was provided for Some commercial uses and not others.
It appears that under ,current case.. law Creekside Joint Venture
can put a restaurant on the, ,property at this time because it is
zoned commerci,al C1. ,It<can/get utilities, a certificate of
occupancy,etp.if theox-dinances are complied with. However,
using theprQpertyfor,pest,aurant use with the respective parking
requirement will eventuaJlyuse up allot. the available parking
leavingunocpuPiedpuilding spa.ce. As YO\) are aware, the
Planning Departmehtestimates this to be in the neighborhood of
9,574 square feet. It. the ordinances are not complied with, the
City staff will act at the direction of the Council. Any
agreement spelling this out is mex-elysuperfluous . "Any agreement
stating that the staff,ca~nactoutside of the ordinance is also
superfluous, and the City is not sllqject to estoppel under the
current law.

'The issue willultlmately have to be addressed . It appears the
alternatives available to Creekside Joint Venture are thus:
1. Securea'lariancefr-omthezoningBoardof Adjustment,
the authority responsible for grantIng them under the
ordinanceandArticlelOllg, Texas Revised Civ;il
Statutes, or
2. Secure additional parking.

IN RE: Parking encroachments of Hilton Hotel on reekside
Dear Mrs. Locke:
This letter is to acknowledge to you and the City of College Station that we
recognize certain encroachments of parking areas of the 'Hilton Hotel located on
UIliversity Drive over the boundary lines of our property" which are those areas
shaded in red on the> plat attached hereto and made apart hereof. Although ,we do
not by this letterrelinQllishany of our title and interest in and to said properties,
we do not have any objections to your issuing a building permit to the Hilton and
allowing them to const;ruclsuchparking spaces thereon. We further agree that we
will not have motor vehiclesowlled or 'possessed by customers of the Hilton removed
and/or towed away from. those ~ncroachmentareas shown on Exhibit "A"because of
the fact that such parking areas ,are encroachments on the property of the Creekside
Retail Plaza owned by Creekside Venture.

channel s before he can consider-a s.i,te plan for thi s p roj ect. Af ter Counc i 1
rules, the City Engineer wl1lhave toconfer"with-the project drainage
engineer concerning tftis project.
Show the location of utility easements, and lines, sizes, etc. of utilities
in these easements. I nfo'rmat ion wi 11 be furnished by the City upon request
from the developer.
Furnlshsetbackmeasurements-towoodendecks. Owner must be aware of the fact
that if the Ci ty needs to get to therearofthi 5 prope'rty and the deck is '~n/~'
the setback, the deck may have to be removed.
Decks which encroach setbacks shall not be covered.
Show all setbacks, including 'that lnfrontof project.
Lengthandwldthofislands must be shown. If allisJands are standard, a
general note will suffice; any odd shapedi~slands are tobetr~ated indivi-
dual'ly.
Creation ofa drive-through in front of Building B by relocation of islands
has been suggested.
Also suggested is the creation of a4 ft. island to separ'atehead-in parking
spaces rather than using wheel stops~
Show an alternate design of the area of the'northern most driveway.
All curbed areas to be marked as Fire Lanes on the revised plans.
Any restaurant over 5000 sq. ft. must besprinklered; any other building
15,000 sq. ft. or over must besprinklered.
Show adjacent lots in the areas where the driveways connect.
