THIS AGREE:MENTlTt<adeoJltfu.is thellt;n d$,~0,;~ Ju].y, 1984, by
and between the City of COllege Station, a Texas MuniCipal Cor-
poration, and BILL CARIKER and LYNNE HUNT, parnters in tfue real
property more fullY-described in the attached Exhibit "A".
The parties agree to the following facts and circumstances:
'1. That theprop.erty is located in an area that was in the
last annexation of the City. Said annexa'Cion occurred on
December 8, 1983.
2. That Bill Cariker and Lynne Hunt misunderstood the
Building DeI;!>artlTtenthead when applying for a permit to locate and
move a house onto the property in the attaChed Exfuibit "A".
3. That the property, more fUlly described in the attached
Exhibit "A", is currently zoned Agricultural--Open, A-O, and as
such, is short two acres for the placement of a home thereon
under the current ordinances of the City of C.ollege Station.
4. That, while acting under the erroneous belief that they
could place. a house on the property, Bill Cariker and Lynne Hunt
moved a house Onto the premises in violation of the ordinances of
the City of College StatIon.
FOR AND IN CONSIDE: RAT I ON of t.he promises set Qut herein, the
part.ies agree as follows:
1. That Bill Cariker and Lynne Hurit may store the house' on
the propert;ydescrlbed in the at.tachedE:xhibit "A", but the house
may not beset ..on a permanent foundation.
2. That the storage of the house on the ldt will be
temporary innat1.lre, subject to the following conditions being
met:
A. Bill Cariker and Lynne Hunt must make an
application to the Planning & Zoning Commission of the City
of College Station by July 13,1984. Further, they must
secure a rezoning to R-1 Single Family from.the City Council
on August 9, 1984.

B. The> City of College Station will not authorize any
utility inspection,s before the approval of the rezonin:gby
the City Council.
In the event the City Council d.oes n.ot
grant the property arezoningtoR-1 ,the C ityofCollege
Station will not make the utility inspections afte,rAugust
9, 1984.
3. Bill C arlkerandLynneHunt will depo s it wi ththeC i ty
Attorney of the City of College Station, either a check or letter
of credit for ONE HUNDRED FIFTY AND NO/100 ($150 .:OO:),DOLLARS,
which sum will beheld by the City Attorney. Intheeverrt that
thepartiesfai.l to secure a rezoning from the City Counc!i:l and
thereafter fail >toremove the housefromthelotbySeptemtjel;:" 30,
1984, then the City Attorney will be authorized to take the money
as damages for failure to conform with the obligations of this
contract.
In the event that Bill Carikerand/orLynne Hunt
install utilities to the premises prior to August 9, 1984, the
City Attorney is authorized ,to take the One Hundred Fifty
($150.00) Dollars as breach of contract damages. This sum in no
way effects the right of the City to enforce its ordinance either
in the Municipal Court or by injunction.
The parties agree that they have read this contract andful-
ly understand~ the consequences thereof and hereby fully agreet.o
the contents.
