The building size and associated rear drive and retaining wall structures have been adjusted so that they have shift uniformly 5' toward the front of the property. Therefore, the private drainage facilities are no longer within the limits of the public drainage easement; 2. All proposed fill has been limited from adjacent property and retaining walls, rated at H- 20 loading, have been placed to accommodate the proposed grading; 3. The Architect and the Developer have been duly noted; 4. Grading for the "off-site" portion of the common driveway, located on Lot 2, Block One of the Gateway Park Subdivision, has been revised so that embankment fill stays within the limits of the access/parking agreement. Therefore the retaining wall in this area has (:'\ been eliminated; \2.) It is our understand that the Architect (RAI) has supplied TxDOT with a new driveway permit with the relevant portion of the Grading Plan attached; 6. This comment is no longer relevant due to the changes identified in Response No. 4; 7. Proposed grading/spot elevations illustrated should create sufficient drainage divides to maintain current flow conditions and patterns. The subject area is located along the Tributary to Carters Creek from a point approximately 80 feet downstream of East Frontage Road to a point approximat.ely l ,OOO ·feet downstream of East Frontage Road. This revision was initiated by Spencer CT. Thompson Jr., City of College Station, in a letter dated November 20, 2000. We issued a Conditional Letter of· Map Revision (CLOMR) for this project on May 29, 1996. We received certified hydraulic analysis, as-built plans, an annotated FIRM reflecting post-project conditions, a maintenance agreement for the culverts, fill certification, a revised topographic workmap, and all applicable forms, prepared by Mr. Thompson, in support of this revision. We received all of the data required to perform a technical review of the request as of November 19, 2001. Based on our review of the submitted data, we are issuing this LOMR to reflect the Springer Chevron Property. This LOMR revises the Special Flood Hazard Area (SFHA) for the Tributary to Carters Creek, which is designated Zone A, to show decreases in width. The maximum decrease in the SFHA is approximately 400 feet at a point approximately 125 feet downstream of East Frontage Road. This revision is shown on the enclosed annotated portions of FIRM panel 48041C0142 C, dated July 2, 1992. This revision is effective as of the date of this letter. Any requests to review or alter this determination should be made within 30 days and must be based on scientific or technical data. We based this determination on the 1% annual chance (100-year) discharges computed in the submitted hydrologic model, without considering subsequent changes in watershed characteristics that could have increased discharges. Additionally,· future development of 2 characteristics that could have increased discharges. Additionally, future development of projects upstream may increase discharges, which may increase flood hazards. A comprehensive restudy of your community's flood hazards would consider the cumulative effects of development on discharges subsequent to the publication of the CLOMR, dated May 26, 1996, · and could, therefore, establish greater flood hazards in this area. This LOMR is based on minimum floodplain management criteria established under the National Flood Insurance Program (NFIP). Your community is responsible for approving all floodplain development and for ensuring all necessary permits required by Federal or State law have been received. State, county, and community officials, based on knowledge of local conditions and in the interest of safety, may set higher standards for construction in the SFHA. If the State, county, or community has adopted more restrictive or comprehensive floodplain management criteria, these criteria take precedence over the minimum NFIP criteria. This revision has met our criteria for removing an area from the 1 % annual chance floodplain to reflect the placement of fill. The community must ensure that any structures placed within the subject area be constructed such that they are "reasonably safe from flooding." "Reasonably safe from flooding" means base flood waters will not inundate the land or damage structures to be removed from the SFHA and that any subsurface waters related to the base flood will not damage existing or proposed buildings. The community and engineers should review and use FEMA Technical Bulletin 10-01, Ensuring that Structures Built on Fill In or Near Special Flood Hazard Areas are Reasonably Safe From Flooding, which may be downloaded directly from the Federal Emergency Management Agency (FEMA) website at http://www.fema.gov/mit/tblOprop.pdf. NFIP regulations Subparagraph 60.3(b )(7) requires communities to ensure that the flood-carrying capacity within the altered or relocated portion of any watercourse is maintained. This provision is incorporated into your community's existing floodplain management ordinances; therefore, responsibility for maintenance of the modified channel and culvert rests with your community. We may request that your community submit a description and schedul~ of channel and culvert maintenance activities. We will not print and distribute this LOMR to primary users, such as local insurance agents or mortgage lenders; instead, the community will serve as a repository for the new data. We encourage you to disseminate the information in this LOMR by preparing for publication in your community's newspaper, a news release that describes the revision and explains how your community will provide the data and help interpret the NFIP maps. In that way, interested persons, such as property owners, insurance agents, and mortgage lenders, can benefit from the information. Use the map panel listed above and revised by this letter for flood insurance policies and renewals issued in your community. We have enclosed an updated version of a document titled List of Current Flood Insurance Study Data, which includes this letter, to help your community maintain all information for floodplain management and flood insurance. If any of the items in that document are not filed in your 3 community's map repository, please contact the FEMA Map Assistance Center at the telephone number listed below for information on how to obtain those items. We have made this determination pursuant to Section 206 of the Flood Disaster Protection Act of 1973 (P.L. 93-234) and in accordance with the National Flood Insurance Act of 1968, as amended (Title XIII of the Housing and Urban Development Act of 1968, P.L. 90-448), 42 U.S.C. 4001-4128, and 44 CFR Part 65. Pursuant to Section 1361 of the National Flood Insurance Act of 1968, as amended, communities participating in the NFIP are required to adopt and enforce floodplain management ordinances that meet or exceed minimum NFIP criteria. The Permittee shall hold harmless the State and its duly appointed agents and employees against any action for personal injury or property damage sustained by reason of the exercise of this permit. 5. Except for regulatory and guide signs at county roads and city streets, the Permittee shall not erect any sign on or extending over any portion of the highway right of way, and vehicle service fixtures such as fuel pumps, vendor stands, or tanks shall be located at least 12 feet from the right of way line to ensure that any vehicle services from these fixtures will be off the highway right of way. 6. The State reserves the right to require a new access driveway permit in the event of a land use change or change in driveway traffic volume or vehicle types. 7. For this purpose, the booklet entitled "Regul ations for Access Driveways to State Hi ghways", was published and adopted, setting out departmental policies to regulate construction and maintenance of access driveway facilities. Contacts with local utility companies and utility locators are required. 4) Lane closure will be allowed between 8:30 AM and 4:30 PM only. Flagmen will be required, if necessary. 5) Connecting Driveway shall be located as indicated and construction shall be according to the City of College Station Standard Details & Specifications. (w= 36' B-B, R= 20'Min). Reinforcing shall be # 4 Bars (24" O.C.B.W.), or an approved equal for an RFC Driveway. 6) Raised curb I curb & gutter sections shall terminate no closer than 30' from existing travel lanes or tie-to existing curb & gutter sections. 7) No undercutting of existing asphalt pavement will be allowed. 8) SET's (6:1) shall be required as indicated (see attached). 9) Ditches (upstream & downstream) @ access driveway shall be graded to drain. 10) Contractor shall notify Jeffrey Holland @ Brazos Maintenance (778-8054) for handling of any roadway signs in conflict with access driveway construction. 11) Pavement surface shall be kept clear of mud, debris, etc. 12) Contractor shall contact Mr. Walt Norwood @ 778-8054, TxDOT, or WNorwood @ Dot.State.Tx.US , 48 hours prior to starting work. General Terms and Conditions The following general tenns and conditions apply to the Easements granted by this instrument: 1. Character of Easement;;. The Easements are appurtenant to and run with the Properties, and portions thereof, whether or not the Easements are referenced or described in any conveyance of the Properties, or any portion thereof, The Easements are for the benefit of the Parties and the heirs, legal representatives, successors, and assigns of the Parties who at any time own the Properties or any interest therein (as applicable, the HHolders"). Such construction must be accomplished in a good and workman I ike manner, substantially in accordance with the Public Road Access Area(s) Plans, such that final completion (as such term is defined by TxDOT) will occur on or before the Public Road Access Area(s) Completio{l Deadline. All driveways, driving areas, curb cuts, and Public Road Access Arca(s) located on the Propertiei; must be maintained at a level of appearance and utility consistent with the highest industry standards then prevailing for similarly used properties in the ma.rket in which the Properties are located. Each Holder will be solely responsible: for the costs of maintaining the driving lanes, driveways, curb cuts, ShartJd Access Easement Page J 11/t>0 39'i7d 99EE -9t>8-6L6 parking spaces, and Public Road Access Area(s) located on that Holder's Properties. If a Holder does not perfonn the required maintenance then any other Holder(s), after giving the r1onperforming Holder thirty (30) days' written notice, will have the right to perform the maintenance and receive reimbursement from the nonperforming Holder for the reasonable costs expended. Reimbursement will be payable on demand and include the costs of the maintenance, plus interest at the lower of. (a) the highest rate pennitted by law; or (b) the rate of 12 percent per year). No walls, fences, or barriers of any kind shall be constructed or maintained in the Public Road Access Areas or any portion thereof which preventS or imports the use or exercise of the easements granted herein, or the free access and mowments, pedestrian and vehicular traffic between the Public Access Areas and the Public Road. 5. Rii:hts R!r~erved. Each Party reserves for that Party and that Party's heirs, legal represent.atives, successors, and assigns the right to continue to use and enjoy the surface of the Properties for all purposes that do not interfere with or interrupt the use or enjoyment of the Easements. 6. Eguitable Riahts of }:nforc~ment. These Easements may be enforced by restraining orders and injunctions (temporary or permanent) prohibiting interference and commanding compliance. Restraining orders and injunctions will be: obtainable on proof of the existence of interference or threatened interference, without the necessity of proof of inadequacy of legal remedies or irreparable harm, and will be obtainable only by the Part1es to or those benefited by this instrument; provided, however, that the act of obtaining an injunction or restraining order will not be deemed to be an el~ction of remedies or a waiver of any other rights or remedies available at law or in equity. Miscellaneous The following miscellaneous terms and conditions apply to the Easements granted by this instrument: 1. Alternative Dispute Resolution. The parties agree to mediate in good faith to resolve any dispute under this Instrument. Fol1owing mediation, all unresolved issues will be resolved by binding arbitration. Absent an agreement to use other rules, the arbitration will be controlled by the American Arbitration Association's Commercial Arbitration Rules. The arbitration award may be judicially enforced by filing it in a court of proper jurisdiction as a final judgment of that court, and additional attorney fees and all other costs of the prevailing party will be paid by the party against whom enforcement is obtained. The parties waive their right to a trial by jury. The arbitration . hearing must be no more than ninety (90) days from the selection of the arbitrator(s), and the final and unappealable ruling of the arbitrator(s) must be rendered in writing within sixty (60) days from .the arbitration hearing. · 2. Bindin~ Effect. This instrument binds and inures to the ben~fit of the Holders and their respective heirs, legal representatives, successors, and pennirtcd assigns. 3. . Qhoice of L!iw. The model appears to have utilized single metering outlet weirs but the proposed Grading Plan has several weirs. 3. The proposed Grading Plan depicts fill onto the adjacent eastern lot. Written consent is needed from this adjacent property owner. Similarly, the access easement documentation with the neighboring property needs to be finalized. 4. The proposed Grading Plan varies from the previously submitted Site Plan and the Grading Plan has several non-conforming Site Plan requirements such as islands, rear drive aisle, etc. Let us know if we need to meet to discuss this project further. Dear Alan: I have reviewed the comments presented by CIVILTECH ENGINEERING, INC. after their study of the Storm Water Report submitted to your office by Berry Engineering Company. As you know, I did not personally, or on behalf of Berry Engineering Company solicit, encourage or agree to any third party review of the submitted report. However, since you have requested the CIVILTECH ENGINEERING, INC. comments be addressed before considering the letting of a building permit for my client, I will try to provide responses even though the comments are somewhat ambiguous, and it appears, they were created without a complete understanding of the project. CIVILTECH ENGINEERING, INC. comments with responses by Berry Engineering in italics: 1. A project location map should be supplied. The location should be included on all maps. The previous!J submitted site plan f?y RA.I. Inc. include a location map, however, it was not anticipated that a1!Y work product would be reviewed f?y unsolicited third parties 2. A complete drainage area map above R440 should be supplied. What defines a "complete drainage area map above node R440" and what additional information could be derived if the conditions at R440 are presented and these conditions have been previous!J accepted? 3. Page 4: The FEMA FIRM was referenced but was not provided as part of the report. The report states that the property does not lie within a designated 100-year flood plain, but the topographic survey indicates it is in "Zone A". This was not necessary as evidenced ry the fact that CIVILTECH ENGINEERING, INC. was able to eventual!J come to fact that a small part of the site did exist in the floodplain, however, it should have been obvious this storm-water is accounted for in the 1 OOJlear event, as presented. 4. Page 5: the term "floodway" is used to describe the outlet channel for the Crossroad property and Carters Creek. This term should be reserved for FEMA floodway channels. This term was used out of context, but should this inadvertent use of a term be a material condition for detrying a developer/ taxpqyer the opportuniry to the quite ergqyment of his properry for the purpose of a benefit to the public and government entities. 5. Page 5: A reference for the outlet channel for the Crossroad property should be provided. Outlet channels were referenced in the report on page 5 in the first sentence under the PROPOSED DRAINGE heading ''will drain direct!J into the floodwqy via a series of openings in the Crossroads concrete drivewqy': 6. Page 5: It stated that the hydrograph for the Crossroads property was started later in time-no information is given to back up this amount if lag. The time for Crossroads run-efl to arrive at the collection point was calculated and added to displace the Crossroads start time (lag). This was stated on page 5 of the report in the T 1 paragraph under the PROPOSED DRAINGAGE heading. However, even if the start time (lag) for the Crossroads runeff is at a'!Y time during the 1 OOJlear storm event it is very small compared* to the total runefl arriving at the R440 collection point. *Increase %=24.02 / 20,325=0.079% (Crossroads peak, cjs /Total runeflpeak, cjs) 7. Peal discharges for Crossroads property were computed using the Rational Method. Consideration should be given to include o ffsite runoff for this area (sub area R440440; drainage area of 0.5 square miles. The Rational Method was an accepted method until recent adoption of the ''Bryan and College Station Unified Storm water Design Guidelines': The statement "Consideration should be given ... " seems ambiguous. Should the additional area collected at R440440 be included in the stuqy along with R440 or should it be studied independent of R440. In either case, Crossroads runefl would still contribute essential!J the same volumetric peak flow rate; however, it would be considerab!J less if all areas at the approximate!J same collection point were studied, collective!J. 8. Hydrographs for Carters Creek was computed utilizing Natural Resources Conservation Service Methods. It is assumed (this is not stated in the report) that these hydrographs were routed and combined utilizing H EC-HMS. It is probab!J correct to assume the Hydrographs were computed utilizing Natural Resources Conseroation S enJice Methods and routed and combined utilizjng HEC-HMS, but regardless of the routed and combined method a'!Y difference would be insignijicant if the same st114J period were used. 9. The timing of the hydrographs for the Crossroads property was compared to the HEC-HMS model at node R440. Two different methodologies should not be compared. Different methods were used since the "Rational Method" was accepted at the time of project start-up. At the start of this prq;ect during a meeting with the ciry and designer/ architect it was decided that all that would be needed would be a drainage report showing the pre-development and post-development conditions and detention would not be necessary. This was decided since the properry site was geographical!J located at the lower portion of the total drainage area and detention would not benefit downstream condition as well as allowing Crossroads runeff to free-flow into the concrete drainage ditch aqjacent to the properry. 10. The HEC-HMS mode was not provided. Availabili!J of the complete certijied model was not inquired about since it would have required considerable more cost and pro;ect delqy due to time for procurement. However, the data received and included in the report was all that was requested and this data was considered an adequate representative of the conditions at the Crossroads properry site. 11. Multiples frequencies (2-year thru 100-year) were computed for the site, but only the 100-year was compared to Carters Creek. The 2-year, 5-year, 10-year, 25-year, 50-year, along with the 100-year storm events were included since thry were in the onginal report requested ly the ciry to show the pre-development and post- development conditions. This was before a'!Y presumption, intent or knowledge of the contracting of a 3rd parry entiry that could be corifused ly their omission in the subsequent report. 12. Any source not produced by the engineer should be referenced (see maps). A'!J source not referenced was definite!J inadvertent and unintentional, however, the maps have the sources prominent!J listed and it should have been obvious there was no intent to steal credit from another person or entz!J. This alleged inference that Berry Engineen·ng Compa'!Y is trying to steal credit for producing or creating maps withoutgiving credit to the author seems strange comingfrom CIVILTECH ENGINEERING, INC., engineer, Ronald F. Mryers, P.E. since he contracted to review and discredit the work product and intelligent paper created ly a competing engineeringjirm for considerable economic gain. This act is not on!J against all ethic rules, but also, a violation of Federal and State law and statutes. 13. Hydraulic computations were not provided. Computations are not usual!J included in all reports unless thry are necessary to impress a finding or fact. The seal and signature ly an engineer licensed in the state ofjurisdiction is all that is necessary to approve and certijj the construction of a prq;ect, however, it is of benefit and an accepted practice ly most engineers to provide the controlling government entity with a'!Y information that mqy be of benefit in ensuring a safe and succes.iful prqject. 14. A detention pond analysis was performed but not proposed. Additional information on this pond-where is located? It appears to be deeper than the terrain of the property. It does not appear to reduce the flow to pre-project conditions. No detention pond was ana!Jzed in the report. There was a typographical error in that detention pond was mentioned one time. Also, the reason for contracting the services of CIVIL IE CH ENGINEERING, INC. was to review the work of a competing engineeringfirm that was seeking to develop a site without detention and, sure!J, this was made clear at the time of contracting. 15. Additional descriptions, numbers, and tables comparisons should be summarized in the report. Even though this comment is complete!J ambiguous as to what should be added and summarized, there are ma'!J, ma'!Y things that be can added and included in a'!Y report, however, the of?jective of reports are to prom.de organized data for intelligent review to make a determination or decision. CIVILTECH ENGINEERING, INC., opinion on adverse impacts and with reposes by Berry Engineering in italics: 1. Considering the disparity in area sizes between sub area R440440 (the sub area containing the Crossroads property) and Carters Creek, it agreed this development will not adversely impact the flows on Carters Creek. This opinion i?J CIVILTECH ENGINEERING, INC., cifter review of the Berry Engineering Compa'!Y '.r report, states their agreement with the conclusion presented. 2. However, the area downstream of the Crossroads property before Carters Creek is reached will have an increase in flows and should be further analyzed. It has been presented and acknowledged from the outset of the Crossroads prq;ect there would be an increase in the flow-rate for the area downstream cifter the development of the Crossroads project. Also, it is accepted knowledge that changingpervious areas to impervious area there will be a positive change in the flow rate. The question has been whether thiS would act to the benefit of the downstream property i?J allowing the run-riff storm water to freeflow in the existing drainage 9stem or be detained and throttled to match the pre-developed conditions. Berry Engineering contends that allowingfreeflow will benefit downstream conditions since it will allow the storm water to move earlier in time and on past critical areas before the bulk of the storm water arrives. This conclusion is made even though there will a slight increase in the peak total flow-rate at the time of concentration (0.0701 ifs will be added to the pre-developed 20,325 ifs as evidenced in the latest submitted report, ''3"' &vision March 2008 ''). This increase is well within the plus or minus error tolerance prescribed i?J this methodology as acceptable for storm water runeff stur!J. It could be assumed that the better solution for Crossroads would be to just incorporate a detention facility, and this would certain!J be the academic solution. However, to accept this as the solution it must be assumed that the construction of the complete detention facility including the outlet control structure would be constructed with such accurary and tolerance so as to be exact/y equal the pre-developed flow. This would require dimensions and tolerances on detail drawing that would be nearfy impossible to meet except in very ideal conditions. I, and on behalf of Berry Engineering Company, have tried to respond to the comments presented by CIVILTECH ENGINEERING, INC. even though it appears by some of the comments presented that CIVILTECH ENGINEERING, INC. does not have a complete understanding of the Crossroads project. This document will serve as a Contract for the proposed professional services. 2. The proposal is valid for a period of 60 days, after which the Consultant reserves the right to review and revise the estimated fee, time schedule, and other terms specified herein. 3. This Contract is not assignable except with the prior written consent of the Consultant and no assignment shall relieve the undersigned of any obligations under this Contract. 4. The undersigned agrees to pay the Consultant for work performed in accordance with the terms of this Contract, without regard to the success of the project. 5. Payment to the Consultant is expressly not conditioned upon the undersigned receiving any payment from third parties who are not a party to this Contract, such as other property owners, developers, or funding agencies. 6. The individual executing this Contract, if acting on behalf of a partnership, corporation, or funding agency, represents that he/she has the authority to do so. 7. Where public hearings/meetings are involved, a minimum of two weeks' notice to the Consultant is required for proper preparation including appropriate graphics and other visual aids. 8. The Client or Consultant may terminate this Agreement at any time by notice in writing. The Client shall pay the Consultant the prescribed compensation for the services actually performed under this Agreement, less such payments on account of the charges as have been previously made. 9. Accounts rendered are due and payable upon receipt of invoice. 10. A project location map should be supplied. The project location should be included on all maps. 2. A complete drainage area map above node R440 should be supplied. 3. Page 4: The FEMA FIRM was referenced but was not provided as part of the report. The report states that the property does not lie within a designated 100-year flood plain, but the topographic survey indicates it is in 'Zone A'. 4. Page 5: The term "floodway" is used to describe the outlet channel for the Crossroad property and Carters Creek. This term should be reserved for FEMA floodway channels. 5. Page 5: A reference for the outlet channel for the Crossroad property should be provided. 6. Page 5: It is stated that the hydrograph for the Crossroads property was started later in time - no information is given to back up this amount of lag. 7. Peak discharges for Crossroads property were computed using the Rational Method. Consideration should be given to include offsite runoff for this area (sub area R440440; drainage area of 0.5 square miles). 8. Hydrographs for Carters Creek was computed utilizing Natural Resource Conservation Service Methods. It is assumed (this is not stated in the report) that these hydrographs were routed and combined utilizing HEC-HMS. The timing of the hydrographs for the Crossroads property was compared to the HEC-HMS model at node R440. Two different methodologies should not be compared. 10. The HEC-HMS model was not provided. 11. Multiples frequencies (2-year thru 100-year) were computed for the site, but only the I 00- year was compared to Carters Creek. 12. Any source not produced by the engineer should be referenced (see maps). 13. Hydraulic computations were not provided. 14. A detention pond analysis was performed but not proposed. Additional information is needed on this pond -where is it located? It appears to be deeper than the terrain of the property. It does not appear to reduce the flow to pre-project condition. 15. Additional descriptions, numbers, and tables comparisons should be summarized in the report. An opinion on adverse impacts: I. Considering the disparity in area sizes between sub area R440440 (the sub area containing the Crossroads property) and Carters Creek, it is agreed this development will not adversely impact the flows on Carters Creek. 2. However, the area downstream of the Crossroads property before Carters Creek is reached will have an increase in flows and should be further analyzed.
