Consideration: TEN AND NO/100 DOLLARS ($10.00) and a note of even date herewith in
the principal amount of FORTY FIVE THOUSAND AND N0/100 DOLLARS ($45,000.00), executed by
Grantee and payable to the order of BRAZOS VALLEY BANK, N.A., said note being secured by a vendor's
lien retained in this deed and by deed of trust of even date herewith to STEVEN D. HARPER, TRUSTEE, for
the benefit of BRAZOS VALLEY BANK, N.A..

COLLEGE STATION, ACCORDING TO PLAT THEREOF RECORDED IN VOLUME 2182, PAGE
35 OF THE OFFICIAL RECORDS OF BRAZOS COUNTY, TEXAS.
Reservations from and Exceptions to Conveyance and Warranty:
This conveyance is made and accepted subject to any and all covenants, conditions, restrictions, easements, right-
of-way, mineral or royalty reservations and/or conveyances, and mineral leases, if any, in Grantor's chain of title,
applicable to and enforceable against the above described property, to the extent, and only to the extent, that the
same may still be in force and effect, shown of record in the office of the County Clerk of BRAZOS County,
Texas, including, but not limited to the following:
1. Easements and building lines as shown on replat recorded in Volume 2182, Page 35 of the
Official Records of Brazos County, Texas.
2. Blanket Easement dated April 15, 1937, from A. J. Tabor, Jr. Estate to City of Bryan, recorded in
Volume 98, Page 75, Deed Records of Brazos County, Texas.
3. Mineral Reservation in Deed dated July 12, 1984, executed by Ralph E. Miller and wife, Aletha J.
Miller, et al to Ronald Cruse, Trustee, recorded in Volume 702, Page 643, Official Records of
Brazos County, Texas.
4. Mineral Reservation in Deed dated May 31, 1985, executed by Ronald Cruse, Trustee to Group 5
Joint Venture, recorded in Volume 794, Page 691, Official Records of Brazos County, Texas.

Miller, recorded in Volume 120, Page 20, Deed Records of Brazos County, Texas.
7. Oil and Gas Lease dated October 24, 1991, together with all terms, conditions, and stipulations
therein contained, between Ralph E. Miller, et al and Central Plains Oil & Gas Corporation,
recorded in Volume 1405, Page 313, Official Records of Brazos County, Texas.
Grantor, for the consideration and subject to the reservations from and exceptions to conveyance and warranty,
grants, sells, and conveys to Grantee the property, together with all and singular the rights and appurtenances
thereto in any wise belonging, to have and hold it to Grantee, Grantee's heirs, executors, administrators,
successors, or assigns forever. Grantor binds Grantor and Grantor's heirs, executors, administrators, and
successors to warrant and forever defend all and singular the property to Grantee and Grantee's heirs, executors,
administrators, successors, and assigns against every person whomsoever lawfully claiming or to claim the same
or any part thereof, except as to the reservations from and exceptions to warranty.
The vendor's lien against and superior title to the property are retained until each note described is fully paid
according to its terms, at which time this deed shall become absolute.
BRAZOS VALLEY BANK, N.A., at Grantee's request, has paid in cash to Grantor that portion of the purchase
price of the property that is evidenced by the note described. The vendor's lien and superior title to the property
are retained for the benefit of BRAZOS VALLEY BANK N.A., and are transferred to that party without
recourse on Grantor.
Current ad valorem taxes on the property having been prorated, the payment thereof is assumed by Grantee.
When the context requires, singular nouns and pronouns include the plural.
