The City of College Station understands that you, your capital partner, and lender are seeking
acknowledgment of the anticipated entitlement and permit schedule for the project to be developed at
717 University Drive. Pending that all requirements of the Unified Development Ordinance ("UDO") and
applicable codes and regulations are met, we anticipate the following schedule:
• Vacation of Existing Utility Easement:
o Initiated 3/1/12; Target Completion 3/21/12
• Site Plan / Development Plat Review: Typical review and approval occurs within 15 working
days.
o Ownertarget application 3/6/12; Target approval 3/26/12.
• Demolition Permit: Typical approval and issuance occurs within 5 working days.
o Owner target application 3/5/12; Target approval 3/12/12.
• Survey Replat: Typical review and approval occurs within 5-7 working days.
o Owner target application 3/27/12; Target approval 4/2/12.
• Foundation Permit: Typical approval and issuance within 20 working days.
o Target application date 4/6/12; Target approval 5/3/12.
• Full Building Permit: Typical approval and issuance occurs within 30 working days.
o Target application 5/4/12; Target approval 6/7/12.

Dear Mr. Hrankowsky,
Below is what I see as the permit process for the 717 University project, according to what I am aware of at
this time. This list may be subject to change depending on new information that may arise at a later time. I've
provided a brief non -comprehensive description of what is involved in each permit request. The following
may be reviewed simultaneously, but approval must proceed according to proper order. This means that the
easement abandonment must be approved prior to approval of the plat, the plat must be filed before the site
plan is approved, and the site plan must be approved prior to building permit approval.
Process:
• Easement Abandonment- Requires a complete application, associate documents specified on the
coversheet checklist, signatures from utility providers and appropriate City Staff, Staff review,
Council action.
• Demolition permit- Contact Ben McCarty, Plans Examiner, Staff review, Staff action.
• Final Plat- Requires a plat complete application, associate documents specified on the coversheet
checklist, construction documents for new public infrastructure, Staff review, the construction or
bonding of public infrastructure prior to P&Z, and Planning and Zoning Commission action.
• *Site Plan- Requires a complete application, associate documents specified on the coversheet
checklist, Northgate applicable landscaping can be shown, Staff review, Staff action unless waivers
are sought from the Design Review Board for specific standards (not anticipated). The following
document (*) are required to be submitted with the Site Plan application.
o *Development Permit- Construction documents for any additional public infrastructure,
grading, sidewalks, etc., Staff review, Staff action_
o *Northgate Building Review (NRA equivalent)- Requires a complete application, exterior
facade elevations, color samples, and material samples, Staff review, Staff action unless
waivers are sought from the Design Review Board for specific standards (not anticipated).
o *Grading permit- May be requested when approaching Site Plan approval, Staff review,
Staff action.
o *Private Improvement in Public Right -of -Way permit (PIP)- Requires a complete
application, Staff review, Staff action.
• Building Permit- Contact Ben McCarty, Plans Examiner, Staff action.

Joe,
The two legal teams continue to discuss the terms of the lease and I think they are close to consensus. We will not have
it executed by tomorrow. We hope the progress and momentum achieved so far will not be hurt by a lack of incentive
on the developer's part once they have their CO, because they and their tenants will not have legal rights to occupy
those balconies overhanging TxDOT right of way until we can execute a lease.

I know we had this conversation at the last MPO Policy Committee meeting, and I believe you also had this conversation
with Chuck Gilman regarding the lease agreement for the Rise at Northgate. So to reiterate, you all will not need us to
hold up the developer's Certificate of Occupancy (CO), that will be issued tomorrow before you all finalize the lease
agreement for the balconies? Let me know thanks.

Hey Chad, regarding the e-mail stream below. The City needs an answer pretty quick, in order to finalize the CO for
August 12t'. One option we could pursue but would prefer not too, is to issue a temporary CO, so that they can have
people move in the week after the 121h. If the answer is no the lease agreement then we need to know that tot, because
then we will use the CO to get the builder to remove the balconies. Either way we need an answer pretty quick. Thanks.

Subject: 717 University west pathway lighting
Jason, please see the attached fixture and photometric study regarding the lighting along the west sidewalk/property
line. Again, the goal is to provide a safe secure path for exiting the building.
This example study is for the fixture mounted at 8' and spaced at 24'. You can see that there is not a 'cone of light'
crossing the property as the fixture disperses the LED source quite evenly. I consider this in compliance with the College
Station ordinance on site lighting. Please confirm if you agree.
We are anxious to order these fixtures, so your help in this regard is greatly appreciated.
