During a recent survey of landscaping in the area of your business, it was observed that much of your landscaping is dead, missing or dying. As you may know the City has adopted Landscaping Ordinances which are a part of Zoning Ordinance No. 1638. Under this ordinance, all buildings except single family and duplex dwellings are subject to the r e quirements which run with the land. Section 11 of the Zoning Ordinance states that replacement of dead or missing landscaping must be completed within 45 days of notification by the City , and replacement material must be of similar character and the same or higher point total as the dead or missing landscaping. This is your official notification of violation of Section 11 of Ordinance No 1638. We hope that you will join us in our efforts to achieve the goals of the City through compliance with our ordinance. Please be advised that the Zoning Ordinance provides provisions for prosecution in Municipal Court if violations are not corrected. Any such ordinance is punished by fines not to exceed $2000.00. Your deadline is forty-five (45) days from the receipt of this letter. If you have any questions concerning this matter, please do hesitate to contact the Planning Office at (409) 764-3570. Due to extensive retaining walls needed for a drive at the rear of this build- ing and the resultant problems we would 1 ike to delete the drive. John Olson (at Jerry Bishop's office) has talked with Harry Davis, Fire Marshall, and found no problems from his department. We have provided a partial drive for utility service access. Another item that has been modified is the restaurant space has been reduced and made a separate building. We have the required 15 1 separation between the buildings. Also, we have reduced the square footage of the retail portion. I will call your office in a few days to check with you and any comments you may have. Please call should you have any questions. At both meetings the City expressed some concern about the actual use of the designated retail lease space of 11,685 square feet. Approximately 35 percent of the total project building area is a large restaurant. I understand this tenant proposes 178 seats . Obviously, the parking lot will not be adequate if the retail space were to be filled with such uses as restaurants, theaterS:-or nightclubs. The parking you have provided should be sufficient if the retail lease space is used primarily by retail tenants. As tenant permits are requested, we will monitor the tenant mix and the available parking normally required for those users. Should we foresee a potential problem we will, of course, contact you immediately so that you can plan accordingly. Kapchinski Subdivision -which this project site occupies, was approved by City Council 3/22/84 but my office has not filed the plat as yet. I am awaiting final sutmittal and approval of sewer relocation drawings before filing for record. (2) Develoµnent of the site will require a drainage report, a flood plain impact study complying with our Flood Hazard Protection Ordinance, and a develoµnent permit since sane of the work proposed is in the 100 year flood plain and the limits of the existing creek banks. Fireman access to tenant spaces was discussed. Fire Marshal Davis noted problems with head-in parking configurations. 3. Various schemes were discussed that involved placement of island (s) that would allow fireman access through parked cars to tenant spaces. 4. Distributing three 9' x 18' islands was presented. The 9' wide space did not completely satisfy the Fire Marshal's requirements for access. 5. The next scheme presented involved placing an 18' wide x 18' deep island in the middle of the row of parking at building. This would allow firemen to access tenant spaces from each erid of open canopy walk area and at center 18' wide island. The island may require one tree by landscape ordinance. The ground cover should be St. Augustine grass so as to not hamper fireman access. 6. Fire Marshal Davis agreed to the scheme in Note 5 with the 18' wide, centrally located island. 7.
