CODE ENFORCEMENT AGREEMENT
This is an agreement pertaining to Enforcement of the
Codes and Ord,inances of the City of College Station as to the
project which shall be referred to as the Ramada Inn Remodeling
and Tower Construction Project, located at 410 Texas Avenue
South, in the City of College Station, Texas. This agreement is
between the CITY OF COLLEGE STATION, a Texas Municipal
Corporation and JOE FERRERI, INDIVIDUALLY, JOE FERRERI, INC. and
, hereafter called "RAMADA". There
presently exists certain instances of non-compliance with City
Codes or ordinances as follows:

1. Lack of cU,rbs along the rear of the
parking lots on Meadowland.
2. Lack of screen'fencing. between the
northernmost parking lot of Mea.dow-
land and the adjacent fourplexes.
3,. Incomplete landscaping.
The part ies agree that 'the instances are presently in
violation of the Zoning Ordinance of the City of College
station. RAMADA agrees' that the ordinance'( s) referen'ced are
valid, being lawfully enacted and presently in force and in
effect.
However, in the interest of avoiding litigation:
1. The City of College station has issued a
temporary certificate, of occupancy for the
remodeling and<tower construction project.
The permit shall be valid for a period of
sixty (60) days from the date herein ,con-
ditioned upon strict compliance with the
provisions of ,this agreement.
2. When the cond,ititonshavebeen satisfied,
the CitY~-lil1issuea final and absolute
Certificate of Occupancy.
3. within thirty (30) days from the date of
this agreement RAMADA shall have installed
the. curb along the rear,of the parking lots
on Meadowland and the screen fence between
the northern most parking lot of Meadowland
and the adjacent fourplexes.
4. within sixty (60) days, the RAMADA shall
cause all landscaping to be installed in
compliance with the ordinance requirements.

This shall include dirt fill, ground cover
and trees of any type which are suit'ed for
survival in the geographical area and meet
the size requirements of the ordinance.
It is understood and agreed that any failure to meet the
above obligations terminates this agreement and revokes the
conditional Certificate of Occupancy issued herewith. In such
event, occupancy of the building shall thereafter be unlawful,
and in violation of City ordinances. Violations may be charged
for each' day of any such violation. RAMADA agrees tha.t upon
presentation of the affidavit of the City Manager or Assistant
City Manager to a District Court of Brazos County that anyone of
the above provisions has not been complied with, the City shall
be enti tIed toa temporary inj unction prohibiting occupation o~,
the premises except for owner s representatives' necessary for
security and maintenance. RAMADA hereby confesses judgment as to
such a temporary injunction.
Joe Ferreri represents that he is authorized to execute
this agreement on behalf of the undersigned business entities and
himself, and that he is the present owner of the Ramada Inn and
its various facilities described herein.
The attached reduced copy of the site plan for the RAMADA
is incorpprated herein for all purposes.
