There are some pertinent facts which I wish the Commission to consider before actil1g onttlis request. "Along wi.th others, I purchased t11is land in 19?1; a total of 13.876 acres~Prior to purchasing the tract, Mr. Ran Boswell (City Manager at. that time)assurect us that all utilities were available, with the provision that we extend a sewer line along a previously approved route to connect to the Bryan sewage treatment plant. We applied for zoning in 1973; you have a record of actiorl taken, appDoving a zoning cl, assification of C-L on the property fronting along University Dr.i ve. I do not recall the exact dista11ce frOm University Drive, but it was reasonable.. Before this re-zoning process could be completed, Fred Sandlin, (City Manager of Bryan at the,time), advised Ran Boswell, by letter, that Bryan could not treat any additional sewage. Upon learning this, the request wa~~tabled, and with no access to sewer services, we could not develop~ In 1980. tije property was served with sewer, and lam now irl a position io develop, and/or sell the property to other developers. I understand fully t.rte problem t11e City of College Station [lad in finally providing sewer~service(and I bear ill-will toward none). I have now owned the property twn years, eight of which saw me with a frozen asset. Two of the original investors were bankrupt in 1974, a third was unable to contribute additional funds to hold the property, so I am now the sole owner of 8.876 acres, and the College Heights Assembly of God Church wwns the 5 acres remaining. .' \4 I do not ask that the City make any reparations, nor do I expect the City to insure me a profitable return. I do recognize the City of College Station to be a responsible Entity, and feel that those in Authority should, in fairness, consider the circum- stances encountered (not through any fault of their own, nor on my part), and recognize that I was rendered a dis-service. I am re~pectfully requestirlg, and s'uggestirlg tIlat present f-ldm"irl- istrators can, without harm to the City, rectify the problem by restoring the 1973 zoning approval. Purely as a matter of interest, I have incurred, to dat~/some $4),200.00 in interest to ~arious banks, have paid some $5,000.00 in taxes while awaiting City services within the City limits of the City of College Station. The City of Coll~ge Station is a responsible legal Entity. and honors decisions made by former Administrations(for example ,Bond Issues)o I am confident that honorable" men, in authority will l ) ____"_act responsibly. While this land is topographically superior to adjacent properties zoned! C-l, it is ohviously of the same characte.r, orl tlle same highway; I am not in a competitive position ;13 ;1 develo- per, unless I have comparable OI)pO"rtuni ty, which means 1 i v.e Z Orl1. ne; f'orlike property.
