Okay,
Here is where I am currently on the issue Bo raised regarding screening of mechanicals with his Falcon Point project.
The UDO only explicitly requires screening of mechanicals in the NRA provisions, which thereby exclude pure
MFR projects.
The Site Design Standards require a note that implies all mechanical equipment must be screened with related
criteria/standards for all site plans. — I believe this to be beyond the scope of authority granted via the LIDO.
The LIDO provides the Administrator the authority to require additional screening of offensive equipment,
leaving that determination and latitude to the Administrator. — I believe (and am prepared to use) this provision
would allow screening to be required where a large piece of mechanical equipment was placed (in contrast to
individual condenser units) with a MFR project and/or where the mechanical equipment (including individual
condenser units) was located adjacent to SFR uses —these are the parameters I would prefer to use to make the
determination under this section.
So, having said all of that, I do not believe the UDO requires the screening in this case, that the site design standards are
invalid in this regard, and that I am not prepared to exert the afforded Administrative authority to require additional
screening — therefore, this email should accompany the approved site plan to explain why the required note is not being
followed and Bo should be informed, that though his plans carry this note and show the screening, he is not required to
do so.

I wanted to follow up with you on the mechanical equipment screening question. While the approved site plan depicts
and notes the screening of the AC units, you will not be required to do so for Falcon Point Condos. It has been
determined that these individual units should be considered different from large mechanical equipment. In addition,
the property is not adjacent to single-family uses, which could require additional screening measures.

I spoke with Steve Smith with the Fire Marshalls office on site this morning and he was fine with the limestone
base surface. I wasn't aware that Sanitation intended to use it as a turn around. It certainly will support the
traffic. It is limestone base over lime stabilized dirt. I am really struggling with asphalt surfacing it since it is so
temporary. We have built a chain across the entrance on two post and were going to put a Knox Lock padlock
on the chain so that fire could take it down. We can put a hook on the other end of the chain that Sanitation can
take down and put back up, but that seems a bit of a pain... We will not stripe parking spaces on the concrete
area and we have already posted the signage for a fire lane and will stripe it as a fire lane.
As for the mechanical equipment shielding, the only shielding required has been from the ROW. Are you telling
me we have to build a fence to shield equipment from the Huntington Apartments? That has not been required
in the past. It is multifamily against multifamily. I think that is only required if it is single family neighbor.
Please clarify. If Dave Coleman is worried about his sewer line and Electric Utilities is worried about access
then what are they going to say when we build a privacy fence down the middle of their PUE? There are 24 a/c
units down the back of the building so it would be nearly all fence. Not to mention the pain of having to mow
and weed eat around it.

parking so that the entire area (the concrete and the stabilized base can be used for turnaround purposes for fire and
sanitation, then we can make this work.

The area behind the planter bed to the South of the parking lot that was disturbed will never grow
grass. It is a heavily forested tree canopy and it didn't have grass before. Any attempt to sod or
hydroseed is going to be useless. Scott Ball had a good suggestion. How about if we mulch that
strip and make the planter bed extend over the disturbed area. It is not our land and Paul Clarke
the owner is good with mulch and commented that they would be tearing that area out in time
anyway. Would that be an acceptable ground cover? It could be quick and grass just isn't going
to grow there.
The trees were not placed on Paul Clarkes land. They were dead trees and they cut them down
before they fell down and did some damage. I will talk to Travis at Pauls office and see if I can
get them to remove them. I think that was there intent but it just got too hot for the older
gentleman that was doing the work.
We can put asphalt over the limestone base for the fire turn around but it is going to be so
temporary I hate to. The limestone base turnaround was OK with fire so we were hoping that the
limestone would be sufficient. We hope to start phase 2 in January for a May completion. It
seems a real waste to put down asphalt for four or five month. We will if we have to but were
hoping to not.

I went out and walked the site briefly with Donnie. Here is the list of items that should be
for temporary drainage swale, dumpsters, we are not doing covered parking till next year,
lighting circuit for monument sign comes out of building #1 so it won't get lighted till next year,
A/C unit screening from street and electrical transformer screening.
I would much prefer to get surprises this week where I can deal with them and not the week after
when I am dying for a CO and have students with u hauls in the parking lot.

and neither will the covered parking
• Establish ground cover for all disturbed areas, including the drainage swale, the disturbed
area adjacent to the landscaping, and the disturbed area for future building #1
• The dirt pile that is located where building #1 will be must be removed from the site
• Pick up all trash and debris around the site. There is addition trash that has spilled over
onto Phase 2 and back in the wooded area that will need to be cleaned up
• Remove all trees that were pulled up and placed on Paul Clarke's property to the south
• Construct the dumpsters pads and place the required 4 dumpsters
• Screen the mechanical equipment with a 4 foot tall white vinyl fence (as described in note
#20 on the site plan)
• Screen transformers
• Fire turn around still needs single course surface treatment and must be gated
I can't remember if the following items were addressed:
• Stripe the fire lane
• Install streetscaping trees and landscaping in the end island that was supposed to contain the
mailbox
Please remember that this is not an exhaustive list and you should consult the construction
documents to ensure that everything has been properly completed. I did not go inside the
buildings to check for any interior issues.

It is important that city services be able to easily maneuver in the turnaround.

north.

I spoke to our operation and maintenance folks and they will allow parking flat
work directly adjacent and perpendicular to the proposed drive isle within the
Atmos Energy easement. Please understand that these decisions are on a case by
case basis. With that said there needs to be a note on the City site plan stating
that the property owner is fully responsible for the replacement of any area
disturbed in the event that Atmos Energy must excavate within the subject easement.

Alan and I have looked at the drainage report, but I don't think those comments are of consequence at
this point. With regard to this project, we have decided to let this phase only be grandfathered as part
of the area which does not require detention. With all future phases, we will be utilizing better data
which indicates that this area requires detention. Alan has already spoken with Bo Miles about this, and
we will be sending a letter to Travis Martinek with Clark & Windham indicating that future phases must
provide detention.

Dear Mr. Martinek,
As you know, development of the property at the northwest corner of Holleman Dr. E.
and Dartmouth St. has been discussed in numerous meetings over the years. There
have been various development proposals provided and subsequent conversations and
notes regarding applicable standards, requirements, and guidelines.
Phase I of the Falcon Point Subdivision Development currently has a site plan under
review and questions have been raised regarding the requirements for stormwater
detention on this site. After careful consideration, we have decided to permit this first
phase only to develop without providing detention for the following reasons:
The design engineer has provided a brief drainage analysis indicating that
detention is not warranted, and
Early project design without detention was predicated on the assumption that
the reach of Wolf Pen Creek where this project ultimately discharges was not
required to detain based on the B/CS Unified Stormwater Design Guidelines
that have been in place for several years.
The primary purpose of this letter is to communicate to Clarke & Wyndham, and others
that may be involved in development of the remainder of the 12.94 acres of the
subdivision, that all future projects on this site will be required to provide detention. In
recent years, a more thorough flood analysis has demonstrated that all properties in the
Wolf Pen Creek Watershed are required to provide stormwater detention. Please note
that this analysis has been circulated throughout the local engineering community for
over a year and is currently being utilized as best available flood hazard/detention data.
Due to the noted factors, we will no longer be able to continue grandfathering this tract
under the previous detention exemption standards.

cover proposed with this project. The overall drainage area for this portion of the creek is +/- 50
acres with almost all of it being previously developed in commericial or multifamily uses
without detention. The addition of the Falcon Point project adds a very small increase in the
amount of impervious cover. Since Falcon Point is located at the bottom end of the tributary
(DA 2), the discharge enters the system much before the peak of the main portion of the drainage
basin reaches its crest (DA 1).
2. It is unclear where the two study points referenced are located as they are not shown on the
exhibit. See attached exhibit. I added a point on the map where the study point is located.
The drainage report will need to be signed and sealed prior to approval. Duly noted.

We had further discussions this afternoon about the 15-ft offset between the building and the 30-inch
sanitary sewer line that Water is requesting. While it practically makes sense to require the additional
separation, we do not think that we can require the building to be shifted for a couple of reasons. First,
this comment was not made with the initial site plan review and site redesign at this point may be costly
to the developer. Also, we feel like the regulations in the BCS Design Guidelines are only suggesting a
15-ft offset for proposed sanitary sewer lines where possible. Since this is an existing line in an existing
easement, we do not feel that we have the authority to require the additional set back.
As I mentioned previously, it makes sense that we need additional space to be able to maintain our
infrastructure. Since we don't feel like we can make the 15-ft offset a requirement, it may be best if you
contacted Bo directly (as you mentioned earlier) to try to work through the issues.
