The Burdened Tract may not be used as a hotel or motel or other lodging property. No building
on the Burdened Tract may exceed one story.
Grantor, for the consideration and subject to the reservations from and exceptions to conveyance
and warranty, grants, sells, and conveys to Grantee the Property, together with all and singular the rights
and appurtenances thereto in any wise belonging, to have and hold it to Grantee, Grantees heirs,
executors, administrators, successors, or assigns forever. Grantor binds Grantor and Grantors
executors, administrators, successors and assigns to warrant and forever defend all and singular the
Property to Grantee and Grantees heirs, executors, administrators, successors, and assigns against
every person whomsoever lawfully claiming or to claim the same or any part thereof, except as to the
reservations from and exceptions to warranty.
Grantee assumes payment of the ad valorem taxes for the calendar years 2013 and subsequent
years of ownership and subsequent assessments for prior years due to change in use or ownership.
When the context requires, singular nouns and pronouns include the plural.
Grantor, as the fee simple owner of the Burdened Tract and the Benefited Tract, establishes the
Restrictions as a covenant, condition, and restriction, whether mandatory, prohibitive, permissive, or
administrative, to regulate the height of buildings and use of the Burdened Tract for the benefit of the
Benefitted Tract. Grantor and Grantee stipulate that (1) the Restrictions touch and concern the Burdened
Tract and the Benefited Tract; (2) privity of estate exists by reason of the common ownership of the
Burdened Tract and the Benefited Tract; (3) notice is given by filing this Instrument in the Official Public
Records of Brazos County, Texas; and (4) the Restrictions are reasonable, their purpose being for the
common benefit of Grantor, Grantee, and the Affected Property Owner(s), who are affected by the
appearance and use of the Burdened Tract. The Restriction runs with the land making up the Property, is
binding on Grantee and Grantee's successors and assigns forever, and inure to the benefit of the owner
of the Benefitted Tract, and their successors and assigns forever. The Restriction benefits the owners of
the Burdened Tract who have standing to enforce the Restrictions by any action at law or In equity.
This Warranty Deed ("Deed' herein) has been executed by Grantor on the date of the taking of its
acknowledgement, but the effective date of this Deed shall be deemed to be the 28th day of August,
2013, for all purposes and it shall be effective as of that date.
