COLLEGE STATION, TEXAS'77840 }fay 13, 1977 Dr. Raymond Rieser Home Owner's Assoc. of Post Oak Forest #26 Forest Drive College Station, Texas 77840 Gentlemen: On January 26, 1977 Raymond Rieser, et ux, and the Home-Owner's Association of Post Oak Forest, Inc. conveyed a part of the common area of the Post Oak Forest Planned Unit Development to Sara J. Jones (Volume 368 page 284, Brazos County Deed Records). The layout of common space is an essential feature of Planned Unit Development approval, and an.UTIauthorized subdivision or sale of com..rnon property appears to .be a violation of both the subdivision regulations and the zoning ordinance of the City of College Station. This letter serves as notice under Section 9-E of the'Zoning Ordinance of the City of College Station to remedy this'violation by initiating proceedings within 30 da.ys of this date to obtain approval of. the sub- division and the new configuration of the. common areas of the Planned Unit Development by not later than 180. days from the date o:f this letter, or failing such approval, to restore title of the common property to the Home Owner's Association of Post Oak Forest, Inc. Should neither of these actions be completed, the City,will initiate . actions pursuant to Section 14 of the Zoning Ordinance. In the meantime, it will not be possible for us to authorize further construction or occupancy within the subdivision until the matter' or the common property is resolved, or to authorize the connection of any. utility to lot 29, lot 30, or any of the common property until approval of the subdivision has been obtained.
