As required by this section, Woodridge will post a cash bond in an amount equivalent to 150% of the landscape & irrigation bid for the Project. Per discussions between yourself and our representative, Amanda Wallis of Capstone Collegiate Communities, LLC ("Capstone"), the required bond amount is Four Hundred Seventy Two Thousand Two Hundred Sixteen Dollars ($472,216.00). It is further understood that as the associated landscaping & irrigation work has been verified by the City as being completed at each building, the bond shall be released within 10 days by the City to Woodridge. Attached are 3 checks each representing 1/3rd of the total bond amount which will be individually allocated to the landscaping & irrigation work at Buildings 1, 2, and 3. Plant material and/or lawn not irrigated with a permanent irrigation area are not guaranleed.If tree drainage is needed after percolation lest, tree drainage shall be an additional cost. If sodding occurs between September 1 and March 1, over -seeding with winter rye shall be an additional cost. Contractor proposes [ ] contracts [ ] to furnish all materials and perform all labor necessary for completion of A COMMERCIAL GRADE IRRIGATION SYSTEM AND/OR LANDSCAPE AT THE PROJECT ADDRESS MENTIONED ABOVE. Irrigation installation is covered by a one year parts and labor warranty. Materials carry manufacturer's warranties of at least one year. Irrigation materials are guaranteed to be commercial grade as specified and work shall be performed in a timely manner according to industry standards. Acts of nature are not deemed as warranty situations. In the event of an act of nature [or vandalism] any subsequent damage to the Contractor's installation shall be a billable item. Should rock be encountered at a depth such as to materially interfere with installation, a $500 00 per day surcharge for each day Rock Saw is required, shall apply. Contractor does not provide warranty, maintenance, or monitoring of temporary irrigation and will not be responsible for damage done to temporary irrigation. Landscaping shall be installed as per plans and specifications supplied by client, general contractor or Inndscape Architect, and follows industry landscape installation standards. Any deviations, exclusions or alternates will be specified in bid. All plant material is guaranteed for one year upon final completion date. Contractor will perform maintenance and watering of plant material umil final acceptance. Water shall be provided on site by Others. Over watering or under watering after acceptance date shall void guarantee on damaged or dead plant material. Guarantee excludes replacement of plants destroyed by catastrophic acts of nature or vandalism. General: Contractor carries Worker's Compensation and General Liability Insurance. Contractor secures applicable permits and abides by state and local codes. Proposal may be withdrawn if not accepted within 30 days of proposal date.Change Orders must be signed and dated before any changes occur for this project and the dated plan.Final Acceptance of the Project releases Contractor of any liability or responsibility of neglect, damage or vandalism of the Project. Tile legal venue for this contract is performable in Denton County, Texas.The above price does not include sales lax. Sales tax will be in addition to the amount specified if a resale certificate or lax exemption form is not received. In the event a contractor requires Contractor to list contractor as additional insured and/or a waiver of subrogation is required, the contractor must notify Contractor, in writing, before an acceptance of this proposal. PAYMENT / PAYMENT SCHEDULE (If applicable) Draw Schedule/Payments [and Relainage, if required] shall be Net 30 unless otherwise determined and agreed upon, in writing, prior to commencement of any work on the proposed/contracted irrigation installation site. Contractor shall be notified of any contemplated contractor back charge, in writing at least 7 days prior to the back charge event. Contractor shall be given the opportunity to investigate and confirm or refute any impending or contemplated back charge before it occurs. All monies are due at time of Final Acceptance. Written evidence of acceptance by the contractor and/or agents of contractor is signified by completion of Contractor's Acceptance Form.
