Estates at Spring Creek Development & Secondary Spring Creek Basin
Dear Mr. Thompson:
This report contains the design layout and supporting data for the design of the Estates at Spring
Creek Development (ESCO) Sanitary Sewer Trunk Line. The trunk line has been over-sized to
accommodate not only the ESCO, but also the rest of the un-serviced Spring Creek Basin and
the remaining portion of the Crowley Development adjacent to the ESCO. The ESCO sanitary
sewer trunk line will be tying into the 21 "0 Spring Creek sanitary sewer trunk line on the Crowley
Property via a 20' public uti lity easement. The layout of the proposed ESCO trunk line is
illustrated in Attachment #1 .
As shown in Attachment #1 and detailed in Attachment #2 , the sewage production by the ESCO
necessitates only a 12"0 sanitary sewer tap to the existing 21 "0 Crowley trunk line. To
accommodate the Estates at Spring Creek Development, the remaining Spring Creek basin and
the remaining Crowley Development, a 21 "0 sanitary sewer line is required (See Attachment #3).
Attachments to this letter include: 1) ESCO Sanitary Sewer Trunk Line layout, 2) proposed
sewage productions for ESCO, 3) proposed sewage productions for the Spring Creek Watershed
and remaining Crowley Development, 4) Proposed 20' Public Utility Easement Field Notes and
two City of College Station Temporary Blanket Utility Easements associated with the Crowley
property.
Please review and respond as soon as possible, as my client is ready to move forward with the

PROPERTY:
All that certain tract or parcel of land lying and being situated in Brazos County,
Texas, out of the Robert Stevenson Survey, A-54, and being part of the same tract
of land described in a deed to Timothy J. Crowley, as recorded in Volume 1415,
Page 74 of the Brazos County Official Records, and being more particularly
described by metes and bounds in Exhibit "A" attached hereto and incorporated
by reference herein (the "Property").
This conveyance shall grant the rights herein specified only as to that portion of the above-
described Property more particularly described on the attached Exhibit "A" known as the
"Easement Area," and any additional area outside the Easement Area necessary to install
equipment necessary and incident to the uses of the "Easement Area," to erect, construct, instal~
and thereafter use, operate, inspect, repair, maintain, reconstruct, modify and remove a sanitary
sewer line described in the Capital Improvements Plan for Spring Creek Drainage Basin -
Sanitary Sewer Service Area 97-01 ; upon, over, and across the said Property as described and
any ways, streets, roads, or alleys abutting same; and to cut, trim, and control the growth of trees
and other vegetation on and in the easement area or on adjoining property of Grantor, which
might interfere with or threaten the operation and maintenance of any public utility equipment,
accessories, or operations. It being understood and agreed that any and all equipment and
facilities placed upon said property shall remain the property of Grantee.
Grantor expressly subordinates all rights of surface use incident to the mineral estate to the
above-descn'bed uses of said surface by Grantee, and agrees to lender's subordination on behalf
of Grantee. Grantor will provide Grantee with the names and addresses of all lenders.
RESERVATIONS AND RESTRICTIONS:
This grant of easement is subject to any and all existing matters, ordinances,
restrictions, covenants, conditions, encumbrances, rights of way, easements, tax
liens, boundary disputes, shortages in area, matters shown on surveys, maps or
plats, encroachments, overlapping of improvements, rights of parties in
possession, and all existing outstanding mineral and royalty interests affecting the
Property, of record in the Office of the County Clerk of Brazos County, along
with conditions that would be revealed by a physical inspection and/or survey of
the Easement Area and adjoining property.

ESTATE GRANTE{):
GRANTOR does hereby grant, bargain, sell and convey unto GRANTEE, its successors·
and assigns, a nonexclusive undefined or "blanket" · easement for the installation,
maintenance, repair, rebuild, operation, inspection and removal of a sanitary sewer line,
including appliances and equipment, described in the Capital Improvements Plan for
Spring Creek Drainage Basin -Sanitary Sewer Service Area 97-01 and defined by
subsequent plat.
RESERVATIONS AND RESTRICTIONS:
1. This conveyance is only of the right, privilege and easement for the aforesaid
purposes. GRANTOR and its successors and assigns shall have the right to use
and to grant to others the right to use the easement area for any purpose which
will not unreasonably interfere with the safe and reasonable maintenance and
operation of installations to be made by GRANTEE therein.
2. GRANTEE covenants and agrees to interfere as little as possible with the cattle
grazing and flow of vehicular and pedestrian traffic over and upon the site, and to
restore the surface of the site, whenever and wherever disturbed by GRANTEE, to
as good a condition as existed at the time of such disturbance.
3. GRANTEE hereby covenants and agrees that in the event the future development
or expansion of either the site or adjacent land, or both, requires the relocation of
the facilities already constructed an<l installed in the easement area, GRANTEE
will relocate such facilities, at the r'equest and expense of GRANTOR, provided
such relocation is sound and feasible from an engi neering standpoint, as
reasonably determined by GRANTEE. and provided further that GRANTOR shall
grant to GRANTEE a substitute easement, by instrument in recordable form
providing for such relocation.

The easement is intended to be temporary, but the rights granted hereiinder shall
not tenninate unless GRANTOR delivers to Grantee (i) an "As Built" survey, a5
approved by GRANTEE, showing the actual location of the sanitary sewer line;
and (ii) an executed easement instrument in form and substance as attached in
Exhibit "B'', which is incorporated by reference, conveying to· Grantee an
easement described in the "As Built" survey. GRANTOR hereby covenants and
agrees that when this property is platted, the sewer line will be accurately depicted
thereon.
GRANTOR warrants that the right of GRANTEE shall be superior to those of all
persons claiming under or through GRANTOR.

PROPERTY:
All that certain tract or parcel of land lying and being situated in Brazos County,
Texas, and being situatco in the ROBERT STEVENSON LEAGUE, A-54, and
being a part of die same uact of land described in a deed to Greens Prairie Investors,
Ltd., as recorded in Volume 3905, Page 55 of the Official Records of Brazos County
Texas, and being more particularly described by metes and bounds -in the anached
EXHIBIT"A".
ESTATE GRANTED:
1. GRANTOR grants to GRANTEE an undefined or "blanket" casement for various
utilities, to be restricted hereafter to the as-built area, and defined by subsequent
survey or plat.
2. GRANTOR docs hereby grant, bargain, sell and convey unto GRANTEE, its
successors and assigns, an undefined casement in and to the above-described parcel ·
of land; GRANTEE to install, maintain, repair, rebuild, operate, inspect and remove
all utility facilities, including conduits, duct lines, vaults, firtings, appliances and
equipment, under the above-described property.
RESERVATIONS AND RESTRICTIONS:
1. This com·cyancc is only of the right, privilege and casement for the aforesaid
purposes. GRANTOR and its successors and assigns shall have the right to use and
to grant to others the right to use the casement area for any purpose which will not
unreasonably interfere with the safe and reasonable maintenance and operation of
installations to be made by GRANTEE therein.
2. GRANTEE covenants and agrees to interfere as little as possible with the normal
flow of vehicular and pedestrian traffic over and upon the site, and to restore the
surface of the site, whenever and wherever disnirbed by GRANTEE, to a~ good a
condition as existed at the time of such disturbance.
3. GRANTEE hereby covenants and agrees that in the event the future development
or expansion of either the site or adjacent land, or both, requires the relocation of
the facilities already constructed and installed in the casement area, GRANTEE will
relocate such facilities, at the request and expense of GRANTOR, pro,;dcd such
relocation is sound and feasible from an engineering standpoint as reasonably
determined by GRANTEE, and provided funher that GRA.i'lTOR shall grant to
GRANTEE a substitute casement, by instrument in recordable form providing for
such relocation.
4. The ClSemer.t is intended to be temporary, but the rights bfallted hereunder shaiJ not.
terminate unless GRANTOR shall deliver a final "As Built" survey or plat, u
approved by GRANTEE, showing the location of utility service, equipment, and

To.be attached based on As Built survey
This conveyance shall grant the rights herein specified only as to that portion of tlie above-
described Property more particularly described on the attached Exhibit "A" known as
the"Easement Area," and any additional area outside the Easement Area necessary to install
equipment necessary and incident to the uses of the "Easement Area," to erect, construct, install, ·
and thereafter use, operate, inspect, repair, maintain, reconstruct, modify and remove a sanitary
sewer line described in the Capital Improvements Plan for Spring Creek Drainage Basin -
Sani.tary Sewer Service Arca 97-01 ; upon, over, and across the said Property as described and
any ways, streets, roads, or alleys abutting same; and to cut, trim, and control the growth of trees
and other vegetation An and in the easement area or on adjoining property of Grantor, which
might interfere with or threaten the operation and maintenance of any public utility equipment,
accessories, or operations. It being understood and agreed. that any and all equipment and
facilities placed upon said property shall remain the property of Grantee.
Grantor expressly subordinates all rights of surface use incident to the mineral estate to the above
described uses of said suifacc by Grantee, and agrees to lender's subordination on behalf of
Grantee. Granter will provide Grantee with the names and addresses of all lenders.
RESERVATIONS AND RESTRICTIONS:
This gr.int of casement is subject to any and all existing matters, ordinances,
restrictions, covenants, conditions, encumbrances, rights of way, easements, tax
liens, boundary disputes, shortages in area, matters shown on surveys, maps or
plats, encroachments,· overlapping of improvements, . rights of parties in
possession, and all existing outstanding mineral and royalty interests affecting the
Property, of record in the Office of the County Clerk of Brazos County, along
with conditions that would be revealed by a physical inspection and/or survey of
the Easement Area and adjoining property.
Upon the recording of .this casement in the Official Records of Brazos County, Texas, the
Temporary Blanket Utility Easement executed by the GRANTOR on and
recorded in Volume Page __, of the Official Records of Brazos County, Texas,
shall be released.
TO HA VE AND TO HOLD, the rights and interests herein described unto the CITY OF
COLLEGE STATION, TEXAS, and its successors and assigns, forever, and Grantor docs hereby
