HomeMy WebLinkAboutMinutes MINUlc~ Planning and Zoning Commission July 3, 1980 7:00 P.M. ~ Mr. Mayo explained that the proposed rezoning involeved a lot which was nearly surrounded by existing single family homes. He added that the tract was located in a Community Development Neighborhood in vlhich the City had spent over $80,000 in federal funds making improvements which would maintain the single family character of the area. He advised that the construction of an office building on this site would deter from this neighborhood character. The public hearing was opened. Mr. Curly Green, 105 Sterling, spoke in opposition to the rezoning. He stated that he represented the area residents and that they would be opposed to any development on the lot in question other than residential. Mr. Sam Ford spoke in opposition to the requested rezoning. The public hearing was closed. Commissioner Gardner stated that the tract was in a small, localized area which needed the protection that zoning could provide. Commissioner Gardner moved that the Commission recommend denial of the rezoning. The motion was seconded by Commissioner Bailey and approved with Commissioner Hazen absent. AGENDA ITEM NO.5 -- A public hearing on the question of rezoning a 0.25 acre tract generally located 350 feet east of Texas Avenue and 400 feet north of Brentwood Drive from Apartment Building District R-4 to General Commercial District C-1. The application is in the name of Mr. L.J. Kirkpatrick, Sr. Mr. Mayo explained that this was a small tract which had been left out of pre- vious rezoning. He pointed out that the tract was far too small for apartment development, and that the C-1 rezoning would be logical. The public hearing was opened. Mr. Gerald Farrar stated that he was representing Mr. Kirkpatrick and explained why the small tract had remained zoned R-4. He said that he was trying to put five tracts of land together for development by a large variety type store. The public hearing was closed. Commissioner Watson moved that the Commission recommend approval of the rezoning. The motion was seconded by Commissioner Sears and approved with Commissioner Hazen absent. AGENDA ITEM NO.6 -- A public hearing on the question of rezoning a 1.64 acre tract generally located 900 feet east of Texas Avenue and 400 feet north of Brentwood Drive from Apartment Building District R-4 to General Commercial District C-1. The application is in the name of Gerald W. Farrar. Mr. Mayo showed the location and surrounding land uses. He said that this tract was another part of the property which Mr. Farrar was trying to put together. ~ ~ . . Mr. Fitch replied that the lots will not consist of multi-story buildings and explained the location of the duplexes and fourplexes. Mayor Halter closed the public hearing. Agenda Item No. 4 - Consideration of an ordinance rezoning the above tract. Councilman Runnels asked questions regarding the widths of the Rock prairie Road extension. City Planner Mayo stated that it would consist of 4 lanes similar to the way Southwest Parkway is built. Mr. Fitch stated that he would be willing to widen the right-of-way. Councilman Runnels suggested reviewing the proposed plans for Rock prairie Road and widening the streets to at least 5 lanes. After further discussion, Councilman Runnels moved to approve Ordinance No. 1377. . Councilman Boughton seconded the motion which passed unanimously. · Agenda Item No. 5 - Public hearing on the question of rezoning Lot 28 of the Richards Subdivision from Single Family Residential District R-l to . Administrative-Professional District A-P. Application is in the name of Kevin G. Schachterie. [82-l27J City Planner Mayo presented the item. He stated that the lot is located at the southeast corner of the intersection of Richards Street and Texas Avenue. Surrounding lots are zoned R-l Single Family Residential. The staff recommends denial of the request for A-P because of the following reasons: 1. The neighborhood has been identified as a Target Area for revitalization through the City's Community Development Program. The City has spent over $80,000 in an effort to revitalize the area. 2. The neighborhood is currently bordered by Commercial development at this time and rezoning would unnecessarily increase Commercial-Residential conflict. He included that the residents of that area were opposed to the rezoning. Mayor Halter opened the public hearing. . They felt an A-O zoning would be beneficial to the area. Mayor Halter closed the public hearing. Agenda Item No. 6 - Consideration of an ordinance rezoning the above lot. Councilman Ringer moved to deny the request per staff and Planning and Zoning recommendations. Councilman Boughton seconded the motion which passed as follows: FOR: Councilmen Ringer, Boughton, Nemec, Prause, Runnels AGAINST: Mayor Halter Agenda BIDS: Item No. 7 - CONSENT AGENDA: Anderson Park Development 2 One-half ton compact pickup for Building Dept. and Parks Dept. lOne-half ton long wheel base pickup for Electrical Dept. PLATS: Final plat - Southwood Valley Section l4D and Section 14 E. . Councilman Prause asked that both vehicles be removed from the consent agenda. All other bids and plats were approved by common consent. Councilman Prause asked why the staff is recommending a higher bid. Purchasing Agent Weddle stated that the staff is recommending a higher bid because of the delivery times on the needed vehicles. Also, he asked the council to accept the next to the lowest bid for the Building Division Pickup rather than the lowest bid, due to the delivery time. Councilman Ringer moved to accept the recommendations of the staff, including the change in recommendation for the truck in Building Division to the next to lowest bid due to delivery time. Councilman Boughton seconded the motion which passed unanimously. Agenda Item No. 8 - Request for appropriation increases in the General and Sanitation Funds. Asst. City Manager/Finance Director VanDever presented the item. He stated that an increase of $150,000.00 is needed in the General Fund Contingency to pay for additional personnel in the police department and for oversize street participation. Also, $139,345.00 is needed in the Sanitation . General Fund for the purchase of an Excavator. This would allow the city 03579 ~ ~ p&Z - July l, 1982 page 5 ~ Mr. Kelly asked for votes. Motion to table request carried, with 2 negative votes. (Hill & Fleming) Mr. Hall asked to make a motion at this time that Staff look into the possibil ity of adding nursery/greenhouse use to the 1 ist of Conditional Uses. AGENDA ITEM NO.6: 82-127: A ubI ic hearin on the uestion of Lot 28 of the Richards Subdivision SE corner of Texas Avenue & Richards St. from Single Family Residential District R-l to Administrative-Professional District A-P. Appl i- cation is in the name of Kevin G. Schachterle, D.C. Mr. Mayo explained the request and located it on a map. He pointed out that this lot is presently zoned R-l and that in the past, requests for rezoning this same lot to General Commercial and also A-P had been denied, and that nothing in the area has changed, therefore staff could not support this request. The publ ic hearing was opened. Kevin Schachterle identified himself as the appl icant and informed the Commission that he was proposing a health care center and law offices on the site. He further indicated that there had been changes in the neighborhood (a shopping center closeby) and that he doubted if a home would ever be built there. He further stated that he bel ieved that A-P would be a good buffer between Texas Ave- nue and the residential area on Richards St. Jack DeMuynck identified himself as a property owner in College Station, and a repre- sentative of the owner of the property in question. He says the owner is in favor of this project, and that there has been no evidence of residential development on Texas Avenue in 20 years. He said the City could collect more in tax money and the A-P would be a good buffer between busy Texas Avenue and the residences. He felt that the land should be put to the highest and best use possible. ) Tim Kneipp spoke and identified himself as the architect who had designed the proposed project, and repeated that he bel ieved that A-P would be a good buffer and indicated that this statement had also been made concerning other items on the previously dis- cussed agenda items. He made certain comments about Mr. Mayo to which Mr. Bailey and Mr. Kelly immediately took exception, and for which Mr. Kneipp offered an apology, saying that he did not mean his statement in any way to be derogatory. Opponents to the request were invited to speak, and Mr. Curly Green came forward and identified himself as a resident on Richards Street, and stated that he and all the neighborhood residents were opposed to this rezoning request, as they had been all past requests, and hoped that the Commission would again rule against recommending rezoning of the land in question. He said that the lot was not big enough to handle anything other than a residence. Sam Ford of 112 Richard then spoke, and indicated there were 9 residents in the audience, all of whom were against the rezoning request, and for whom he and Mr. Green were spokes- men. No one else spoke. Publ ic hearing was closed. ,) Mr. Bailey pointed out that this area is currently a target for Community Development funds, and that it is now a unique area which has been residential for 30+ years. He reminded the Commission that in the past the position had been that we did not wish to change the character of the neighborhood and rezoning requests had been denied. Mr. Bailey made a motion to recommend denial of this rezoning request. Mr. Hall se- conded the motion. Motion carried unanimously.
