STORM SEWER, ONLY The Contractor shall take all necessary precautions to prevent silt and debris from leaving the immediate construction site in accordance with the approved erosion control plan as well as the City of College Station Drainage Policy and Design Criteria. If it is determined the prescribed erosion control measures are ineffective to retain all sediment onsite, it is the contractors responsibility to implement measures that will meet City, State and Federal requirements . The Owner and/or Contractor shall assure that all disturbed areas are sodden and establishment of vegetation occurs prior to removal of any silt fencing or hay bales used for temporary erosion control. The Owner and/or Contractor shall also insure that any disturbed vegetation be returned to its original condition , placement and state. The Owner and/or Contractor shall be responsible for any damage to adjacent properties, city streets or infrastructure due to heavy machinery and/or equipment as well as erosion, siltation or sedimentation resulting from the permitted work. Any trees required to be protected by ordinance or as part of the landscape plan must be completely fenced before any operations of this permit can begin. In accordance with Chapter 13 of the Code of Ordinances of the City of College Station, measures shall be taken to insure that debris from construction , erosion, and sedimentation shall not be deposited in city streets , or existing drainage facilities. Box 1000 Bryan, Texas 77805 Re: Red Lobster Fill in TxDOT Right-of-way Dear Alan, July 8, 2003 We are currently working on a site for a new Red Lobster restaurant in the Gateway Subdivision in College Station. This site is located along the west frontage road of SH 6 just north of the intersection of University Drive and SH 6 and immediately west of the new Home Depot site. As part of this project we are requesting to fill the TxDOT right-of-way south of the most northerly driveway entrance to Home Depot. TxDOT has requested that we inform the City of Bryan of the effect of this fill and receive acknowledgement from both the City of Bryan and College Station. Per the CLOMR-F report prepared for the Home Depot, the fill placed in the Burton Creek floodplain limits had no effect on the base flood elevations at either the fill location or upstream of the Gateway Subdivision. This was due to the fact that the fill placement was located within an ineffective flow area of the creek. Furthermore, the northernmost Home Depot driveway creates a dam, which isolates the Red Lobster property and the remainder of the properties south of the driveway from the Burton Creek floodplain . TxDOT has requested an acknowledgement from the City of Bryan stating that they do not have a problem with filling the TxDOT right-of-way south of the northernmost Home Depot driveway. If you would like you may respond directly on this letter and we will forward it to Tx OT with our next submittal. Thank you for your time and help with this project. At that time, the developers decided to move forward with the Home Depot itself without pursuing the fill. Last week you should have received a copy of a drainage fill permit for this work prepared by Mitchell & Morgan. Box 9960 College Station, TX 77840 Re: Red Lobster Fill in TxDOT Right of Way Dear Spencer: May27, 2003 Attached you will find the 3 sets of the Red Lobster Fill Permit Plans as well as 2 bound copies of the revised Conditional Letter of Map Revision (CLOMR-F) runs for the Burton Creek floodplain detailed in FEMA FIRM panel number 48041C0142C. Red Lobster's desire is to fill in the TxDOT right-of-way to provide for a more aesthetic view from the frontage road and well as providing a safer roadside condition without the steep roadside ditch. The purpose for providing the CLOMR-F runs are to illustrate the floodplain hydraulics with the as-built conditions for the Home Depot site. The revisions include the addition of the northernmost driveway to the Gateway property, which in effect creates a dam that protects, and subsequently removes, the rest of the site from the adjacent Burton Creek floodplain. The placement of fill removes Lots I and 2R, Block I entirely and the majority of Lots IO and 11, Block I from the floodplain. Based on the hydraulic analysis performed, it was determined that the fill placement within the TxDOT right-of-way on the proposed Red Lobster site (Lot I 0) will have no effect on the floodplain elevation because the fill is located within the ineffective flow area and on the uphill side of the dam created by the northern driveway. These areas are detailed in Exhibits I and 2 of the attached Burton Creek CLOMR-F report. This fill is shown on the included Red Lobster Fill Permit Plans. Currently, the hydraulic design of the Red Lobster site includes the connection of a proposed 18-inch storm sewer pipe which will connect to an existing TxDOT 30- inch storm sewer that crosses to the east side of SH6. This pipe will drain both Lot 2R and the overland flow from area between the frontage road and the Red Lobster curb line with a grate inlet. Design details and calculations have been provided in the Red Lobster Fill Permit Plans on Sheet SI. • '\ Because Burton Creek is an interjurisdictional creek, by copy of this letter we are informing the City ofBryan of the effects of this fill as well.
