The Zoning Board of Adjustments (ZBA) voted (3-2) to deny the variance for the
sign requirement for the above -referenced case. This vote was taken at the
Board's regular meeting on April 3, 2012.
Recourse from ZBA decisions is to a Court of Law and appeals must be made
within ten (10) days of the decision, which becomes final at Thursday noon after
the meeting.
When a variance request is denied, the applicant may request that the ZBA
rehear the request at a future date. To make a request to rehear, the applicant
must submit new information that was previously not available to the Board. The
request to rehear must be provided to the Administrator within ten days of the
denial. Applicants must have the ZBA's approval to present the same or a
similar request regarding the same property after denial of such request by the
Board.

To whom it may concern,
On December 20, 2011, 1 informed a representative of Sign Pros that the subject sign permit for Twin
Liquors was denied.
The Unified Development Ordinance (UDO) Section 7.4.1.2., Attached Signs, allows for commercial
buildings or tenant lease space to have attached signage that does not exceed a total of 2.5 square feet
per linear foot of all public entry fapade, Twin Liquors' public entry facade is 707', allowing the tenant a
total of 176.5 square feet of signage.
A sign permit (No. 11-3980) was approved on November 22, 2011 for a 176 square foot sign, attached
above the main entry of Twin Liquors' lease space. The subject permit (No. 11-4287) was submitted on
December 19, 2011 for a 40.63 square foot sign, located on a building on the same property as Twin
Liquors' lease space but not on the same building.
The subject sign (No. 11-4287) was installed without the required permits. It was denied due to it
exceeding the maximum allowed area of signage for Twin Liquors and it is not attached to the building in
which the lease space is located. Section 7.4.1.3 allows for the property owner to divide the building
signage of the tenants located in the building; it does not allow for signage of all buildings to be divided
up between all tenants on the property.
A variance request to the sign ordinance can be made to the Zoning Board of Adjustments (ZBA) for sign
permit No. 11-4287. The Board requires that there be an unnecessary hardship and special condition to
the land to justify such variance. Mere inconvenience or financial disadvantage will not be considered.
If this office has not received a complete ZBA variance application by 5:00 PM on February 13, 2012 or
notice that the sign has been removed, we will be forced to turn this matter over to the Code
Enforcement Division. For your convenience, attached you will find a copy of the ZBA variance
application.
