Grade. changes are frequently necessary' while
building si tes are being prepared for construction.
Often the building site has .been chosen because of
theprese~ceofmature trees. However,any.change
in grade around existing trees can have a marked
effect .on their survival and future. growth. Unless
corrective steps are taken immediately, lowering
the grade exposes the existing root systelnto the
air and reduces .the supply of nutrients andmois.:.
ture available to the roots.
Raising the grade or soil level over existing
roots can have an even greater effect on the f~ture
growth and survival of existing.. trees. When .fill
of any type is placed over the existing root system,
it causes a reduction in the. oxygen supply to the
tree roots and slows down the rate of gas exchange
between the roots and the air in. the soil pore space.
,Both oxygen and . water are essential to .the
growth, development .andnutrientuptake of the
roots. Many of the soil.. organisms also utilize . the
water .and. oxygen. in their normal growth . processes.
Lack of oxygen.. in the soil may result in .accumu-
lation of. noxious gases. and chemicals detrimental
to good growth. When this occurs,. the feederroots
fail to develop, . the roots die and the above-ground
portion of the tree begins to decline. Many factors
-including tree species, depth and type of fill,
drainage, soil structure below the fill and the gen-
eral vigor of .the. existing tree-have a . determining
influence upon the time it takes for the above-
ground symptoms to appear.. Thus, it might take
anywhere .. from several months to.. as. much as 3 to
5 years before death of a tree would occur.
Determining · Feasibility. ofPreventinglniury
When thegradearoundan.established tree is
being raised, careful consideration should be given
to methods of preventing injury to the tree before
the fill is .made rather than.attempt to take correc-
tivemeasures after the damage has.been .. done.
While the initial cost maybe . high, ... preventing

darnage is always. cheaper and more effective than
attempting to correct the situation after the dam-
age has been done.
Several important factors. should be considered
in attempting to determine whether the cost of
saving tile tree is worth the effort and expense of
making . the. installations necessary to prevent or
reduce extent of injury.
Density of. Tree Population. Where trees are
scarce, any attempt to save one or two sound trees
is usually worthwhile. If there are numerous trees
on the property, the property. owner may 110t feel
that the cost to save one or two in the immediate
construction si te is justified.
Species and Variety. Some of the fast-growing,
short-lived trees are not worth the cost of trying
to save them. But a good healthy tree that is
mature or adapted -to the area, with a. long life
expectancy, is difficult to replace. For such t~eees,
the expense of providing. the necessary protection
can frequently be justified.
Age and Vigor of. Existing Trees. The. condi-
tionof.the tree is an important factor in deter-
mining its worth. If it has many large cavities,
has been severely damaged by lightning or storm
or. has lived out a normal. life span, it is difficult
to justify the expense and labor necessary to save
the tree. This is especially true if there is danger
of losing it.to.othercauses. But a young,.vigorous
tree, if attractive and.. well. placed, would be valu-
able. enough .to save. .
Proper< Installation of FiUAround Existing Trees
All vegetation should. be removed, including
sod and underbrush beneath the branch spread of
the tree. Organic matter, as itdecomposes beneath
asoil..fill, can create noxious materials detrimental.
to... the. tree roots.
The soil surface should be cultivated or broken
up so that the least possible amount of root dis-
turbancewilloccur.Thistreatment allows better
contact with .the. fill. soil and prevents. a sharp line
of demarcation between the existing surface and

ZONING BOARD OF ADJUSTMENT
RULES AND PROCEDURES
I. ApplicationProcess
a. Application forms are available in the office of the Zoning Official.
b. Completed applications are to be returned to the Zoning Official
no later than noon on the\~ed. preceeding publication date.
II. Fee Schedule
a. There is a $10.00 base fee to cover the cost of newspaper notice.
b. There is a $2. on per property owner within 200' fee to cover the
cost of mailing.
c. Fees are paid at the Tax Office and a receiptturnedinasa
part of the application.
III. Notification Schedule
a. ~Joticein the Eagle will be published on the \.Jednesday preceeding
the meeting.
b. Letters to property owners will be mailed not less than one (1)
week preceeding the meeting.
c. Packets forZBA members will be available on the Friday preceeding
the..meeting.
d. Notice of meetings will be postedFridaypreceeding the meeting.
IV. Rules and Meeting<Procedures
a. The Board will follow Robert' sRules of Ot'Jder, newly revised.
b. Witnesses:
(1) All" witnesses shall be placed under oath by the following statement:
"Do you swear or affirm to tell the truth in this proceeding,
under penalties of perjury?"
(2) Witnesses shall include the applicant, any interested per.sons
wishing to speak, and staff members.
(3) All witnesses shall be sworn in by the Chairman.
c. Motion Format Form
(l)Eachcas~ shall be reviewed using the Motion Format Form (see attached) ·
(2) Board cotlsensus shall be placed on the Motion Format Form, kept as part
oithe application file after being signed and approved.
d. Motions
(1) Motions shall be made based on the 11otionFormat Form and may
be positive or negative based on Board consensus.
(2) Neg~tiveMotions {motions to deny a request) should be made when
the board cannot find uniqueand:special conditions, undue
hardship, or that the spirit of the Ordinance will be" preserved.
(3) Mot~ons to deny a request (negative motions) which fail do no!.
imply the. request is granted.
(4) Requests are only granted when a positive motion is approved.
e. Minutes
(1) Planning Technician shall record all meetings.
(2) Minutes shall be prepared in paraphrased form to reflect pertinent
points of discussion.
(3) All rninutesshall be signed by the Chairman when approved.
(4) Tape recordings shall be kept for 3 years.

f. Applicants may not resubmit the same request regarding the same piE~ce of property
without the Board's approval. When an applicant's request is denied, ~t"he
applicant may immediately request that the Board consider the appl:ication
again, at some future date.
v. Ordinance 1301
The City's.flood plain Ordinance adopted June 25, 1981 provides that variances
to the requirements of this Ordinance shall be heard by the Zoning Board of
Adjustment.
