SPECIAL WARRANTY DEED
THE STATE OF TEXAS
COUNTY OF BRAZOS
For Ten Dollars ($10.00), and other valuable consideration, paid to Longmire College
Station, Ltd., a Texas limited partnership, with an address at 13140 Coit Road, Suite 220,
Dallas, Texas 75240 ("Grantor"), by Longmire Apts. LLC, a limited liability company formed in
Texas, with an address at 14185 N, Dallas Parkway, Suite 650, Dallas, Texas 75254
("Grantee'), the receipt and sufficiency of which are hereby acknowledged, and the further
consideration of the execution by Grantee of a promissory note of even date herewith ("the
Note") payable to the order of Viewpoint Bank ("Mortgagee"), bearing interest and being
payable as more particularly described therein, representing funds advanced by Mortgagee to
Grantee for a portion of the purchase price for the Property (as hereinafter defined), Grantor has
GRANTED, SOLD and CONVEYED, and by these presents does hereby GRANT, SELL and
CONVEY unto Grantee the real property located at 2302 Longmire Drive, College Station,
Texas 77845, and as described in Exhibit "A" attached hereto and made a part hereof; together
with all improvements located thereon (herein called the "Property").
This Deed is made and accepted subject only to the exceptions set forth in Exhibit "B"
attached hereto and made a part hereof.
TO HAVE AND TO HOLD the Property, together with all and singular the rights and
appurtenances thereto in anywise belonging, subject to the foregoing terms, provisions, unto
Grantee, its successors and assigns, forever; and Grantor does hereby bind itself, its successors
and assigns, to warrant and forever defend all and singular the Property, subject, however, as
aforesaid, unto Grantee, its successors and assigns, against every person whomsoever lawfully
claiming, or to claim the same, or any part thereof, by, through, or under Grantor, but not
otherwise.
Ad valorem taxes for the current year have been prorated through the date of the deed,
and Grantee hereby assumes and agrees to pay such ad valorem taxes for the current year and
subsequent years during its ownership of the Property.

purposes therein contained by signing the name of the corporation as such general
