All trees required to be protected as part of the landscape plan must be completely barricaded in accordance with Section
7.5.E., Landscape/Streetscape Plan Requirements of the City's Unified Development Ordinance, prior to any operations of
this permit. The cleaning of equipment or materials within the drip line of any tree or group of trees that are protected and
required to remain is strictly prohibited. The disposal of any waste material such as, but not limited to, paint, oil, solvents,
asphalt, concrete, mortar, or other harmful liquids or materials within the drip line of any tree required to remain is also
prohibited.
TCEQ PHASE 2 DRAIANGE REQUIREMENTS IN EFFECT.
The Contractor shall take all necessary precautions to prevent silt and debris from leaving the immediate construction site
in accordance with the approved erosion control plan as well as the City of College Station Drainage Policy and Design
Criteria. If it is determined the prescribed erosion control measures are ineffective to retain all sediment onsite, it is the
contractors responsibility to implement measures that will meet City, State and Federal requirements. The Owner and/or
Contractor shall assure that all disturbed areas are sodden and establishment of vegetation occurs prior to removal of any
silt fencing or hay bales used for temporary erosion control. The Owner and/or Contractor shall also insure that any
disturbed vegetation be returned to its original condition , placement and state. The Owner and/or Contractor shall be
responsible for any damage to adjacent properties, city streets or infrastructure due to heavy machinery and/or equipment
as well as erosion, siltation or sedimentation resulting from the permitted work.
In accordance with Chapter 13 of the Code of Ordinances of the City of College Station, measures shall be taken to insure
that debris from construction, erosion, and sedimentation shall not be deposited in city streets, or existing drainage
facilities.
I hereby grant this permit for development of an area inside the special flood hazard area. All development shall be in
accordance with the plans and specifications submitted to and approved by the City Engineer in the development permit
application for the above named project and all of the codes and ordinances of the City of College Station that apply.

DEVELOPMENT AGREEMENT
This Agreement is entered into this the 13th day of November, 1997, by IDJ.~rmffl --'-"A ,t
City of Colleg(}.Station, a Texas Home-Rule Municipal Corporation (hereinafter referred ~
to as "CITY'),'.·:and W. Dow Hamm, III., Corp (hereinafter referred to as "HAMM''), a
Texas Co~ofat1on.
wHEREAS, HAMM is the developer of the property more particularly described as Lot
1, Block 1, ·Wheeler Subdivision Phase One, (hereinafter referred to as "MARRIOTT
PROPERTY"), as shown on the plat, a copy of which is attached hereto and incorporated
herein by reference;
WHEREAS, City Council approved a motion to rezone 2.5 acres on the southeast comer
of University Drive and Lincoln from A-P Administrative Professional to C-B Business
Commercial with conditions offered by the applicant, and
WHEREAS, HAMM: has proposed to build a Marriott Towne Place Suites extended stay
hotel on this 2.5 acres, and
WHEREAS, HAMM: offered several conditions to mitigate potential negative impacts of a
3-story hotel at this location, and
WHEREAS, impact studies have shown inadequate sewer capacity in the system for this
use, and
WHEREAS, HAMM: agreed to pay for upgrades to the system to accommodate this
particular use, and
WHEREAS, HAMM: desires to assure future sewer capacity for all properties within the
Master Plat for the Wheeler Subdivision (planning case file #97-316) (EXHIBIT A),
attached and incorporated herein by reference.
WHEREAS, The CITY has determined it necessary to do additional upgrades that are not
related to this particular use but necessary for future developments in the area, and
WHEREAS, The CITY and HAMM: have agreed to participate in these upgrades,
WHEREAS, The City Council considered and approved this Development Agreement on
November 13, 1997,
NOW, THEREFORE, for and in consideration of the recitations above and in
consideration of the promises and covenants herein expressed, the parties hereby agree
and covenant as follows:

1. HAMM shall be responsible for the cost of upgrading the 8 inch sewer line for
the MARRIOTT and WHEELER PROPERTIES, as shown on the Wheeler
Master Plat from M029 (Sheet 033, B 1) to M007 (Sheet 032, B2) (EXHIBIT
B) to a 10 inch sewer line as outlined in the Impact Study submitted by Kling
Engineering (EXHIBIT C) attached and incorporated herein by reference.
CITY shall be responsible for the construction cost to oversize the above
referenced line from a 10 inch to a 12 inch sewer line.
CITY shall also be responsible for the design and construction cost to upgrade ·
the 8 inch sewer line from M018 to M029 (Sheet 033, Bl) (EXHIBIT D) to a
12 inch line.
EXHIBIT E outlines cost participation for both HAMM and CITY.
These improvements shall be designed and constructed by HAMM as part of the
development of the MARRIOTT PROPERTY. During construction, the City
Engineer shall have the project inspected. Once the sewerline is constructed,
HAMM shall remit a "Completion Letter" to the City Engineer. If the inspector
agrees that all work has been completed in accordance with the City's
specifications, the City Engineer shall provide written documentation to HAMM
of the formal acceptance of the sewerline. Upon receipt of the acceptance letter
by CITY, HAMM shall invoice the CITY for CITY'S participation referenced in
EXHIBIT E. CITY shall remit payment within thirty (30) days of invoice.
Per the sewer impact study provided by HAA1Jvf during the processing of
the Wheeler Master Plat, all properties within the Wheeler Subdivision
shown on EXHIBIT A will require the construction of a JO" sewerline as
outlined in Item 1. above. HAA1Jvf desires to assure future capacity for all
properties within this subdivision, but the CITY does not currently
"reserve" sewer capacity for any future development. However, in view of
the concerns expressed by HAlvUvf, the City does hereby agree to assure
future sewer capacity for all properties within the Wheeler Subdivision,
per anticipated flows outlined in the referenced impact study. In the event
that such future sewer capacity is not available to said properties within
the sewerline improved and paid for by HAlvUvf, pursuant to this
development agreement, CITY agrees to reimburse HAA1Jvf or any other
developer all reasonable costs and expenses to be incurred in increasing
sewer capacity necessary for the development of any and all properties
within the Wheeler Subdivision as referenced in the impact study.
2. If HAMM does not build the project as described within two (2) years from the
date of this agreement the zoning will revert back to A-P Administrative
Professional on Lot 1, Block 1, Wheeler Subdivision Phase One.

3. There shall be a buffer area maintained by HAMM as shown on the conceptual
site plan attached as EXHIBIT F. All existing vegetation shall be maintained
within this buffer area by HAMM and supplemented by street trees as required
by the City's streetscape regulations. The buffer area may be used for passive
recreational activities or storm water management. It may contain pedestrian or
bike trails, but no active recreational activities shall be allowed. No parking or
building shall be allowed in the buffer area.
4. Access shall be limited to one right-in, right-out drive onto University Drive and
one access drive onto Lincoln.
5. Building height shall be limited to 3 stories, building facades shall consist of at
least 25 percent brick and colors shall be muted earth tones as shown on the
rendering presented to City Council (EXHIBIT G).
6. The number of suites shall be limited to 95.
7. All notices and documents required herein shall be sent and provided to the

All notices and documents shall be deemed received when mailed with sufficient
postage and deposited in a regular mailbox of the United States Post Office. The
parties may change addresses upon thirty (30) days' written notice sent certified
mail, return receipt requested.
8. This -Agreement shall be filed of record in the Official Records of the Brazos
County Clerk, Brazos County, Texas.
9. HAMM agrees to and shall indemnify, hold harmless and defend CITY, its
officers, agents and employees, from and against any and all claims, losses,
damages, causes of action, suits and liability of every kind, including all expenses
of litigation, court costs, and attorney's fees, for injury to or death of any person,
or for damage to any property arising out of or in connection with this
Development Agreement. Such indemnity shall apply where the claims, losses,
damages, causes of action, suits, or liability arise in whole or in part from the
negligence of the CITY. Said indemnification shall be in full force and effect for
five (5) years from the date of execution of this agreement and will then
terminate. HAMM' s liability to repair or replace defective materials or
workmanship or both in connection with the improvements to be constructed
pursuant to this agreement shall cease one ( l) year after the sewer line is
accepted by the CITY as provided in Item I. above.

10. For five (5) years from the date of execution of this agreement, HAMM shall
procure and maintain at its sole cost and expense, insurance against claims for
injuries to persons or damages to property that may arise from or in connection
with the performance of the work hereunder by HAMM its agents,
representatives, volunteers, employees or subcontractors. HAMM' s insurance
coverage shall be primary insurance with respect to CITY, its officials,
employees and volunteers. Any insurance or self-insurance maintained by CITY,
its officials, employees or volunteers, shall be considered in excess of the
HAMM' s insurance and shall not contribute to it. Certificates of Insurance and
endorsements shall be furnished to the CITY and approved by CITY before
CITY issues a Certificate of Occupancy. A Property Insurance Policy shall be
required. The following general requirements shall be applicable to the policy:
A. Property insurance shall be written by a carrier with · an A: VIII or better
rating in accordance with the current Best Key Rating Guide.
B. Only insurance carriers licensed and admitted to do business in the State of
Texas will be accepted.
C. Deductibles shall be listed on the Certificate of Insurance and · are
acceptable only on a per occurrence basis for property damage only. The
deductible limits shall not exceed Ten Thousand Dollars ($10,000.00).
D. Claims Made Policies will not be accepted.
E. The coverage shall contain no special limitations on the scope of protection
afforded to the City, its officials, employees, or volunteers.
F. The insurance policy shall be endorsed to state that coverage shall not be
suspended, voided, cancelled, or reduced in coverage or in limits except
after thirty (30) days prior written notice by certified mail, return receipt
requested, has been given to the City of College Station.
G. The following Commercial General Liability will be required and
maintained during the period of this Agreement.
a. Minimum Combined Single Limit of $600,000.00 per occurrence for
· Bodily Injury and Property Damage.
b. Coverage shall be at least as broad as Insurance Service's Office form
number CG 00 01 .
c. No coverage shall be deleted from the standard policy without
notification of individual exclusions being attached for review and
acceptance.
Certificates of Insurance shall be prepared and executed by the insurance
company or its authorized agent, and shall contain provisions and warranting the
following:
a. The company is licensed and admitted to do business in the State of
Texas.
b. The insurance set forth by the insurance company are underwritten on
forms which have bee . approved by the Texas State Board of
Insurance or ISO.

c. Sets forth all endorsements and insurance coverage according to
requirements and instructions contained herein.
d. Shall specifically set forth the notice of cancellation, termination, or
change in coverage provisions to the City of College Station.
e. Original endorsements affecting coverage required by this section
shall be furnished with the certificates of insurance.
11 . This Development Agreement has.been made under and shall be governed by the
laws of the State of Texas. Venue shall lie in a court of competent jurisdiction in
Brazos County, Texas. If it is determined that the CITY OF COLLEGE
STATION had no authority to enter into this Development Agreement, then
HAMM: agrees that it shall meet all conditions as required by this Development
Agreement or zoning shall revert back to A-P Administrative Profe~sional on Lot
1, Block 1, Wheeler Subdivision Phase One and each pany shall be considered to
be returned to the position he was in before this Development Agreement was
entered into except that sections 9 and 10 shall remain in full force and effect.
12. In the event of litigation, HAMM agrees to pay and shall pay for all of the
attorney's fees, court costs and other litigation costs of Cl TY.
13 . HAMM: shall provide proof of its authorization to execute this Development
Agreement, which proof of authorization to sign is attached hereto as Exhibit
H.
14. This agreement shall be binding upon and inure to the benefit of any successor,
heirs or assigns.

The subject property for this report is. the Bert Wheelers Inc. 8.471 and 4.242 acre
tracts located on the southwest and southeast comers of the University and Lincoln drive
intersection. The purpose of this report is to investigate existing sanitary sewer lines within
and downstream of the area in light of proposed development of the two tracts and to suggest
modification (revitalization) to the system to provide adequate sanitary sewage flow
collection. This is not a comprehensive system analysis and only accounts for impact on the
existing sanitary sewer system due to the development of the subject tracts.
This study is being conducted at the request of Bert Wheelers, Inc., current owner of
the tracts~ as a condition for the rezoning of the tracts approved by City of College Station
Planning & Zoning Commission April 17, 1997. Current development plans for the two tracts
· are conceptual in nature and therefore the most intense landuse for individual zoning districts
will be used in the analysis.
SITE DESCRIPTION:
The study area consists of a total of 12.713 acres lying south arid adjacent to F.M. 60,
University Drive, at its intersection with Lincoln Drive (see Appendix 1, "General Location").
Current Zoning for the 8.471 acre tract is C-8 Business Commercial and for the 4.242 acre
tract is A-P Administrative Professional. Currently there is no developed land use and the
tracts are vacant.
PROPOSED USAGE:
There is not a specific use proposed for the 8.471 acre tract. The most intense use for
C-B zoning is considered Hotel/motel. The 4.242 acre tract has two scenarios for proposed
usage. The first, Scenario A. is to have the entire tract operating under A-P Administrative
Professional. The second, Scenario B is for 1. 738 acres of the tract to operate under A.:P
zon.ing and the remaining 2.504 acres operate under C-8 zoning. Currently, steps are being
taken by the owner to gain City approval for Scenario B. Under this option, proposed usage
would be as follows:

EXISTING CONDITIONS SANITARY SEWER LINE ANALYSIS:
The City of College Station Engineering Department provided information concerning
existing conditions for the sanitary sewer collection system serving the subject tracts. Lines
are described from manhole to manhole as shown in Exhibit A, "Existing Conditions" found in
Appendix 3, "Existing Sanitary Sewer System". The system analysis for this project begins at
a manhole located at the northeast corner of the 4.242 acre tract designated as M030A and
terminates at manhole M001 located near the College Station City Limits line (see Appendix
3). Limited capacity exists in the current system. Line segments and limiting capacities are
summarized in the following table.

Line M030A-M018 had inaccurate as-built infomiation and time constraints prevented field
verification of line slope and flowfines. A minimal slope of 0.3% was assumed for this line
and existing flow calctilated per TNRCC design standards (see Appendix 3 fo_L line capacity
and existing flow calculations). ~ --
PROPOSED CONDITIONS SANITARY SEWER LINE ANALYSIS;
DESIGN PARAMETERS:
Design flows are based on comparable usage for like zoned properties. In the
absence of a proposed use, the most intense use for a zoning district will be used. The
following table describes these design parameters (see Appendix 4, "Design Parameters").

SYSTEM ACCEPTABILITY:
The extreme limiting line capacity for the existing sanitary sewer system is 22.4 gpm
occurring in line M010-M008 with the second most limiting capacity being 89.8 gpm in line
M029-M021. Capacity of the system is exceeded under both development scenarios.
Portions of the existing line wi.11 need to be reworked to accommodate the increased sewer
demand. Scenario A exceeds capacity of the existing system along two sections of line
(M029-M021 & M010-M008) and nears full flow capacity along two other sections (M017-
M013 & M013-M010). Scenario 8 exeeeds capacity of the system along the entire route from
M029 to MOOS (see Exhibit B "Existing System Inadequacy" in Appendix 3 and Table 5 below
for summary). Revitalization of the system is required prior to any development causing an
increase in peak sanitary sewer flow greater than 22:4 gpm.

PROPOSED SYSTEM REVITALIZATION:
Using the development scenarios set forth in this report, proposed system
revitalization will be discussed and cost estimates of the improvements provided.
SCENARIO A: Total increase in peak sanitary sewer flow due to this scenario is
calculated to be 121.5 gpm. Using the given existing capacities within the system,
line sections M010-M008 & M029-M021 are exceeded. Suggested improvements. to
the system consist of the following:
A 1) Install a 10" line on a minimum 0.33% slope from manhole M029 to
tv1008 accommodating all of the increased flow as well as existing flow.
Capacity of new line -667.5 gpm minimum
Contributing flow (exist+new) -246.85 + 121.5 = 368.4 gpm
Remaining Capacity -299. 1 gpm
2) Abandon the existing 8" line in place.
(see Appendix 4, "Design Parameters" for calculation)
SCENARIO B: Total increase in peak sanitary sewer flow due to this scenario is
calculated to be 177.6 gpm. Using the given existing capacities within the system,
line sections from M029 to MOOS will need to be reworked. Suggested
improvements to the system consists of the following:
A 1) Install a 1 O" line on a minimum 0.33% slope from manhole M029 to
MOOS accommodating all of the increased flow as well as existing flow.
Capacity of new line -667.5 gpm minimum
Contributing flow (exist+new) -246.85 + 177.6 = 424.4 gpm
Remaining Capacity -243. 1 gpm
2) Abandon the existing 8" line in place.

CONCLUSIONS & RECOMMENDATIONS;
It is shown using accepted design principles that the subject tracts would require
additional sanitary sewer capacity should they develop according to the proposed
development scenarios. Although Scenario A exceeds capacity of the existing sanitary sewer
system in only two segments, full flow is approached in two additional segments. In Scenario
B, the majority of the system's capacity from manhole M029 to MOOS is exceeded. It is
recommended that revitalization option A, applicable to both scenarios, be constructed to
provide the excess sanitary sewer capacity needed to accommodate the subject tract
development. This option provides for the existing and additional sewer demands while
leaving a significant amount of remaining capacity in the line. Since there is no definite
development plan for the 8.471 acre tract, this remaining capacity can be used as a reserve
to insure that the Owner can use the 8.471 acre tract for purposes that may require more
sanitary sewer capacity than the projected 116.0 gpm. It should be noted that if the 8.471
acre tract develops in such a manner as to require more than 193.98 gpm in sanitary sewer
capacity (limiting capacity in line M024-M025) additional revitalization of the system would be
necessary to carry flow to the system improvements as recommended by this report.
Due to the fact that other undeveloped areas are in close proximity to this project, it is
recommended that the City of College Station consider providing an oversized line capable of
receiving additional sanitary sewer flows based on projected land use.

Dear Mr. Thompson:
Transmitted via this letter is a cost estimate that is being submitted in connection with an Oversized
Participation (OP) request. This request is submitted with regard to the construction of a sanitary sewer
line that is being construction as part of the proposed AmeriSuites Hotel Project. This project is currently
under construction at 1100 University Drive in College Station, Texas.
The subject sanitary sewer is located in the rear of the referenced property. Details concerning the sewer
are illustrated on the revised Sheet C-14 of the submitted construction drawings. Sheet C-14 also shows
the plan and profile for the sanitary sewer.
The difference in the construction cost is being submitted with respect to an 8-inch diameter sanitary
sewer line required by the developer and a 12-inch diameter sanitary sewer line requested by the City of
College Station (City). The site work contractor for the project, Colt Construction Company, indicated
the difference in the construction costs between the two sizes of lines. These cost differences are
summarized in the attached Table 1. The costs reflect some additional work required at the
"downstream" manhole due to the increased line size.
