The Texas Department of Transportation, hereinafter called the State, hereby authorizes --------------hereinafter called the Permittee, to 1:8:1 construct I 0 reconstruct a _S_l_D_E_W_A_L_K ________ (residential, onvenience
store, retail mall, farm, etc.) on the highway right of way abutting highway number SH 30 in Brazos
County, located @ 900 & 1100 Harvey Road (SH 30), east (430') of Munson Drive
Subject to the following:
1. The Permittee is responsible for all costs associated with the construction of this access driveway.
2. Design of facilities shall be as follows and/or as shown on sketch and is subject to conditions stated below:

All construction and materials shall be subject to inspection and approved by the State.
3. Maintenance of facilities constructed hereunder shall be the responsibility of the Permittee, and the State reserves the right
to require any changes, maintenance or repairs as may be necessary to provide protection of life or property on or adjacent
to the highway. Changes in design will be made only with approval of the State.
4. The Permittee shall hold harmless the State and its duly appointed agents and employees against any action for personal
injury or property damage sustained by reason of the exercise of this permit.
5. Except for regulatory and guide signs at county roads and city streets, the Permittee shall not erect any sign on or extending
over any portion of the highway right of way, and vehicle service fixtures such as fuel pumps, vendor stands, or tanks shall
be located at least 12 feet from the right of way line to ensure that any vehicle services from these fixtures will be off the
highway right of way.
6. The State reserves the right to require a new access driveway permit in the event of a land use change or change in
driveway traffic volume or vehicle types.
7. This permit will become null and void if the above-referenced driveway facilities are not constructed within six (6) months
from the issuance date of this permit.
8. The Permittee will contact the State's representative Mr. Walt Norwood, Maintenance Supervisor
telephone, ~ 778-8054 ,at least twenty-four (24) hours prior to beginning the work authorized by this permit.

Access Driveway Regulations
The Texas Transportation Commission, in recognition of its responsibility for the safety and utility of public highways under its
jurisdiction, has directed the department to adopt access driveway standards to accomplish a coordinated development between
highways and abutting property. For this purpose, the booklet entitled "Regulations for Access Driveways to State Highways", was
published and adopted, setting out departmental policies to regulate construction and maintenance of access driveway facilities.

Access Driveway Permit -Sidewalk (5' x 58')
GENERAL SPECIAL PROVISIONS (Access Permit ) :
1) Traffic Control plan is required, as per TMUTCD, prior to start of construction
work in SH 30 (Harvey Road) right-of-way.
2) Lane closure will be allowed between 8:30 AM and 4:30 PM only.
3) Areas within ROW disturbed by construction shall be restored to equal or better
conditions than existing prior to construction.
4) Contractor shall be responsible for locating all utilities within the right-of-way
construction site. Contacts with local utility companies and utility locators are
required.
5) Sidewalk construction in the SH 30 right-of-way shall be in accordance with new
TxDOT ADA requirements. Width= 5', (See PED-05 Standards).
(Max. cross-slope thru Driveways = 2%)
6) No color texturing shall be used for ramps! sidewalks at private or commercial
driveways; Only on public streets.
7) Contractor shall notify Norman Maurer @ TxDOT Brazos Maintenance (778-8054) for
handling of any roadway signs in conflict with construction.
8) Pavement surface shall be kept clear of mud, debris, etc.
9) Contractor /Owner /Representative must contact Mr. Walt Norwood at 778-8054 or @
Walt.Norwood@TxDOT.gov; or a TxDOT Representative 48 hours prior to starting
construction in the SH 30 right-of-way.

Jay .. you are correct .. that 1s what the sidewalk does its "bend around" ... I noted 1t as L.P . Base ... big honker !!!
We had Jones and Carter go with a survey crew and locate most of the stuff on the site ... so I believe its location to be accurate .....

There appears to be a large power pole with a 5' diameter base (at least) located just west of the east driveway that doesn't
really show up on the attached drawing -you might want to check this out.

Post Oak Village and Post Oak Square.
This proposal was configured to have some of the sidewalk on private property .... Which required private access easements between private land
owners ....
The City has stated that this 1s no longer a requirement. Thus I submit for your review a revised version which put the sidewalk entirely in the
TXDot ROW. It varies only slightly from the original design.
· My question: Does TXDot have any issues with this layout ... Post Oak Village will assume all costs for construction and maintenance for the sidewalk
(1n accordance with agreements between TXDot and the city of C.S.).

If there are no issues with this sidewalk .... Can you give me the requirements for paperwork ... that we can complete and get the required permit
from TXDot and that I can coordinate with the City of C.5.
