Tem, 77210-4324 713.381.6500 August 28, 2013 Joe Schultz Schultz Engineering, LLC 2730 Longmire, Suite A College Station, Texas 77845 RE: REQUEST FOR ENCROACHMENT ACROSS THE ENDEVCO IOLA LATERAL PIPELINE (SEMINOLE; LID #14; TRACT #BR-11; DB #6410) LETTER OF NO OBJECTION — BRAZOS COUNTY, TEXAS Dear Mr. Mr. Schultz: Pursuant to your request on behalf of CastleGate II Subdivision (CG (l)'s proposed construction of an eight feet (8') wide concrete sidewalk and a four -foot (4') high landscaping berm as per plans from Schultz Engineering, LLC dated July 2013 (collectively referred to as ENCROACHMENT) crossing the Endeveo Iola Lateral pipeline, please be advised that Seminole Pipeline Company as represented by its operator Enterprise Products Operating LLC (COMPANY) hereby has no objection to the proposed ENCROACHMENT in consideration of CG II'S agreement to the following requirements: A minimum of 48 hours (excluding weekends and holidays) prior to commencing construction activities relating to the Encroachment within twenty-five feet (25') of COMPANY'S pipeline, CG II shall notify, or shall require and be responsible for its contractors, agents, and subcontractors to notify local One -Call by dialing 811, as well as COMPANY'S Operations representative Vince Tabone at (713) 823.2120, so that Mr. Tabone or his designated representative can be present during any approved construction operations. The following language must be conspicuously displayed on all drawings depicting the pipeline: WARNINGI HIGH PRESSURE PIPELINE Excavation and/or Construction Prohibited without Prior Written Permission From Enterprise Products Operating LLC 2. CG II'S crossing(s) will be as close to ninety (90) degrees as possible to COMPANY'S pipeline, but not less than forty-five (45) degrees. Approved construction within ten feet (10') of COMPANY'S pipeline and facilities require physical verification of pipeline location prior to commencement of any work. 3. CG II'S concrete sidewalk will be constructed in such a way that a minimum vertical separation of three feet (T) is maintained between the top of COMPANY'S pipeline and the top of the paved surface. 4. CG II'S landscape berm will be constructed in such a way that a maximum vertical separation of eight feet (8') is maintained between the top of COMPANY'S pipeline and the finished grade. The COMPANY'S representative will measure the finished grade of cover to ensure the maximum height is not exceeded. 5. CG II will not move construction equipment across COMPANY'S pipeline and/or rights -of -way without the consent of COMPANY'S representative. A 72-hour notice is required before crossing the pipeline with heavy equipment. Wherever CG II is approved to cross COMPANY'S pipeline and/or rights -of -way with heavy equipment, CG II will place matting or other suitable material over the pipeline as determined by COMPANY'S representative in the field at a perpendicular angle. All parallel movement of heavy equipment shall maintain a safe distance of five feet (5') horizontal separation between COMPANY'S pipeline and equipment. ENTERPRISE PRODUCTS OPERATING LLC ENTERPRISE PRODUCTS HOLDINGS LLC (General Partner) RE: REQUEST FOR ENCROACHMENT ACROSS THE ENDEVCO IOLA LATERAL (SEMINOLE; LID #14; TRACT #BR-11; DB #5405) LETTER OF NO OBJECTION — BRAZOS COUNTY, TEXAS Dear Mr. Schultz: Pursuant to your request on behalf of 3-13 Development (3-D)'s proposed construction of the Casllegate II Subdivision project (referred to as ENCROACHMENT and described in detail below) crossing the Endevco Iola Lateral pipeline, please be advised that Seminole Pipeline Company, LLC represented by its Operator Enterprise Products Operating LLC (COMPANY) hereby has no objection to the proposed ENCROACHMENT in consideration of ENTITY'S agreement to the following requirements: 1. ENTITY'S aforementioned Castlegate II Subdivision project as per plans from August 30, 2012 and received updated plans September 27, 2012 that will consist of two (2) twenty foot (20') wide lanes separated by a six Inch (6") raised curb median, one (1) four Inch (4") thick by five feet (5') wide concrete sidewalk and one (1) four inch (4") PVC drain pipe. 2. A minimum of 48 hours (excluding weekends and holidays) prior to commencing construction activities relating to the Encroachment within twenty-five feet (25') of COMPANY'S pipeline, 3-13 shall notify, or shall require and be responsible for its contractors, agents, and subcontractors to notify local One -Call by dialing 811, as well as COMPANY'S Operations representative Mark Winford at (979) 830-5842, so that Mr. Winford or his designated representative can be present during any approved construction operations. The following language must be conspicuously displayed on all drawings depicting the pipeline: WARNINGI HIGH PRESSURE PIPELINE Excavation and/or Construction Prohibited without Prior Written Permission From Enterprise Products Operating LLC 3. 3-D'S crossing(s) will be as close to ninety (90) degrees as possible to COMPANY'S pipeline. COMPANY will require physical verification of pipeline location prior to commencement of any work including open cut construction. 4. 3-D will place warning tape in accordance with American Public Works Association (APWA) Uniform Color Code, shall be placed above the foreign utility, twelve inch (12") below the ground and shall extend at least twenty feet (20') in such a manner that it would be unearthed before damage could result to the pipeline. 5. 3-D'S aforementioned concrete road and concrete sidewalk crossing(s) will be Installed in such a way that a minimum vertical separation of four feet (4') is maintained between the top of COMPANY'S pipeline and the top of the paved surface(s). TEXAS 77064-6317 713.381.6500 w .enlerpriseproductsxom 6. 3-D will install the aforementioned PVC drain pipe across and over COMPANY'S pipeline In such a way that a minimum vertical separation of twenty-four inches (24") between the top of COMPANY'S pipeline and the bottom of 3-D'S drain pipe Is maintained. 3-D will not move construction equipment across COMPANY'S pipeline and/or rights -of -way without the consent of COMPANY'S representative. COMPANY will require a minimum of 72 hours notice prior to crossing COMPANY'S pipeline with heavy equipment. Wherever 3-D is approved to cross COMPANY'S pipeline and/or rights -of -way with heavy equipment, 3-D will place matting or other suitable material over the pipeline as determined by COMPANY'S representative in the field. No large vibratory compaction equipment is allowed within the COMPANY'S right-of-way, only walk -behind vibratory roller/compactor is allowed when working over COMPANY'S pipeline. 3-D will maintain a minimum of four feet (4') of cover over the top of the COMPANY'S pipeline at locations where construction or maintenance activities will take place over the pipeline. 8. 3-D may place excavated material inside COMPANY'S rights -of -way, but may not place such material over COMPANY'S pipeline unless approved by COMPANY'S representative. No equipment will be allowed to work over COMPANY'S pipeline unless approved by COMPANY'S representative. COMPANY requires hand excavation to be performed within elghteen-inches (18") plus half the diameter of COMPANY'S pipeline; however, at no point should mechanical excavation be performed less than two feet (2') from COMPANY'S pipeline. All mechanical digging equipment must have the teeth removed or barred with a plate welded across the teeth. 9. 3-D will not place large landscaping, including, but not limited to, trees and large shrubs with a mature untrimmed height greater than eighteen inches (18") on COMPANY'S rights -of -way. No light or utility poles, fences, buildings, houses, barns, garages, patios, swimming pools, reinforced concrete slabs, or other permanent structures will be permitted on COMPANY'S rights -of -way. 10. Any and all use of COMPANY'S rights -of -way for temporary workspace and any and all crossings of the subject pipeline must be approved by COMPANY'S representative in the field, provided, however, that such approval shall not be unreasonably withheld. 3-D agrees to clean up and repair all damages to COMPANY'S rights -of -way resulting from the work on or across COMPANY'S rights -of -way. Any and all damage repairs and cleanup of COMPANY'S rights -of - way will be subject to COMPANY'S acceptance. 11. 3-D may place and maintain utility markers on either edge of COMPANY'S pipeline rights -of -way unless said markers interfere with landowner's or tenant's land use. 12, Within 120 days of the completion of the Encroachment across COMPANY'S rights -of -way, 3-D will provide to COMPANY at the above address a reproducible as -built drawing of the crossing(s), which shall include a distance of twenty-five feet (25') on each side of said crossing($) along with depiction of elevations. 13. The existence of the Encroachment does not constitute a waiver of COMPANY'S express rights under the COMPANY'S grant of easement or any other rights which may be implied by law or equity.
