AN ORDINANCE REZONING TWO TRACTS OF LAND LYING AND BEING SITUATED IN THE CRAWFORD BURNETT LEAGUE, IN BRAZOS COUNTY, TEXAS, AND BEING A PART OF THAT 47.27 ACRE TRACT OF LAND CON- VEYED TO MOHAWK, LTD. BY MARION C. PUGH BY DEED RECORDED IN VOLUME 326, PAGE 869 OF THE DEED RECORDS OF BRAZOS COUNTY, TEXAS AND BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS IN THE BODY OF THIS ORDINANCE FROM SINGLE FAMILY DISTRICT R-1A, DUPLEX DISTRICT R-2, TOWNHOUSE-ROWHOUSE DISTRICT R-3 AND APARTMENTS LOW DENSITY DISTRICT R-4 TO SINGLE FAMILY DISTRICT R-1A AND APARTMENTS LOW DENSITY DISTRICT R-4. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: WHEREAS, the City Council held a public hearing in the City Hall at 7:00 P.M. on Thursday, November , 1982, on the question of rezoning certain areas within the city limits; AND, WHEREAS, the City Council has determined the following: To rezone or change the classification of the following two (2) tracts of land all lying and being situated in the Crawford Burnett League, in Brazos County, Texas, and being more fully described by metes and bounds as follows: TRACT NO. 1 Being all that certain tract or parcel of land, lying and being situated in the CRAWFORD BURNETT LEAGUE, in Brazos County, Texas and being a part of that 47.27 acre tract of land conveyed to Mohawk, Ltd. by Marion C. Pugh by deed recorded in Volume 326, Page 869 of the Deed Records of Brazos County, Texas and being more particularly des- cribed as follows: . COMMENCING: at an iron rod marking the intersection of the southwesterly right-of- way 1 ine of the abandoned I. & G.N. railroad right-of-way and the southeasterly right- of-way line of the county road known as Luther Street, said rod also being the most northerly corner of the aforementioned 47.27 acre tract of land; THENCE: S 190 39' 00" E for a distance of 219.71 feet for the POINT OF BEGINNING, said point being the most northerly corner of this tract, said point also being in the southwesterly right-of-way line of the abandoned 1.& G.N. railroad right-of-way, said point also being in the northeasterly 1 ine of the aforementioned 47.27 acre tract of 1 and; THENCE: S 19039100"E for a distance of 1105.51 feet for corner, said point also being in the southwesterly right-of-way line of the abandoned 1.& G.N. railroad right-of- way, said point also being in the northeasterly 1 ine of the aforementioned 47.27 acre tract of land; THENCE: S 440 40 I 0011 W for a distance of 807.93 feet for corner; THENCE: N 450 33' 20" W for a distance of 169.34 feet for a corner; .. THENCE: N 430 511 or W for a distance of 283.88 feet for a N 430 01' 46" W for a distance of 724.52 feet for a N 630 531 49" E for a distance of 127.67 feet for corner; THENCE: corner; THENCE: corner; . THENCE: N 730 56' 00" E for a distance of 115.64 feet for corner; said point also being the beginning of a curve to the left; THENCE: along the aforementioned curve for a distance of 209.44 feet for a corner, said curve having a radius of 400.00 feet, delta of 300 00' 00", a tangent of 107.18 feet, r ~ . . . ~ Page 2 and a chord bearing N 580 561 00" E for a distance of 207.06 feet; THENCE: N 430 56' 0011 E for a distance of 650.73 feet for a corner, said point also being the beginning of a curve to the right; THENCE: along the aforementioned curve for a distance of 184.42 feet to the POINT OF BEGINNING, said curve having a radius of 400.00 feet, delta of 260 251 001', a tangent of 93.88 feet, and a chord bearing N 570 081 30" E for a distance of 182.79 feet, said tract of land containing 25.289 acres of land more or less, from Duplex District R-2, Townhouse-Rowhouse District R-3 and Apartments Low Density District R-4 to Apartments Low Density District R-4. TRACT NO. 2 Being all that certain tract or parcel of land, lying and being situated in the CRAWFORD BURNETT LEAGUE, in Brazos County, Texas, and being a part of that 47.27 acre tract of land conveyed to Mohawk, Ltd. by Marion C. Pugh by deed recorded in Volume 326, Page 869 of the Deed Records of Brazos County, Texas and being more particularly described by metes and bounds as follows: BEGINNING: at an iron rod marking the intersection of the west or southwesterly right-of-way line of the Missouri Pacific (I & G.N.) Railroad right-of-way and the southeasterly right-of-way of a County Road known as Luther Street, said iron rod being located S 190 391 E a distance of 44.6 feet from the east corner of the A&M Cemetery, said east corner being the intersection of the common 1 ine between the CRAWFORD BURNETT and the J.E. SCOTT LEAGUES and the beforementioned west or south- westerly right-of-way 1 ine of the Missouri Pacific (I & G.N.) Railroad; THENCE: S 190 391 00" E for a distance of 219.71 feet for a corner, said point also being in the westerly right-of-way line of the abandoned I & G.N. Railroad right- of-way, said point also being the beginning of a curve to the left; THENCE: along the aforementioned curve for a distance of 184.42 feet for a corner, said curve having a radius of 400.00 feet, delta of 260 25' 00'1, tangent of 93.88 feet, and a chord bearing S 570 08' 30" W for a distance of 182.79 feet; THENCE: S 430 56' 00" W for a distance of 650.73 feet for a corner, said point also being the beginning of a curve to the right; THENCE: along the aforementioned curve for a distance of 209.44 feet for a corner, said curve having a radius of 400.00 feet, delta of 300 00' 00", tangent of 107.18 feet, and a chord bearing S 580 561 00'1 W for a distance of 207.06 feet; THENCE: S 730 561 0011 W for a distance of 115.64 feet for a corner; THENCE: S 630 531 49" W for a distance of 127.67 feet to an iron rod for a corner, said iron rod also being in the southeast right-of-way line of the aforesaid county road known as Luther Street; .. THENCE: N 430 561 00" E for a distance of 1346.58 feet along the southeast right-of-way line of the aforementioned county road known as Luther Street right-of-way to the POINT OF BEGINNING and containing 4.084 acres of land, more or less, from Town- house District R-3 and Apartments Low Density District R-4 to Single Family District R-1A. ,. . . .
