TEXAS 77840·2499 RE: Driveway Access to University Drive at 303 W. University, Coll~ge Station Dear Mr. Marro: I have received your proposal and visited the site. I cannot grant a drive access to University Drive at that location for the following reasons: (1) The Northgate business area is a heavy foot traffic area and I cannot reasonably permit vehicle traffic crossing sidewalk areas at the volumes that will be generated by opening a drive to your parking lot. (2) Left turning movements leaving the drive will conflict with left turn traffic trying to enter the University across the street and the two west bound lanes on University. The poor site distances due to grade and direction of the east bound University traffic and east bound entering traffic on University from Wellborn Road will also create unacceptable conflicts. ADDITIONAL SITE COMMENTS: (1) The parking spaces you show, though standard 9' width, are well below our standard 20' depth (2' overhang permitted yields an 18' depth measured from curb face). I suggest you may want to shift some dimensions to make better use of what mi nimal space there is available. (2) You have completely eliminated the trash container from your site. It is currently in the south westerly corner of the parking lot. I'm sure trash removal will be as necessary from your restaurant as it is from others and I suggest you consider this part of the operation in your site design. (3) There are some items of your project which appear to be overlapping to adjacent properties or frontage, par- ticularly the fence in the northwest corner which should not be higher than 3' for the 10' next to the curb, to allow vehicles to observe one another as they use your drive and/or Patricia Street, and the curb return you proposed on the westerly side of the drive on University. Pullen: July 17, 1985 On April JO, you wrote Mr. Ray Marro , A.I.A. citing your objection to driveway access at 303 W. University . I am writing in order to propose a more effective drive-up facility and corresponding curb-cut that will accommodate the safety of pedestrians and allow a controlled blending into traffic westbound on University Avenue. In our last telephone conversation on June 12th you stated your willingness to keep an "open mind" in regard to an improved presentation. I appreciate your willingness to take the time to consider this proposal. Please review these changes on enclosed site plan: I. Note illuminated sign: "No thru traffic--drive-up window only." This will remind drivers that it will be impossible (see item 3) to exit as through traffic. Additional optional identical sign could be mounted on post 20' east of proposed sign. 2. Note four speed bumps in drive-thru: the two northern speed bumps will prevent any driver from building up any speed before approaching drive-up window and steel barrier gate (Item 3). The two southern speed bumps, more closely spaced, shall prevent all vehicles from crossing sidewalk or entering westbound only University Avenue (see item 5) at a speed none other than a crawl. Please recognize that both southern speed-bumps must be approached from a dead-stop position at drive-up window location after gate (Item 3) has been opened. 3. Note 10' x 3' horizontal steel gate with access controlled inside drive-up window. Flying Tomato, Inc. P.O. (see example in polaroid photo "A" and "B") The 3 '~layers" of steel gate 3'4" high offer reasonably impenetrable barrier for vehicles inhibited from speed build up by the 2 northern speed bumps . The gate integrity is enhanced by its being anchored by rollers in a steel channel jamb to receive ends of gate . (similar to jamb detail in Polaroid photo"C") CONTROL BOX: (see enclosed spec sheet) STANLEY Model #ASJCB. Slide gate was selected over swing-arm barrier gate because of increased potential for gate because of increased potential for gate strength versus minimal gate movement. CONTROLLED ACCESS: Driver can request (or deserve) gate ope~ing only after coming to complete stop at drive-up window and summoning employee. For customers stopping and using facility, this is no inconvenience. For any attempt at through traffic, exit would be refused. -On back-side of gate frame, red reflectors will be mounted to indicate barrier at night. -On back-side of gate "watch for pedestrians" sign can be mounted. 4. Note: illuminated sign: "Right Turn Only" ("STOP" sign can also be added.) Turn restriction will allow entrance onto University Avenue westbound only eliminating majority of previous stated conflicts. Closely spaced speed-bumps inhibit rolling exit onto street. s. Note: new concrete curb cut. Curb can be "swung" as shown, to enhance right turn only tendency, and inhibit left turns. The landlord has indicated that for many decades the existing building had driveway and curb-cuts on both east and west sides exiting University Avenue. The curb-cuts weire surrendered voluntarily to the city, and no history of hazard was mentioned. -OPTIONAL: 2 yellow flashing lights for pedestrians, S'S" high could be mounted either side of driveway, adjacent to sidewalk, similar to those found in school crossing areas. Lights would flash when gate is in open position. -Note: New 90 square foot and landscaping area west of 2 southern speed bumps. Mr. Marro and I observed all the existing drive-up facilities in the City of College Station in hopes of gathering ideas for our improved facility. Although they offered no suggestions, we noted that they all exited into significant traffic traveling both directions, yet harbored no turn restrictions. They offered no speed bumps, signage, or any other traffic control equipment. Although our proposal options for the maximum safety conceivable, Ray and I had to ask whether it is excessive or out of context with every other drive-up in town? (see item "D") We feel that our proposal, if required could set a national precedent as an example of maximum drive-through window safety for pedestrians and vehicular cross traffic. It has been indicated to us by city officials that a city-sponsored study of the Northgate commercial area showed the shopper origin as 60% automobile and 40% pedestrian. This study suggests a need to accommodate access for both sources, and we belie¥e our proposal offers this access in the safest manner conceivable. Although our restaurant is providing up to 24 parking spaces (more than any other commercial entity in the immediate Northgate area) this amount of spaces is still short of that required by the new city code. Please consider that the burden put on these spaces, and the few others in the Northgate area will be lessened substantially if customers (many in the above 60%) can just drive-up to pick-up their desired product, rather than have to utilize, or search for, a rare parking space. It has been noted by traffic engineers that one of the greater sources of vehicular congestion, and hazard to pedestrians, is a vehicle constantly circling in search of a parking space. We are very :excited about our future in College Station, and very proud of the significant improvement and enhancement we are investing into this area. Flying Tomato, Inc., is a tightly run chain and in our 15 year history (of as many restaurants) this is by far our most ambitious investment to date. Although we had to add a sprinkler system to our budget, as well as many other enhancements not required by code, we were further burdened by an additional $26,000 to connect the system to adequate supply available only on Main St. The ability to maintain a drive-up window, which has been operated without incident in many of our other stores, was integral to our plan when many of the above concessions were agreed to. The inability to adequately service and accommodate customers arriving by car will put a significant burden on our ability to remain economically viable. Please consider our presentation as an acceptable solution to the need effectively integrate access by slow moving singular customer vehicles with the reasonable safety needs of pedestrian customers and other foot traffic. Ray and I welcome any further suggestions that might achieve this goal . Thank you for your consideration to this matter. City Engineer, City of College Station 1101 Texas Avenue College Station, Texas 77840 July 17, 1985 Dear Mr. Pullen: In reference to Paragraph 3 of your letter of June 12, 1985, I, too, am concerned about the disruption to traffic that will be caused by the city completing the water line to Boyett St. at a later date. We are presently completing the line from Main to our location and, as per our telephone conversation of June 12, we both recognize the minimum disruption would be to continue the line at this time. After consulting with Kelvin Mullins from Omni Construction Co., he said continuing the line would require an approximate $800 engin- eering fee which would then confirm exact specifications and corresponding fees to complete the line. Based on the low bid we have presently contracted, Kelvin approximates $8,500 for the run and 1,200 to 1,500 for a hy~rant, if required. Since Flying Tomato, Inc. is making a long term commitment to the community, we have no difficulty in accepting a purchase order payment arrangement from the city. Since the billing would be through Flying Tomato, Inc., I believe I could convince Omni Construction Co. to waive their 8% profit mark-up ($850) so the city could have the lowest price possible. As a matter of record I am ,returning to yo.u the diagram of the existing drive-thru facilities with ' comments. Also, I am sure you are aware that most of these installations do not involve pedestrian traffic at all. You seem to have addressed all of my concerns regarding ~traffic move- ments. Since large numbers of your customers will come· from campus and other areas by foot I suggest you consider m~king the "rie~ masonry wall" to the left of your vehicle gate a pedestrian gate. You may wish to install some sort of device in that area to prevent the passage of bicycles and motorcycles which might conflict with your vehicle traffic movement . From an aesthetic standpoint, considering the entire Northgate area, I am not in favor of installing this drive. However, you have addressed all the traffic problems I had previously addressed, albeit with "bells and whistles" which are of course subject to your maintenance with respect to their operational success. As a result of your efforts, I am granting you an exit drive access at 303 West University Drive with the conditions of design you have shown on your drawing submitted to me dated July 16, 1985. I am enclosing a detail of the gutter section you must install along the frontage of your drive. I recommend paving brick in your drive access in lieu of concrete. Since you are apparently intending to leave in place the existing brick sidewalk, the paving brick may be more consistent in appearance than concrete. _d),:A .~ David J~ P.E. SALE OF ALCOHOLIC BEVERAGES NEAR CHURCHES, SCHOOLS AND HOSPITALS (l) Definitions The following definitions shall apply in the interpretation and the enforcement of this section: Church: A building used principally for reliaious worship and in which persons assemble and congregate to worship at least once each week and which is owned by such congregation or persons or leased by such congregation for a period of more than one year. Public Hospital: A hospital to which the public at large is admitted for medical treatment. Public School: A school which has one or more of the grades kindergarten through twelfth grade, and which is owned and conducted by the state or a political subdi- vision or agency thereof. Sales of Alcoholic Beverages Prohibited No person shall sell or engage in the business of selling an alcoholic beverage where the place of business of such person is within three hundred (300) feet of any church, public school or public hospital, the measurements to be along the property lines of the street fronts and from front door to front door, and then direct line across street intersections where they occur. (3) Exceptions This ordinance shall not apply to a place of business which is legally authorized to sell alcoholic beverages prior to the effective date of this ordinance; however, should such a place of business discontinue the sale of alcoholic beverages, then the provisions of this ordinance shall apply thereafter. Kee, Zoning Offici~ J The Flying Tomato Restaurant As you requested the following is a chronological listing of events that have taken place concerning The Flying Tomato restaurant. 1. Jan. 17, 1984 I sent a letter to Tomato's architect, Paul Rowald, indicating that seating for their restaurant could not exceed 230 seats (based on a prior non-conforming use). 2. The site plan was approved on April 30, 1985 indicating MAXIMUN SEATING-230. 3. The building permit was issued on May 5, 1985 with an approved site plan attached. 4. An inspection by Kim Johnson on August 19, 1985 found in excess of 330 seats on the premises. The Certificate of Occupancy was held until all but 230 seats were removed. The seats were removed the next day, the C.O. was issued and the restaurant opened for business. 5. Ralph Senn, owner, filed an application before the ZBA that was two-fold. He first appealed my decision that the Zoning Ordinance regulates outdoor seating. The ZBA upheld my decision on Septmber 3, 1985. He then requested a variance to parking for the addition of 148 seats to be placed outdoors. The ZBA denied this request based on a lack of unique and special conditions and lack of undue hardship as presented by the applicant. 6. Ralph Senn filed another application before the ZBA which was again a two-fold request. He requested first a variance to 27 parking spaces to add 81 more seats to the restaurant. The ZBA denied this request on September 19, 1985 for the same reasons as before. He then requested a variance to the parking requirement that off-premise spaces be on property within 200' and under the same ownership. The ZBA tabled this request pending the location by Mr.Senn of property for off-premise parking. As a matter of record I am ,returning to you the diagram of the existing drive-thru. facilities with ' comments. Also, I am sure you are aware that most of these installations do not involve pedestrian traffic at all. You seem to have addressed al.l of my concerns regarding traffic move- ments. Since large numbers of your customers will come from campus and other areas by foot I suggest you cons i.der m·aking the "new masonry wa 11" to the left of your vehicle gate a pedestrian gate. You may wish to install some sort of device in that area to prevent the passage of bicycles and motorcycles which might conflict with your vehicle traffic movement. From an aesthetic standpoint, considering the entire Northgate area, I am not in favor of installing this drive. However, you have addressed all the traffic problems I had previously addressed, albeit with "bells and whistles" which are of course subject to your maintenance with respect to their operational success. As a result of your efforts, I am granting you an exit drive access at 303 West Universi~y Drive with the conditions of design you have shown on your drawing submitted to me dated July 16, 1985. I am enclosing a detail of the gutter section you must install along the frontage of your drive. I recommend paving brick in your drive access in lieu of concrete.
