On June 5, 1990, I spoke with Jim Baker of Franklin Savings in
Austin; phone (512) 479~3347. He indicated to me that they have
hired a contractor to correct the violations and, that work should
begin immediately. He said his firm has to get permission from
FSLIC in order to do anything and that is the reason for the

As you may not be aware, Parkway Square Shopping Center is not in compliance with
,the City's landscape. ordinance. While new plantingswere done in June of this year,
many of those pla,ntsand trees died. The shopping center landscaping looks very bad as
of this date, with many of the dead trees leaning over and some appearing ready to fall
completely.
We have been working with the new owners of the Kroger side of the center to bring
the landscaping,into compliance.. We. have been dealing with Mr.. Conrad Ollenburger
of Weingarten Realty. He' mentioned that he has spoken with you regarding the
landscape. compliance. . Technically compliance on . your side of the property (since you
did not change owners) should have been back on Nov. 5, 1990 while under the auspices
of Culpepper Properties. However, through an oversight on our part, T G & Y was not
legally notified of the dea.dlineex1:ension to January 7, 1991Jor compliance for the
entire shopping cente~as request~d pyWeingarten Realty.:\Veingarten was notified.
Therefore, ple~se be aware that you have a . Feb. .J8, 1991 deadline for your part of the
shopping center to be in compliance with our landscape ordinance.
Compliance is based on the · landscaping plan in our files and contains. 4460 p,oints on
our landscape point scale. But basically, if you replace the dead and dying vegetation on
your property with similar species in healthy condition you will be incompliance. I urge
you to the meet the deadline or earlier for the main reason that our planting season is
very short here. The plants must have time to. establish roots before the heat of the
summer or else they soon die.
Please be aware that. after the deadline the enforcement will be turned over to the
Enforcement Coordinator and charges will be · filed in Municipal. Court.

If you check the. viability of the extant plants, match the attached plan, and prune

anchored shopping. center. There is ample on-site. circulation and access to the individual

The majority of the excess parking appears to>be, located in the lot adjacent to Texas
Avenue where parking is at least 400 feet from the main retail building.
Possible uses of the available pad site are either a freestanding retail building or a fast
food facility (see Attachments 11 and 12). The parking requirements for the center under
these two plans are:

not the parking.

Description of the Take
The take is a O.171-acre (7,447 square foot) rectangular shaped parcel averaging 15.37
feet in depth across the full frontage. Approximately, 2,753 square feet will be taken from
the portion of the property used. by the fueling station pad and4,694 square feet of the
balance from the center. Approximately 3,493 square feet of paved drive, the concrete
curb fronting the drive and landscape trees fall within the take (see Attachment 13). No
portion of the buildings but partof38 parking spaces will be taken.
Use of the Remainder
The remainder can .be reconfigured as shown in Exhibit B-1 so that the loss of parking is
only 33' spaces.' The lost spaces are ones that average 500 feet from the main building.
The reconfigured remainder will provide. 822 spaces, which . is .49 more.. spaces thCiD
required by City ()rdinance. The.cost to reconfigure the property as proposed in ~xhibit B
is estimated at $44,500 as detailed in Attac1uIl.ent 14.
Either of the two uses ,proposed for the whole property's available pad site could!be
developed on the remainder.padsite{see Attachments 15 and 16). Parking requinements
for the center would. be:

In both of these, cases, the size of the building is limited by the available parking.
The only remaining unobstructed view of the retail space from Texas Avenue is to the
north of the , entry drive where there isa potential pad site. 'Any use of this site fora'
stl11cture. wouldfurtherdiminishthecenter'syisibilityfrom Texas Ave~ue. Thislloss of
visibility would probably reduce. the desirability and function of the lease space. behind it.
All plans for reconfiguration assume that the City of College Station will approve
remainder plans with levels of non-conformity equal to or less than that found on the
whole.
Conclusions
1. The whole property is improved with a grocery-anchored ,shopping center that is
efficiently designed but provides 10.1% 'more parking than is. required.
2. The excess parking is located further from the lease space than is generally desirable
for such,~ shopping center.
