SUBJECT: Park Place Landscaping and Plan
I checked the site on Tuesday ,Aug.29 and found the following:
1.2 live oaks are missing on the east side near the bank facility.
2. 15 live oaks may be dead or dying.I can't say for sure now if they are dead
because a few may come back.
A few have dropped leaves and usually this is a sign of shock and the tree will releaf later.
We need to closely watch these for the next 30 days .If dead then ,they will need to
replace.
3. Many of the 15 gal.live oaks do not have a 1 1/2" trunk but the height and crown of the
trees are close or equal to a 1 1/2" tree.( Ordinance calls for a 1 1/2" trunk size)
4.There are 3 dead junipers in the island near Texas Ave. and the Kentucky Fried Chicken
restaurant.
5.The live oaks at 10-12' spacing are much too close and will present the owner the same
visibility problem in a few years,especially the businesses along SW Parkway st.
I recommend a 3 O' spacing for these or any oak .
6.It would 've been helpful to plant some taller shrubs near the dumpster at SW parkway.
( for screening)
7. One dead Indian hawthorn near the billiard hall.
8.There are 16 Bradford pears (vs 12 shown on plant list)
9. A few Crepe Myrtles have brown leaves but appear that they will survive and releaf
I'm not sure how you will handle the point situation with live oaks that look bad so I'll
leave that up to you and Joey. Thanks,Pete

TERMS AND CONDITIONS
DEFINITIONS
On this Airbill, we, our and us refer to Federal Express Corporation, its employees and agents.
You and your refer to the sender, its employees and agents
.fGREEMENT TO TERMS
By giving us your package to deliver, you agree to all the terms on this Airbill and in our current
Service Guide, which is available on request. No one is authorized to alter or modify the terms of our
Agreement.
RESPONSIBILITY FOR PACKAGING AND COMPLETING A/RB/LL
You are responsible for adequately packaging your goods and for properly filling out this Airbill.
Because the number of packages and weight per package are critical to our ability to correctly bill
you, any omission of this information from thisAirbill will result in a billing based on our best estimate
of the number of packages received from you and an estimated "defaulf' weight per package, as
determiDed and ~eriodically adjus~ by U'l:
AIR TRANSPORTATION TAX INCLUDED
Our basic rate includes a federal tax required by Internal Revenue Code Section 4271 on the air
transportation portion of this servic~.
LIMITATIONS ON OUR LIABILITY-
Our liability for loss or damage to-your package is limited to your !:!Ctual damages or $100,
whichever is less, unless you pay for and declare a higher value. We ao. not carry car>io liability
insurance, but you may pay thirty cents for each additional$ l 00 o! declared value. If you declare a
higher value and pay the additional charge, our liability will be fhe lesser of your declared value or
the actual value of your package.
Our liability for delays not caused by your negligence shall be limited to a refund of youi delivery
charges.
We won't be liable for your acts or omissions, including but not lirnited10 improper or insufficient
packing, securing, marking or addressing, or for the acts or omissions of ttie recipient or anyone
else with an interestin the package. Also, we won't be liable 1f you or the reciP-ieQt violates'any of the
terms of our agreement. _ 1
Final~. we won't be liable for loss. damage or delay caus~d by events we cannot r€asonably
foresee or control, including but not limrted to acts of God, penis of the air, weather conditions,
mechanical delays, acts of public enemies, war, strikes, civil commotions, or a6ts or OmiSsions of
public authorities (including customs and quarantine officials) with actual or €pparent authority.
WE WON'T BE LIABLE IN ANY CASE FOR l ... CIDENTAL, CONSEQUENTIAL OR
SPECIAL DAMAGES, WHETHER OR NOT WE KNEW 'THAT SUCH DAMAGES
MIGHT BE INCURRED.
DECLARED VALUE LIMITS
The highest declared value we allow is $25,000 per package unless your package contains
items of "extraordinary value," in which case the highest declared value we allow 1s $500. Items of
"extraordinary value" include artwork, jewelry, furs, money; precious metals, negotiable instru-
ments, and other rtems listed in our current SeJVice Guide.
ff you send more than one package on this Airbill, you may fill in the total declared value for all
packages, not to exceed $25,000 per package. (Example: 5 packages can have a total declared
val)Je of up to $125,000.)
However, if more than one package is shipped on this airbill, our liability for loss or damage will ~
be limited to the total declared value (not to exceed $25,000 per package), regardless of the num-
ber of packages lost or damaged. You have the responsibility of proving the actual loss or
damage. -
FILING A CLAIM
ALL CLAIMS MUST BE MADE BY YOU IN WRrTING:
• WITHIN 15 DAYS AFTER WE DELIVER YOUR PACKAGE IF YOUR CLAIM RESULTS FROM
SHORTAGE, DAMAGE OR DELAY; OR .
• WITHIN 180 DAYS AFTER WE ACCEPT YOUR PACKAGE IF YOUR CLAIM RESULTS
FROM NON-DELIVERY
'We'll consider your claim filed if you call and notify our CustDrner Service Department at 800/
238-5355 and notify us 1n writing as soon as possible.
Within 90 days after you notify us of your claim, you ml.Jst send us all relevant information about it.
We are not obligated to act on any claimmtil you have µaid all transportation charges, and you may
not deduct the amount of your claim from thQSe. charges.
ff the recipient accepts your package without noting any dam~ge on the delivery record, we will
assume that the package was delivered in good condition. In order for us to process your claim, you
must, to the extent possible, make the original sh1ppln1J cartons and packing available for irr spection. 1• ..,
Claims for overcharges and refunds must be made in writing within 12 months of the billing
date.
RIGHT TO INSPECT
We may, at.o(!r option, open and inspect your packages prior to or after you g;,ffl thern to us to deliver.

We don't provide GO.D. services. ff you send a package C.O.D. by mistake. we'll deliver the
package and bill our charges to the recipient.
RESPONSIBILITY FOR PAYMENT
Even if you give us different paym9ot in~tructiOf1S, you will always be primari~ responsible for all
delivery costs, jlS .well as any costs we 'l!i'Y incur in either returning your package to you or
warehousing' it pending disposition.
QUALIFIED ACCEPTANCE
We reserve the right to re1ect a shipment after acceptance and prior to the performance of any
portion of the transportation. services, i"/1\lll such shipment would be likely to cause pamage or
delay to other shipments, equipment or personnel, or if the transportalion of which is prohibited by
law or is in violation of any rules contained in this Alrbill or our Service Guide."
