AN ORDINANCE REZONING TWO TRACTS OF LAND LYING AND BEING SITUATED IN THE MORGAN RECTOR LEAGUE, ABSTRACT 46, IN COLLEGE STATION, BRAZOS COUNTY, TEXAS, AND BEING MORE FULLY DESCRIBED BY METES AND BOUNDS IN THE BODY OF THIS ORDINANCE FROM DISTRICT R-l SINGLE FAMILY RESIDENTIAL TO DISTRICT R-3 TOWNHOUSE/ROWHOUSE AND DISTRICT R-5 APARTMENTS MEDIUM DENSITY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: WHEREAS, the City Council held a publ ic hearing in the City Hall at 7:00 P.M. on Thursday, June 10, 1982 on the question of rezoning certain areas within the city limits; AND, WHEREAS, the City Council has determined the following: To rezone or change the classification of the following two (2) tracts of land all lying and being situated in the Morgan Rector League in College Station, Brazos County, Texas and being more fully described by metes and bounds as follows: TRACT NO. Being a 2.583 acre tract or parcel of land, lying and being situated in the Morgan Rector League, Abstract No. 46, College Station, Brazos County, Texas, and being a portion of a called 16.2 acre tract described in deed from Harold L. Miller, et ux, to F. N. Smith, et ux, recorded in Volume 157, Page 414, of the Deed Records of Brazos County, Texas (see Volume 447, Page 435, of the Deed Records of Brazos County, Texas, for further description), and being more particularly described as follows: COMMENCING AT THE south corner of the beforementioned 16.2 acre tract, same being the west corner of a 50.3 acre tract described in deed from Harold L. Miller, et ux, to W. M. Dowell, et ux, recorded in Volumn 154, Page 382, of the Deed Records of Brazos County, Texas; THENCE N 460 401 06" E along the common 1 ine of the beforementioned 16.2 acre tract and the beforementioned 50.3 acre tract for a distance of 682.00 feet to the PLACE OF BEGINNING of tHis tract, same being in the centerline of the proposed 801 wide Dartmouth Street; THENCE N 430 19' 54" W along the centerl ine of the beforementioned proposed 80' wide Dartmouth Street for a distance of 407.00 feet and corner at the center- 1 ine intersection of a proposed 60' wide street; THENCE N 460 40' 06" E along the centerline of the beforementioned proposed 60' wide street for a distance of 65.00 feet and corner at the beginning of a centerline curve concave to the southeast, having a radius of 205.51 feet; THENCE in a northerly and easterly direction along said curve for an arc length of 245.80 feet and corner at the end of this curve, the chord bears N 800 55' 551' E 231.41 feet; THENCE S 640 481 17'1 E, continuing along the centerl ine of the beforementioned proposed 601 wide street, at a distance of 177.36 feet, pass the end of the said proposed 60' wide street, continue on for a total distance of 297.36 feet and corner in the southeast line of the beforementioned 16.2 acre tract; THENCE S 460 40' 06" W along the southeast 1 ine of the beforementioned 16.2 acre tract for a distance of 365.10 feet to the PLACE OF BEGINNING, containing ORD I NANCE NO. page 2 2.583 acres of land, more or less, from District R-l Single Family Residential to District R-5 Apartments Medium Density. TRACT NO. 2 Being a 7.426 acre tract or parcel of land, lying and being situated in the Morgan Rector League, Abstract No. 46, College Station, Brazos County, Texas, and being part of a called 16.2 acre tract described in deed from Harold L. Miller, et ux, to F. N. Smith, et ux, recorded in Volume 157, Page 414, of the Deed Records of Brazos County, Texas (see Volume 447, Page 435, of the Deed Records of Brazos County, Texas, for further description), and being more particularly described as follows: COMMENCING at the south corner of the beforementioned 16.2 acre tract, same being the west corner of a 50.3 acre tract described in deed from Harold L. Miller, et ux, to W. M. Dowell, et ux, recorded in Volume 154, Page 382, of the Deed Records of Brazos County, Texas; o THENCE N 45 001 00" W along the southwest 1 ine of the beforementioned 16.2 acre tract for a distance of 385.16 feet to the PLACE OF BEGINNING of this tract; THENCE N 460 40' 06" E for a distance of 693.21 feet and corner in the center- 1 ine of the proposed 801 wide Dartmouth Street; THENCE N 430 19' 54" W along the center 1 ine of the beforementioned proposed 80' wide Dartmouth Street for a distance of 22.00 feet and corner at the centerline intersection of the said proposed 80' wide Dartmouth Street and a proposed 60' wide street; THENCE N 460 401 06" E along the centerline of the beforementioned proposed 60' wide street for a distance of 65.00 feet and corner at the beginning of a center- line curve concave to the southeast, having a radius of 205.51 feet; THENCE in a northerly and easterly direction along said curve for an arc length of 245.80 feet and corner at the end of th i s cu rve, the chord bea rs N 800 55' 55" E 231.41 feet; THENCE S 640 481 17" E, continuing along the centerl ine of the beforementioned proposed 601 wide street, at a distance of 177.36 feet, pass the end of the said proposed 601 wide street, continue on for a total distance of 297.36 feet and corner in the southeast line of the beforementioned 16.2 acre tract; THENCE N 460 40' 06" E along the southeast line of the beforementioned 16.2 acre tract for a distance of 43.00 feet and corner at the east corner of the said 16.2 acre tract; THENCE N 330 381 56" W along the northeast line of the said 16.2 acre tract for a distance of 434.80 feet and corner at the north corner of the said 16.2 acre tract, same being in the southeast line of a 301 wide roadway; THENCE S 630 48' 47" W along the northwest 1 ine of the beforementioned 16.2 acre tract for a distance of 1241.55 feet and corner, said corner lying on the southwest 1 ine of the said 16.2 acre tract; ORDINANCE NO. page 3 THENCE S 450 001 00'1 E along the southwest 1 ine of the beforementioned 16.2 acre tract for a distance of 409.77 feet to the PLACE OF BEGINNING, containing 7.426 acres of land, more or less from Single Family Residential District R-l to Townhouse/Rowhouse District R-3.
