There are some issues regarding the ROW as found on the ground and per the Plat Record. I am not an attorney but I do understand Excess and Deficiencies in title. In this case, it appears that there is an excess in this lot, but it cannot be determined in fact unless a survey was performed on the entire Block to the south and to the north of Nunn Street.1As per land law, streets get their entire width but no more, so in this case the Plat calls for 50 - feet. I have shown the 50' ROW but I also show where the rods are found and where the ROW would be based on the rods. The landowner could have a claim to the area in between. Proration is a last resort in title issues and I would recommend the advice of an attorney if the city wants to use the additional area. It could also be solved by a Boundary Line Agreement between the landowner and the city. Let me know if you would like to meet and discuss further. Thanks, H. The ROW along Nunn is being looked at by Strong -he wasn't able to determine accurately where it is . The only plats we could find are the ones attached, one from 193 8 and a rep lat of the northeastern comer lots. The 1938 plat shows a 50' ROW which differs from the 60' ROW shown on the 30% Lincoln rehab plans from B&B. Strong is working with information we got from Henry Mayo (Lincoln surveyor) to try to determine where those property comers actually are on the ground and if there really is 60' of ROW along Nunn.
