Explain or give evidence of the fbllowing:
(1). The changed or changing conditions in the area or in the City
making this zone change necessary:
The use since the present lumber yard and hardware store structure
was built in 1974 has been consistant with permitted M-2 Heavy
Industrial use. part of this tract is presently zoned M-2 and
part is zoned R-6. The buildings. used consistant withM-2 use
straddle the Zone change. See attached survey.
(2). The zone change is in accordance with the Comprehensive, Plan; or if
it ;s not, then why is the Plan incorrect?
The plan is for industrial use, the preHent u~e, Rnd iH con~i~rRnt
with industrial use. Therefore it is believed that changing the
R-6 portion of the tract to M-2 1.) will be in accordance with
the plan 2.) and avoid what appears to be spot zoning with the
current zoning.

1. The continued use since a building permit was issued for a
commercial building which was erected and has been continuously

Being a 1.754 acre tract or parcel of land lying and being situated
in the J. E. Scott League, College Station, Brazos County, Texas, and
being the 1.15 acre tract of land conveyed to Marion Pugh by the deed
recorded in Volume 240, Page 237, of the Deed Records of Brazos
County, Texas, and the abandoned I. & G. N. Railroad property adja-
cent to the said 1.15 acre tract, said 1.754 acre tract being more
particularly described as follows:
BEGINNING at an iron rod for corner, said iron rod being located at
the point intersection of the west right-of-way line of the H. & T.
C. Railroad with the southeast right-of-way line of Farm to Market
Road No. 2347;
THENCE S 480 07' W along the above mentioned southwest right-of-way
line Farm to Market Road No. 2347 for a distance of 222.01 feet to an
iron rod for corner, said iron rod being located in the centerline of
the abandoned I. & G. N. Railroad right-of- way;
THENCE S 190 19' E along the above mentioned centerline for a dis-
tance of 283.83 feet to an iron rod for corner;
THENCE N 710 28' E at a distance of 50.0 feet pass an iron rod
located at the point of intersection of the east right-of-way line of
Carroll Street, continue along the said northwest right- of-way line
of Carroll Street, for a distance of 254.73 feet to an iron rod for
corner, said iron rod being located at the point of intersection of
the said north right-of-way line of the H. & T. C. Railroad; executed
the same for the purposes;
THENCE N 260 55' W along the above mentioned west right-af-way line
of the H. & T. C. Railroad for a distance of 375.8 feet to the PLACE
OF BEGINNING, containing 1.754 acres of land, more or less.
