Agenda Item No. 4 ~-Apublic hearing on, the question,of granting a conditional use permit'forthe operation of a fraternity house located at 418 College Main. The application is in the name of 'Alpha Gamma Rho Fraternity. The public hearing was.opened. Mr. Mayo noted that 'the fraternity was in the process of purc.hasing an adjacent vaca-nt lot for use as a parking lot. Mr. RaymondSis stated that the fraternity had an earnest money contract to purchase the vacant lot and that. this lot would provide them with.ample par;king space. Commissioner White asked what provisions had been made for expansion of the fr'aternity membership. Mr. Sis.advised that they also had an earnest money contract on a hous~located on an adjacent lot, and that if the membership increased~ they would also buy this house. The..public hearing was closed. Connnissioner Mathewson suggested that issuance of an occupancy permit require purchase of Lot 3 for use as a parking area._ suggested t11at this be made part of the motion. Commissioner Burke asked.what the proposed membership would be. Mr. Sis replied that the maXimtlm membership would be 24, but that for the next year it would be only 12 . He advised the Commission that. if the membership increased to more than 12, they would purchase the adjacent house for use by their members. Chairman Stover asked wl:1at the fraternity planned to, use as a surface..for the parking, area. Mr. Sis stated that they intended to use gravel. Commissioner Mathewson moved that the use permit be granted on the cond.ition that Lot 3 be purchased as a parking area and that the parking area be surfaced so as to meet the.approva1 of the City Engineer. The '. motion was seconded by Commissioner ,Burke. Connnissioner Sweeney asked if any provision had been made for sidewalks. The Commissi.on asked if a ,site. plan 'ahdbe.enprovided. Connnissioner Mathewson moved that the request be tabled so that a site plan including property line, existing structures, proposed parking area,~garbage facilities, landscaping, sidewalks, etc. could be prepared. The nlotionwas seconded by Commissioner Burke and unanimously approved. It "tvastheconsensus'of the Commission that they were in favor of the fraternity use permit, and that the action to table was taken so that the details discussed cQ'uld be shown on a site plan alldkept for record · Agenda Item No.. 5 -- Reconsideration of the rezoning of several' tracts of land bounded by or adjacent to Southwest Parkway, Welsh Avenue, F.M. 2~18 and F.M.2154 asrecormnended by.the.Planning and Zoning Connnission. ... 1. The owners of Tract 112 had asked for time to prepare a .presentation. ' 2. Th,epetitioners felt that the Commission had not looked at the area as a whole. Mr. M,ayo pointed out that this situation had been under study for five months and suggested that this had been ample. time f.or a presentation to have been prepared by any of the property owners. He also noted that the rezoning had bee:n studied at length by both the entire Commission and a subcommittee. Restated that the entire area had, indeed, been studied and that dividing the area into tracts had been done to help meet the legal requirements of any re~3ul ting rezoning ordirtance. Commissioner Bailey pointed out that the Commission had also spent over a year revising the Comprellensive Plan which included the area in question. Chairman Stover stated that one of the main points of disagreement would be Tract 163 which had been left zonedR-6. Connnissioner Mathewson stated that he felt sure the owners had understood that the Commission's actions had not assured approval of any site plan of over 24 units per acre. Mr. Ken Schick, owner of Tract 163, stated that his firm had put approximat~ly 10 months of planning into their proposed project. Mr. Stover pointed out that 110 plans for the project had been presented to the Connnission and that only a site plan had been shown to the staff. Councilman Gardner stated that he was concerned about Tract 163being'left zoned R-6, and that the large areas zoned A-O left them in doubt. Mr.Gardn~rsuggested that a committee of the various grdupsinvolved be established. Commissioner Mathewson pointed out ,that the Connnissiont.s recommendations were in accordance with the Comprehensive' Plan. Restated that ,. the proposed zoning :represen.ted ianH.even.. Commissioner Bailey moved that the permit not be granted due to the pote:ntial traffic congestion and hazards created by the facility. The motionwas'secondedbyCommissioner Burke. Commissioner Sweeney stated that he felt a facility of this' type was ne:eded ~ but not in th~s location. The motion was unanimously approved. Residential District R-l to Duplex Residential DistrictR-2. The 'application is in the name of Ms. Lorelei B. Brown. The public hearing was opened.' Mr. Mayoexplained_.,the request and showed the surrounding zoning and land use. Mrs. Charles Ric.hardson, I013 Foster, spoke in opposition to the request. She stated that granting this request would be contrary to the deed restrictions in College IIills. The following residents of the neighborhood spoke in opposition to the request: Mr. D . A,. Commissioner Bailey stated that the request was spot zoning and that the feelings of the surrounding residents ,vas clearly in opP,osition. Co.mmissioner Mathewson moved that, in order to bring zoning into closer compliance , with the Comprehensive Plan, the Commission consider rezoning the two R-6tracts located to the north on Foster Street to a lower density residential zone. The motion was seconded by Connnissioner, Etter and unanimously approved. Dr. Ray Sisstated that they didn't expect any large delivery trucks and ,that trash disposal would be in bags. at the curb. He also noted that the surface . of the parking area would have to be on "all, weather" surface to be approved by his office., Commissioner tfathewson moved that the use permit be granted on the following, conditions: l. The existing drive\vay.be closed. 2., The curb line as suggested by the staff be constructed. 3. The surfacing"of the parking' area comply.with City standards. The motion was seconded by Commissioner Sweeney. Dr. Sis stated that the tree shown on the site plan might not be exactly where it was shown. Cormnissioner Mathewson Stlggested that his motion be amended to read: 2. The curb line with a suitable single. entrance to the parking area be constructed. The amendment \Vas accepted by Commissioner Sweeney'! Commissioner White suggested that th-e parking area be moved away ,.from the property line of theadjaceut lot. to the east. ,Corrn:nissioner }fa. thews on amended his motion to read: 4. That the edge of the parking area be set.back 5 feet from the property line of the adjacent lot to the east. The amendment was approved by Commissioner Sweeney. The amended motion was approved with Commissioner White abstaining. Agenda ,Item No. 7--'Considerationof a final plat - Sutton Place located west of and adjacent to the East Bypass, approximately 2000 feet south of Harvey Road. Mr. Mayo noted that Mr . Ash had deter,:m.ined that the Council could grant a variance , to allow a rural type street in the City Limits. He also noted that it would not be necessary for the right-of-way of Scarlett O'Hara Drive to be on this plat. Mr. Ash pointed out that the street on the proposed plat would be built to City standards only without curb and gutter'. Commissioner Whi temoved that'. the. plat be . ap,proved.
