Under the present ord"inance requirement rear setbacks for' all structures are

Under the present ordinance requlreOlentrear setbacks for all structures .are measured
from therearpfbperty line. On lotsthat'sbut an alley the boundary of the ~lley is
also the reClrproperty line. On lots that abut private access easements the rear proPerty
line Is typically in the center of the private access easement. This results in a dif-
ference in effective rear setbacks for lots abutting alleys as opposed to lots abutting

. private access easements. Frequently builders, developers or lot ~ners are confused by
the visual difference in setbacks along ~he different types of rear access ways.
The proposed note "1" to be added to the District Use Schedule - Table A would allow for
the placement of accessory structures.15 feet from the boundary of a private access ease-
ment or publ rc alley. This would allow consistency in locating garages in the rear yards
of lots where rear access is provided (setback problems encountered have been I imited to
the'placement of garages).
All accessory structures (greenhouses, tool sheds, etc.) would be able to utilize the
plO(X)sedl5 ft. rear setback. This is not anticipated to create any problems as there would
be an additional 20 feet of access way plus 15 feet of setback from any structures 10-
