi on of amend ing the Zoni ng Ordinance Nos 850; AND WHEREAS, the City.Councll has determined to amend Ordinance No. 850; THEREFORE, BE IT ORDAINED BY THE CITY COUNCil OF THE CITY OF COLLEGE STATION, TEXAS: ,The Zoning OrdInance No. 850 is hereby amended as follows: 7-De APPLICATION OF SECTION. 1. Shrub" A woody perennial planting differing from a perennial herb by its morewQodystem and fromatree~y its low stature and habit of branching from the base. Groundcover -A spreading plant including sods and grasses less than 18 inches in heIght, whichtsused for er.osion control. Barricadeareaforexlstingtrees-A protected>areaextenqing in a radius seven feet from every protected tree that prevents intrusion by construction equIpment and other vehicles. Parktng- Interior-Parking rows which are not located on the periphery of the proposed project s' te and further, where, none of. the parking spaces abut any property llneassocjatedwith the proposed project site. The location of existing boundary lines and dimensions of the tract. b. The locatIon of existIng and proposed utility easements on or adjacent to the lot and the locatIon of overhead power lines. c. The locatlon~ size and type of proposed landscaping in proposed land- scaped areas; and the slzeof proposed landscaped area. Botanical nomenclature as well as common names must be listed. · d. Every development must employ either a sprInkler system or have a hose connection within 150 feet of any landscapIng. 8. Replacement of dead landscaping must occurwithJn 45 days of notification. Rep,lacement mater.lal must be of similar character and the same or higher point total as the dead landscaping~ 9. All landscapfngmust be completed before a Certlficateof Occup~ncy is Issued. However,plantingof trees and shrubs between June 15th and September 15th may be delayed until October 15th. During this three-month perIod landscaped a'rea must have all groundcover in place before a Certificate of Occupancy is Issued. 10. Eroded or otherwise displaced sollmust be removed from the R.O.W. abutting thedeyelopment before the CertIficate of Occupancy will be issued. 7-0.5. LANDSCAPlNGGUIDE 1. The City Forester shall determine which types of generally used plants arevfablein the College Station area, and shall/prepare a guide of such plants, setting forththeJrgeneric and scIentific names. PENALT1ES Any property owner failing to comply with the prOVISions of this ordin,ance shall begutltyofa misdemeanor arid liable fora fine of not less than twenty- 'five dollars ($25.00) nor more than two hundred dollars ($200.00l. Each day sU,chvlolation shall be permitted to exist shall constitute a separate offense. 7-0.13. VARIANCEANOAPPEAL,PROCESS ( Any request fora variance to the requirements of thisordlnance or an appeal ofthePRC'srecommendationswil1 be heard by the Planning and Zoning Commission. The request shall be flledw.ith the Zonlng OffIcial, in writing, no later than ten (10) days after thePRC meeting. The Planning and Zoning Commi ss ilon shall corslder the request at a regularly scheduled meeting within twenty (20) days of receipt of the request. The decisi.onbythe Planning and. Zoning Commission sha 11 be sub] ecttoappeal by anapp licant or by the City pursuant to the statutory andordtnancerequirements and provIsIons pe<rtaining toappe,als to theZon~ngBoard of AdJustment. 7-0.14. REPEAL OF CONFLICTING ORDINANCES Anyordinancelnconfllct:wfth this ordinance,or which is inconsistent with the provisIons of this ordinance is hereby repealed to the extent necessary to gIve thIs ordinanee ful:l force and effect. 7~0.15. SEVERABILITY Should any action of this ordinance be declared by a court of record to be unconstItutional or lnvalid, such decision shall not affect the validity of the ordinance as a whole or any part thereof other than the part so declared to be unconstitutIonal or Invalid.
