CONSIDERATION: Ten Dollars ($10.00) and other
good and valuable consideration.
PROPERTY:
Being Parcels A-1, A-2, A-3, A-4 and A-5 more particularly described by metes
and bounds in the attached Exhibit "A".
This conveyance shall grant the rights herein specified only as to that partion of the above-
described Property more particularly described on the attached Exhibit "A" known as the
"easement area," and any additional area outside the easement area necessary to install and attach
guy wires, and anchors necessary and incident to the uses of the Easement Area to erect,
construct, install, and thereafter use, operate, inspect, repair, maintain, reconstruct, modify and
remove the following:
Landscaping;
Electric transmission and distribution lines;
Water lines and sanitary sewer lines, connecting lines,
access facilities, and related equipment;
Stonn sewers and collection facilities;
Television, telephone, and communications lines;
Drainage ditches, drainage pipes and all other drainage
structures, surface and subsurface;
upon, over, and across the said Property as described on Exhibit "A" and any ways, streets, roads,
or alleys abutting same; and to cut, trim, and control the growth of trees and other vegetation on
and in the easement area or on adjoining property of Grantor, which might interfere with or
threaten the operation and maintenance of any public utility equipment, accessories, or
operations. It being understood and agreed that any and all equipment and facilities placed upon
said property shall remain the property of Grantee.
It is expressly'understood that the Grantor, Grantor's heirs, successors or assigns, reserves and
shall continue to enjoy the use of the surface of the Easement for any and all purposes which do
not interfere with and prevent the use by Grantee of the easement including walks, alleys or
driveways. Grantor shall give Grantee 30 days prior written notice of its intent to use the surface
of all or any part of said easement and the proposed use.
Grantor hereby reserves unto itself, its successors and assigns, all oil, gas, and other minerals,
ground water and water rights now owned by Grantor in and under or that may be produced from
the above-described property. Provided, however, Grantor expressly subordinates all rights of
surface use incident to the mineral and water estate to the above-described uses of said surface by
Grantee, and agrees to lender's subordinations on behalf of Grantee. Grantor will provide
Grantee with the names and addresses of all lenders.
RESERVATIONS FROM AND EXCEPTIONS TO
CONVEYANCE AND WARRANTIES:
All easements, rights of way, and prescriptive rights in others for any purposes whatsoever,
whether of record or not, all presently recorded restrictions, reservations, covenants, conditions,

oil and gas or water leases, oil, gas mineral, and water severances of any kind and all ri~ts
incidental thereto; rights of adjoining owners in any fences situated on a common boundary lme,
any encroachments or overlapping of improvements and any discrepancies or conflict in
boundary lines.
TO HA VE AND TO HOLD, the rights and interests herein described unto the CITY OF
COLLEGE STATION, TEXAS, and its successors and assigns, forever, and Grantor does hereby
bind itself, its successors and assigns, to warrant and forever defend, all and singular, these rights
and interests unto the CITY OF COLLEGE STATION, TEXAS, and its successors and assigns,
against every person whomsoever lawfully claiming, or to claim the same or any part thereof, by,
through and under Grantor, but not otherwise, except as to the reservations from and exceptions
to conveyance and warranty.
This easement is made as a correction .easement in substitution of the easement titled
"Landscape, Drainage and Utility Easement" ("Corrected Easement'') dated December 20, 2002,
and recorded in Volume 5051, Page 15, of the Official Records of Brazos County, Texas, to
correct the metes and bounds descriptions attached to the easement as Exhibit A. Other than the
stated correction, this easement is intended to restate in all respects the Corrected Easement and
the effective date of this correction easement relates back to the effective date of the Corrected
Easement.

Abstract No. 49, Brazos County, Texas, also being a portion of the remainder of that
certain called 192.64 acre tract of land described in a Special Warranty Deed With
Vendor's Lien to College Main Apartments, Ltd., recorded in Volume 03687, Page
00258, of the Official Records of Brazos County, Texas (0.R.B.C.), said 0.991 acre tract
of land being more particularly described by metes and bounds as follows with bearings
based on the Texas State Plane Coordinate System, Texas Central Zone -NAD83, which

Being a 1.467 acre (63,900 square feet) tract of land situated in the Richard Carter

This conveyance shall grant the rights herein specified only as to that portion of the above-
described Property more particularly described on the attached Exhibit "A" known as the
"easement area," and any additional area outside the easement area necessary to install and attach
guy wires, and anchors necessary and incident to the uses of the Easement Area to erect,
construct, install, and thereafter use, operate, inspect, repair, maintain, reconstruct, modify and
remove the following:
Electric transmission and distribution lines;
Water lines and sanitary sewer lines, connecting lines,
access facilities, and related equipment;
Storm sewers and collection facilities;
Television, telephone, and communications lines;
Drainage ditches, drainage pipes and all other drainage
structures, surface and subsurface;
upon, over, and across the said Property as described on Exhibit "A" and any ways, streets, roads,
or alleys abutting same; and to cut, trim, and control the growth of trees and other vegetation on
and in the easement area or on adjoining property of Grantor, which might interfere with or
threaten the operation and maintenance of any public utility equipment, accessories, or
operations. It being understood and agreed that any and all equipment and facilities placed upon
said property shall remain the property of Grantee. ·
The Grantor herein grants to Grantee in addition to the Easement Area, the Temporary
Construction Easement described on Exhibit "A", being an additional thirty-foot (30') wide strip
of land, being adjacent and contiguous to the twenty-foot (20') easement granted, and being for
temporary use only in constructing, installing, erecting, repairing, removing the lines, pipes, and
other facilities and placing in said twenty-foot (20') easement. Said thirty-foot (30') wide
temporary construction right-of-way shall be in force and continue only for a period of time
required for the initial construction and placing of the said electrical lines, water, sewer and
storm lines and other facilities permitted herein, at which time said easement shall be
extinguished and all right, title and interest in and to said thirty-foot (30') strip shall revert and be
that of the Grantor, Grantor's heirs and assigns herein.
lt is expressly understood that the Grantor, Grantor's heirs, successors or assigns, reserves and
shall continue to enjoy the use of the surface of the Easement for any and all purposes which do

Grantor hereby reserves unto itself, its successors and assigns, all oil, gas, and other minerals,

land described in a Special Warranty Deed With Vendor's Lien to College Main

described by metes and bounds as follows with bearings based on the Texas State Plane

Volume 1192, Page 376, O.R.B.C., and the northwesterly right-of-way (R.0.W.) line of
State Highway No. 30 -also know as Harvey Road (a 120 foot wide R.O.W. at this
location), said point being located at Texas State Plane Coordinate grid position
X=3567418.10 and Y=l0220224.80, being the most southerly comer of the herein
described tract, and from which a 1 inch iron pipe found and as called for in the deed for
said 57 .304 acre tract bears South 33 degrees 33 minutes 29 seconds East, at 400.22 feet;
TIIENCE, departing the northwesterly R.O.W. line of said State Highway No. 30, and
along the common line of the southwesterly line of said 192.64 acre tract and the

657.05 feet;
THENCE, North 48 degrees 12 minutes 41 seconds East, departing said common line, a ·
distance of 323.86 feet to a point for the most northerly corner of the herein described
tract, said poiii.t being on the proposed southwesterly R.O.W. line of Copperfield Drive (a
115 foot wide R.O.W. at this location), said point also being on a curve to the right from
which the radius point bears South 45 degrees 46 minutes 09 seconds West, a distance of
2,945.00 feet;
THENCE, in a southerly direction, along the proposed southwesterly R.O.W. line· of said
Copperfield Drive, and along said curve to the right, through a central angle of 00

TEMPORARY CONSTRUCTION EASEMENT
In addition, it is intended to create a thirty-foot (30) wide Temporary Construction
Easement adjacent and parallel to the easterly line of the above described permanent
public utility easement. This Temporary Construction Easement contains 2.167 acres
(94,406 square feet) of land.
An easement exhibit drawing of even survey date herewith accompanies this field note
description.

This conveyance shall grant the rights herein specified only as to that portion of the above-
described Property more particularly described on the attached EXIDBIT A, known as the
"Easement Area", and any additional area outside the Easement Area necessary to install and
attach equipment, suy wires, and anchors necessary and incident to the uses of the Easement
Area to erect, construct, install, and thereafter use, operate, inspect, repair, maintain, reconstruct,
modify and remove the following:
Electric transmission and distribution lines;
Water lines and sanitary sewer lines, connecting lines,
access facilities, and related equipment;
Stonn sewers and collection facilities;
Television, telephone, and communications lines;
Drainage ditches, drainage pipes and all other
drainage structures, surface and subsurface;
upon, over, and across the said Property as described and any ways, streets, roads, or alleys
abutting same; and to cut, trim, and control the growth of trees and other vegetation on and in the
Easement Area or on adjoining property of GRANTOR, which might interfere with or threaten
the operation and maintenance of any public utility equipment, accessories, or operations. It
being understood and agreed that any and all equipment and facilities placed upon said Property
shall remain the property of GRANTEE.
GRANTOR hereby expressly acknowledges that they are the owners of this Property.
GRANTOR expressly subordinates all rights of surface use, incident to the mineral estate owned
by GRANTOR, to the above-described uses of said surface by GRANTEE. GRANTOR will
provide GRANTEE wlth the names and addresses of all lenders, if any, and agrees to lender's
subordinations on behalf of GRANTEE, if any.
RESERVATIONS AND RESTRICTIONS: NONE.
TO HA VE AND TO HOLD, the rights and interests herein described unto the CITY OF

This conveyance shall grant the rights herein specified only as to that portion of the above~

as the "Easement Areas", and any additional area outside the Easement Areas necessary to install
and attach equipment, guy wires, and unchors necessary and incident to the uses of the Easement
Areas to erect, construct, install, and thereafter use, operate, inspect, repair, maintain,
reconstruct, modify and remove the following:

drainage structures, surface and subsurface;
upon, over, and across the said Property as described and any ways, streets, roads, or alleys
abutting same; and to cut, trim, and control the growth of trees and other vegetation on and in the

Easement Areas or on adjoining property of GRANTOR, which might interfere with or threaten

being understood and ngrced that any and all equipment and facilities placed upon said Property
shall remain the property of GRANTEE.
GRANTOR hereby expressly acknowledges that it is the owner of this property.
GRANTOR expressly subordinates all rights of surface use, incident to the mineral estate owned
by GRANTOR, to the above-described uses of said surface by GRANTEE. GRANTOR will
provide GRANTEE with the names and addresses of all lenders, if any, and agrees to lender's
subordinations on behalf of GRANTEE, if any.

Areas to erect, construct, install, and thereafter use, operate, inspect, repair, maintain,
reconstruct, modify and remove the following:
Electric transmission and distribution lines;
Water lines and sanitary sewer lines, connecting lines,
access facilities, and related equipment;
Storm sewers and collection facilities;
Television, telephone, and communications lines;
Drainage ditches, drainage pipes and all other
drainage structures, surface and subsurface;
upon, over, and across the said Property as described and any ways, streets, roads, or alleys
abutting same; and to cut, trim, and control the growth of trees and other vegetation on and in the
Easement Areas or on adjoining property of GRANTOR, which might interfere with or threaten
the operation and maintenance of any public utility equipment, accessories, or operations. [t
being understood and agreed that any and all equipment and facilities placed upon said Property
shall remain the property of GRANTEE.
GRANTOR hereby expressly acknowledges that it is the owner of this property.
GRANTOR expressly subordinates all rights of surface use, incident to the mineral estate owned
by GRANTOR, to the above-described uses of said surface by GRANTEE. GRANTOR will
provide GRANTEE with the names and addresses of all lenders, if any, and agrees to lender's
subordinations on behalf of GRANTEE, if any.

more particularly described by metes and bounds and shown on survey diagram
marked EXHIBIT A attached hereto and made a part hereof for all intents and
purposes.
This conveyance shall grant the rights herein specified only as to that portion of the above-
described Property more particularly described on the attached EXHIBIT A known as the
"Easement Area", and any additional area outside the Easement Area necessary to install and
attach equipment, guy wires, and anchors necessary and incident to the uses of the Easement
Area to erect, construct, install, and thereafter use, operate, inspect, repair, maintain, reconstruct,
modify and remove the following:
Electric tmnsmission and distribution lines;
Water lines and sanitary sewer lines, connecting lines,
access facilities, and related equipment;
Stonn sewers and collection facilities ;
Television, telephone, and communications lines;
Drainage ditches, drainage pipes and all other
drainage structures, surface and subsurface;
upon, over, and across the said Property as described and any ways, streets, roads , or alleys
abutting same; and to cut, trim, and control the growth of trees and other vegetation on and in the
easement area or on adjoining property of Orantor, which might interfere with or threaten the
operation and maintenance of any public utility equipment, accessories, or operations. It being
understood and agreed that any and all equipment and facilities placed upon said Property shall
remain the property of Grantee.
Gran tor hereby expressly acknowledges that it is the owner of this property.
Grantor expressly subordinates all rights of surface use, incident to the mineral estate owned by
Grantor, to the above-described uses of said surface by Grantee. Grantor will provide Grantee
with the names and addresses of all lenders, if any, and agrees to lender's subordinations on
behalf of Grantee, if any .
RESERVATIONS AND RESTRICTIONS: NONE
TO HA VE AND TO HOLD, the rights and interests herein described unto the CITY OF
COLLEGE STA TlON, TEXAS, and its successors and assigns, forever, and Grantor does hereby
bind itself, its successors and assigns to warrant and forever defond, all and singular, these rights
and interests unto the CITY OF COLLEGE STATION, TEXAS, and its successors and assigns,
against every person whomsoever lawfully claiming, or to claim same, or any part thereof.

the State of Texas and more particularly described as follows, to-wit:

RESERVATIONS FROM AND EXCEPTIONS TO CONVEYANCE WARRANTY:
All validly existing easements, rights-of-way, and prescriptive rights, whether of record or
not; all presently recorded and validly existing restrictions, reservations, covenants,
conditions, oil and gas leases,. mineral interests outstanding in persons other than Grantor,
and other instruments, other than conveyances of the surface fee estate, that affect the
Property; validly existing rights of adjoining owners in any walls and fences situated on a
common boundary; any discrepancies, conflicts, or shortages in area or bO\mdary lines;
any encroachments or overlapping of improvements; all rights, obligations, and other
matters arising from and existing by reason of the Brazos County Appraisal District, and
taxes for the current year, which Grantee assumes and agrees to pay, the payment of which
Grantee assumes.
For Grantor and Grantor's heirs, successors, and assigns forever, a reservation of all oil,
gas, and other minerals in and under and that may be produced from the Property. If the
mineral estate is subject to existing production or an existing lease, this reservation
includes the production, the lease, and all benefits from it.

1. Chapter 1, Section 29 of the Code of Ordinances, as amended, a copy of which is
maintained in the City Secretary's Office in the City of College Station, Texas, is
· hereby incorporated by reference and constitutes a part of this conveyance. ·
2. The property may be used only for burial or internment of the human body.
GRANTOR, for the consideration and subject to the reservations from, restrictions on and
exceptions to conveyance and warranty, GRANTS, SELLS, and CONVEYS to GRANTEE
the property, together· with all and singular the rights and appurtenances thereto in anywise
belonging, to have and hold it to GRANTEE, and GRANTEE's heirs, successors and
assigns. GR.ANTOR and GRANTOR's successors and assigns to warrant and forever
defend all singular the property to GRANTEE and GRANTEE's heirs, administrators,
successors, and assigns against every person whomsoever lawfully claiming or to claim the
same or any part thereof, except as to the reservations from exceptions to conveyance and
warranty, when the claim is by, through, or under GRANTOR but not otherwise.
