Dear Mr. Guerra,
Per your request for a letter of documentation from Memorial Funeral Home that states that they are not interested
in cross access, the following deliberate attempts have been employed;
1. Most recently, Mr. Rusty Gerdes, an agent representing the current owners of the property (Wilfred and Julie
Jacinto) has made several attempts to get an answer regarding this matter, yet has received no response. Please
note the attached letter dated on 11-16-11, accompanied by documentation that the letter was sent certified, and
receipt of it was documented. Again, since this date, no response was received.
2. In addition, correspondence from 2009 is also attached. Essentially, a like attempt was made by Mr. Jacinto's
architect (John Rhodes) to obtain permission for shared access. According to this information, shared access was
denied by the funeral home and an adjacent property owner.
I hope this fulfills the obligation for denied cross access, I don't know what else we could possibly do to get the
funeral home to respond one way or the other.

Re: Driveway access for 16 B Morgans Lane
Dear David Holigan,
I am just following up on my phones calls regarding the driveway access for the property
at 16B Morgans Lane. We understand that you will not allow us to use your driveway.
All I ask of you is a letter stating that you will not allow access through your driveway.
We need this in order to present to the City of College Station, We would like to have
the letter by November 30, 2011 in order to present it to them. We appreciate your help
on this matter.

Mr. Russell,
Thank you for your time this morning on the phone. As we discussed, We are the architectural firm
hired by Wilfred Jacinto the property owner for the property located directly behind you on Morgan's
lane in College Station. Mr. Jacinto is attempting to expand his business and develop a small
commercial building on his lot. Due to current city standards he is not allowed to have his own curb cut
or entrance to his lot due to the distance to the main intersection of Texas Ave. and you existing curb
cut.
Would your company be willing to agree to signing a shared access agreement with Mr. Jacinto? If
not could you please respond and let us know that you are not willing to do so at this time. This will
allow us to proceed with other options for him.
