To answer your question, regarding thedentention of water on the above project:
The City Of College Station has no surface water design ordinancewhfch specifically
refers to the retentionordententionof surface water on developed sites. We have
been asking those whodevelop~pr;'operties to make all reasonable attempts necessary
not to increase the post development rate of runoff or concentrateithedischarge
i na manner which will cause damage to'downstreamproperti es. It is my' understandi ng
that the laws of this state contain volumes of statements regarding:', "the handling of
surface water andtherel atio,nshipsof upstream and downstream landowners. It appea rs
to, me that downstream landowners are" responsible to accommodate 'only that runoff from
upstream properti eswhich has not beenal tered by constructi'on.' '

In my position as the GityEngineer of College Station, I am charged with the
responsibi lity of protect ingpublic health7safetyandgenera 1 welfare , as di rected
by the City Council. Since storm water ultimately leaves one ,persons property and

devastating effects of storm water endured by lithe public", have":'long and frequentl y

of this community, relative to storm water drainage, byrequirfng:eac h property owner,
large and small, to do hi s<parttoreduee future devastationfromtheeffeets of
storm waterrunoff>bymakingeveryeffortlfeel is reasonable not to increase the
fl owo f water from his property to his neighbors., Some si tes'are mo,re suitable to
water control thanothersand,as such ,are required to make a,greater effort., Small
sites are limited bytheir.size 'to how well they can accommodate the process of
controlling water. Fortunately they contribute small amounts to the problem and are
usually part of a:subdivisionofa large property which has provided wide area runoff
control. Large sites create large volumes of runoff and impact their neighbors more
severely. Therefore, they have a greater responsibility to be a "good nei ghbor" and
provide more control of their problem.

Recently, all projects which are greater in area than 1/2 acre and which propose
to cover more than 40% of the; r areaw; thimpervious materials, have been required
to submit a drainage study tome for consideration and approval. Myapproval;s
based onmyeval uation of the impact of the proposed runoff'on adjacent and
downstreamproperti es,i ncludingpu bl icproperti es, utflittes,dra i nage systems,
etc. and the "rea sonabl eness II of the e'ffort made to reduce the post deve 1 opment
increase of runoff . IIReasonabl eness" has little to do with dollars cost except
as compared to the total cost of the proposed development and the private and public
cost incurred asa, result of the project. In order for me to review a proposal,
I ask that an estimate be made of the rate of runoff beforedevelopme:nt, the rate
of runoff after development with no effort 'to control the sameandi;th'e rate of runoff
when controlled. This enables me to evaluate what effort isbeingrnade to be a
IIgood nei ghborll .

consideration given to the retention or detention0f surface water for
the Aldersgate tract.
It is our understanding that Garrett Engineering will be doing the
drainage study for the church.
It is also our intention to work with the City Engineer on this
matter.
I would only ask that a copy of any correspondance directly related
to this pro'ject, would be sent to our office.

Dear Mr. Rinehart:
At the time your building passed final inspection for its Certificate of Occupancy,
I received from you two letters of intent which stated:
(1) The church would replant the 9 dead pine trees in the large island
where your sign is located by October 15;
(2)
Problems ,involving undersized parking (regular spaces - 11 at 9 ft.,:
handicapped space -one at 12 ft.) would be resolved within 30 days
(by August 6). At that time, r decided that you could cross-stripe
the inadequate spaces for motorcycle parking. This would be a much
more lenient solution, ratherth,anrequiring the church to tear out
concrete curbing in the island to 'widen the spaces.

This letter is intended to remind you of your Oct. 15 deadline for replacement
of the 9 pine trees. If you have any questions regarding species selection,
please consult theTAMU Horticultural Extensio'n Service, the College Station
Forester, orme._ Also at this time I am informing you that the remaining
trees on the 'site (live oaks and crepe myrtles) which.have died since the
Certificate of Occupancy must be replaced within 45 days (Nov. 27,1984). This
is required by Section 7-D.4.(8) of Ordinance 850, the Zoning Ordi.nance which
reads:
7-D.4.(8) Replacement of dead landscaping must occur within 45 days of notification.
Replacement material must be of similar character and the saJ:Ile or higher point
total as the dead landscaping.

May I suggest now,asI. did at ,the time of original planting , that you consider
choosing 3 or 4 varieties of trees. This would insure survival of at least
some trees in the event of harsh conditions.
As far as correcting the parking space problems, I will .allow until Oct. i8 for
the undersized spaces to be cross-striped and labeled for,motorcycle parking.
After this date, complaints will be filed" in Municipal Court. I will additionally
request at Court ..that . corrections ,to the undersized spaces be resolved by tearing
out 'concrete in the islands to retrieve the footage needed.
If any of the above situations (landscaping and parking) are not corrected by
the appropriate deadlines, complaints will.be filed in Municipal Court. Each
dayofviolatton counts.' as a separate offense ,and is subj e.ct to fines from
$25.00 to $200. 00 for each offense. Since i the parking corrections 'are already
long overdue, no less than 7 complaints will be filed if the new deadline' is not
met.
