PROPERTY: Being Parcels A-1, A-2, A-3, A-4 and A-5 more particularly described by metes and bounds in the attached Exhibit "A". This conveyance shall grant the rights herein specified only as to that partion of the above- described Property more particularly described on the attached Exhibit "A" known as the "easement area," and any additional area outside the easement area necessary to install and attach guy wires, and anchors necessary and incident to the uses of the Easement Area to erect, construct, install, and thereafter use, operate, inspect, repair, maintain, reconstruct, modify and remove the following: Landscaping; Electric transmission and distribution lines; Water lines and sanitary sewer lines, connecting lines, access facilities, and related equipment; Stonn sewers and collection facilities; Television, telephone, and communications lines; Drainage ditches, drainage pipes and all other drainage structures, surface and subsurface; upon, over, and across the said Property as described on Exhibit "A" and any ways, streets, roads, or alleys abutting same; and to cut, trim, and control the growth of trees and other vegetation on and in the easement area or on adjoining property of Grantor, which might interfere with or threaten the operation and maintenance of any public utility equipment, accessories, or operations. It being understood and agreed that any and all equipment and facilities placed upon said property shall remain the property of Grantee. It is expressly'understood that the Grantor, Grantor's heirs, successors or assigns, reserves and shall continue to enjoy the use of the surface of the Easement for any and all purposes which do not interfere with and prevent the use by Grantee of the easement including walks, alleys or driveways. Grantor shall give Grantee 30 days prior written notice of its intent to use the surface of all or any part of said easement and the proposed use. Grantor hereby reserves unto itself, its successors and assigns, all oil, gas, and other minerals, ground water and water rights now owned by Grantor in and under or that may be produced from the above-described property. Provided, however, Grantor expressly subordinates all rights of surface use incident to the mineral and water estate to the above-described uses of said surface by Grantee, and agrees to lender's subordinations on behalf of Grantee. Grantor will provide Grantee with the names and addresses of all lenders. This easement is made as a correction .easement in substitution of the easement titled "Landscape, Drainage and Utility Easement" ("Corrected Easement'') dated December 20, 2002, and recorded in Volume 5051, Page 15, of the Official Records of Brazos County, Texas, to correct the metes and bounds descriptions attached to the easement as Exhibit A. Other than the stated correction, this easement is intended to restate in all respects the Corrected Easement and the effective date of this correction easement relates back to the effective date of the Corrected Easement.
