The P.R.C. met with Mr. Cain and Harry Bostic, the project
architect, on Tuesday, May 26, 1981. We recommend approval of the
plan with the following conditions:
(1) Relocate fire hydrants as recommended;
(2) Designate fire lanes;
(3) Provide 15 feet clearance between stairs of
buil di ngs ;
(4) Provide a landscaping plan to be approved later
by the staff.

SUBJECT: Parkland Dedication
Dear Mr. Woods:
An omission was made in the permitting process for the two buildings you, Mr.
McDowell, and the Marek Brothers built, in that City staff did not collect the fee
for Parkland Dedication during the process. The amount owed the City for those
two buildings, based on a base fee of $225.00 per unit, totals $2700.00. This
amount was due prior to issuance of a Building Permit, but because of the error
in collecting the fee during the entire process, it becomes necessary to inform
you that until that fee is paid, additional building permits for residential units on
Tract B & Tract C of Southwood Valley Section 30 subdivision will not be issued.
We apologize if this error of omission causes you any inconvenience. We will
be happy to apply funds toward the required Parkland Dedication immediately
upon receipt.

at your convenience.

Dear Shirley:
I am in receipt of your letter of 11/2194 regarding Parkland Dedication reimbursement. I
have previously discussed this item with Mr. Bill Fitch and it was stated that the dedication of
Georgie Fitch Park satisfied the Parkland dedication for that particular phase of Southwood
Valley. Therefore, because of the option of payment of funds or dedication of land, the
Parkland dedication has been satisfied for the lots developed and yet to be developed.
If there is a policy for double pledging of land and/or funds, please advise me.

Jane Kee has been working with the Finance staff to research' the background of parkland
dedication for this particular area of the city.
It has been the practice of the city to collect parkland dedication for multi-family dev~lopment at
the time of issuance of building permits because the number of dwelling units will be known at
that time. When single family and duplex lots are platted. ,it is the responsibility of the developer
to pay the parkland dedication requirements based on the number of lots in the subdivision.
It has been determined that Mr. Fitch did Indeed dedicate parkland for all single family and
duplex development in the Southwood Valley area. The area in Which Section 24 is located was
originally zoned for multi-family development. but was subsequently rezoned to single family
development. The excess parkland dedicated originally has been absorbed by Section 24, since
single family development was not part of the original plan. funds for parkland
dedication on your apartments already permitted on Balcones' at the rate of $225.00 per
dwelling unit now, and additional funds will be collected issuance of any additional
building permits for apartments in the future. . /

Dear Shirley:
I am in receipt of your letter of January 17, 1995 regarding explanation of the
disputed Parkland Dedication Fees for our project located on Balcones.
Our posture has not changed with receipt of this correspondence. In researching
the plat dates for Southwood Valley Section 24D,E,C, and A, the earliest plat date for
any of these sections is April 1985. Southwood Section 30 was originally platted in
February 1981. The discrepancy in dates does not lead me to believe that Mr. Fitch
platted Section 30 with the intention of using a portion of the parkland dedication to
service future sections within Southwood Valley.
In referring to "College Station Development Services Subdivision Regulations"
Revised 1/92, page 9-30, Section 10: Requirements For Park Land Dedication, I find
that it is the responsibility of the developer, at the filing of the "Final Plat" that "such
plat shall contain a clear fee simple dedication of an area of land to the City for park
purposes, which area shall equal to one (1) acre for each one hundred thirty three
(133) proposed dwelling units." As the zoning was established at or prior to the
acceptance by the City of College Station of the "Final Plat", I can surmise that the
parkland dedication of 10 acres is more than adequate to satisfy the total number of
units that could be developed within Southwood Section 30. Further, absorption by the
First Baptist Church of College Station of land previously platted for multi-family
development removed land in this section from development into multi-family
deveiopment, thereby allowing less units to use the dedication with the same
acreage, as originally platted, per the ordinance.
We remain steadfast in our belief that Mr. Fitch dedicated 10 acres in Section 30 for
the express purpose of satisfying the Parkland Dedication requirements for that
Section. That belief is further verified by the ordinance as it relates to the dedication of
parkland. It appears from your letter that the City of College Station must also share
the same thought because you allowed the utilization of this excess dedication to be
nor does the Ordinance address this issue.

Dear Shirley:
I have read the correspondence that you have supplied with findings from
interdepartmental research.
From November of last year, the direction of the research has evolved from excess
allocation of unused portions of parkland dedication in Southwood Section 30 to other
areas of Southwood Valley, then that Mr. Fitch in a benevolent posture donates the
Georgie K. Fitch Park with no Parkland dedication to a situation now where a preset
number of units was designated with the Parkland dedication and where we now owe
Parkland dedication on 17 of the 24 units.
Quite frankly, I am disgusted with the manner in which the City of College Station
has monitored these events and the incongruity with the findings. It is clear to me that
no one really knows the answer to the question, but the developer certainly cannot
have his facts correct, therefore attach as much monetary penalty as possible to him.
There is a suspicion that the City of College Station has double dipped the
developers on Parkland. It is one that I have heard for years, but gave the City the
benefit of a doubt that with all of the structure in place that they should know the score
at any given point. I am now convinced that the suspicions have some foundation.
Under protest I am sending the amount stated in your letter to the City of College
Station. I fully intend to involve the Council as to the manner in which this matter was
handled and my findings as they contradict the position that the City has taken.
Additionally, there are two recent instances where developers of the lots were
harassed with a threat of non issuance of a building permit because of our ongoing
disagreement. In neither instance should the developers have even been alerted of a
problem let alone threatened with the potential of non issuance of the permit as the
Parkland dedication is not even established until such time as the developer applies for
the building permit and the total number of units determined. This action has tainted

unit Parkland dedication.

Dear Jeff:
Following receipt of your letter dated May 5, 1995, in which you state grave concerns and
disagreements with the manner in which City staff makes information available regarding
parkland dedication requirements, as well as the number of times parkland dedication is required
for projects, clarification of information previously offered is being presented.
The deed was located for the 11.30 acres of land which is better known as the "Georgia K. Fitch
Park". It was recorded in Volume 387 Page 848 of the Deed Records of Brazos County. Texas,
on December 28, 1977. The deed refers to a "gift to the City of College Station, Texas.,,". In an
effort to substantiate the fact that Mr. Fitch intended this to indeed be a gift, minutes and taped
recordings of City Council meetings were researched, with the result being that at the December
7, 1977 City Council meeting held at 4 p.m., Mr. Fitch spoke and did refer to the 11.3 acres as a

Regarding your concern that City staff "threatens" prospective developers regarding parkland
dedication, it has become the policy over the past year or so, for staff to discuss parkland
dedication at the time the Project Review Committee reviews a project. This is done in an effort
to help identify any costs for a project "up front", so the developer or contractor does not have
that surprise when he comes in to pull the building permit for the project.

SECTION 10: REQUIREMENTS FOR PARK LAND DEDICATION
IO-A. Purpose
IO-A.l This section is adopted to provide recreational areas in the form of neighborhood
parks as a function of subdivision development in the City of College Station. This
section is enacted in accordance with the home rule powers of the City of College
Station, granted under the Texas Constitution, and the statutes of the State of
Texas, including, but not by way of limitation, Articles 974a and 1175. It is hereby
declared by the City Council that recreational areas in the form of neiqhborhood
parks are necessary and in the public welfare, and that the only adequate proce-
dure to provide for same is by integrating such a requirement into the procedure for
planning and developing property or subdivisions in the city, whether such devel-
opment consists of new construction on vacant land or rebuilding and remodeling
of structures on existing residential property.
IO-A.2 Neighborhood parks are those parks providing for a variety of outdoor recreational
opportunities and within convenient distances from a majority of the residences to
be served thereby. The park zones established by the Parks and Recreation
Department and shown on the official Parks and Recreation map for the City of
College Station shall be prima facie proof that any park located therein is within
such a convenient distance from any residence located therein. The primary cost
of neighborhood parks should be borne by the ultimate residential property owners
who, by reason of the proximity of their property to such parks, shall be the primary
beneficiaries of such facilities. Therefore, the following requirements are adopted
to effect the purposes stated:

Duplex. and/or Apartment Residential Purposes

IO-B.l Whenever a final plat is filed of record with the County Clerk of Brazos County for
development of a residential area in accordance with the planning and zoning reg-
ulations of the City, such plat shall contain a clear fee simple dedication of an area
of land to the City for park purposes, which area shall equal to one (1) acre for
each one hundred thirty-three (133) proposed dwelling units. Any proposed plat
submitted to the City for approval shall show the area proposed to be dedicated
under this section. The required dedication of this subsection may be met by a
payment of money in lieu of land when permitted or required by the other provi-
sions of this section.
IO-B.2 The City Council declares that development of an area smaller than one (1) acre
for public parks purposes is impractical. Therefore, if fewer than one hundred
thirty-three (133) units are proposed by a plat filed for approval, the developer shall
be required to pay the applicable cash in lieu of land amount provided by 10-D.3.,
rather than to dedicate any land area. No plat showing a dedication of less than
one (1) acre shall be approved.
IO-B.3 In instances where an area of less than five (5) acres is required to be dedicated,
the City shall have the right to accept the dedication for approval on the final plat,
or to refuse same, after consideration of the recommendation of the Planning and
Zoning Commission and the Parks and Recreation Board, and to require payment of
cash in lieu of land in the amount provided by 10-D.3., if the City determines that
sufficient park area is already in the public domain in the area of the proposed
development, or if the recreation potential for that zone would be better served by
expanding or improving existing parks.
IO-B.4 The dedication required by this section shall be made by filing of the final plat or
contemporaneously by separate instrument unless additional dedication is required
subsequent to the filing of the final plat. If the actual number of completed
dwelling units exceeds the figure upon which the original dedication was based,

such additional dedication shall be required, and shall be made by payment of the
cash in lieu of land amount provided by 10-D.3., or by the conveyance of an entire
numbered lot to the City.
10-C Prior Dedication; Absence of Prior Dedication
10-C.I Credit shall be given for land and/or money dedicated pursuant to Ordinance 690
or 983.
10-C.2 If a dedication requirement arose prior to passaqe of this section, that dedication
requirement shall be controlled by the ordinance in effect at the time such obliga-
tion arose, except that additional dedication shall be required if the actual density
of structures constructed upon property is <;1Teater than the fonner assumed density.
Additional dedication shall be required only for the increase in density and shall be
based upon the ratio set forth in 10-B. of this section.
10-C.3 AJ. the discretion of the City, any fanner ~ of land to the City may be credited on a
per acre basis toward eventual land dedication requirements imposed on the donor
of such lands. The City Council shall consider the recommendation of the Planning
and Zoning Commission and the Parks and Recreation Board in exercising its
discretion under this subsection.
10-D Money in Lieu of Land
10-D.1 Subject to veto of the City Council, a land owner responsible for dedication under
this section may elect to meet the requirements of 10-B. in whole or in part by a
cash payment in lieu of land, in the amount set forth in 10-0.3. Such payment in
lieu of land shall be made at or prior to the time of final plat approval.
10-0.2 The City may from time to time decide to purchase land for parks in or near the
area of actual or potential development. If the City does purchase park land in a
park zone, subsequent park land dedications for that zone shall be in cash only,
and calculated to reimburse the City's actual cost of acquisition and development
of such land for parks. The cash amount shall be equal to the sum of the average
price per acre of such land, and the actual cost of adjacent streets and on-site utili-
ties, or an estimate of such actual cost provided by the City Engineer. Once the
City has been reimbursed entirely for all such park land within a park zone, this
subsection shall cease to apply, and the other subsections of this section shall
again be applicable.
10-D.3 To the extent that 10-0.2. is not applicable, the dedication requirement shall be met
by a payment in lieu of land at a per-acre price set from time to time by resolution
by the City Council, sufficient to acquire land and provide for adjacent streets and
utilities for a neiQ'hborhood park to serve the park zone in which such development
is located. Unless chanqed by the City Council, such per-acre price shall be com-
puted on the basis of Two Hundred Twenty-five Dollars ($225.00) per dwelling unit.
Cash payments may be used only for acquisition or improvement of a neiqhborhood
park located within the same zone as the development.
1 Q-E Comprehensive Plan Considerations
Land shown on a comprehensive plan as beinq suitable for development of the City for a
major recreational center, school site, park, or other public use, shall be reserved for a
period of one (1) year after the preliminary plat is approved by the City if within two (2)
months after such approval the City Council advises the subdivider of its desire to acquire
the land or of the interest of another qovemment unit to acquire the land, for purchase by
the interested qovemmental authority at land appraisal value at the time of purchase. A
failure by the City Council to so notify the subdivider shall constitute a waiver of the right to
reserve the land. Any waiver of the right to reserve the land shall no longer be effective if
the preliminary plat shall expire without adoption of a final plat.
