Section 3.3.E.d.3 of the applicable Unified Development Ordinance (UDO) states that "Approval or conditional approval of a Preliminary Plat shall be effective for 24 months from the date of such action." At the Commission's June 17, 2010 meeting, Phase 1 Lot 1, Block 1 of the subdivision received Final Plat approval. There is one additional phase that has not received Final Plat approval and been filed for record and the applicant is requesting an extension to the expiration date of the Preliminary Plat. The Commission has the authority to grant an extension based on Section 3.3.E.d.3 of the LIDO which states that "If a Final Plat is not filed within 24 months of the effective date of approval, the Planning and Zoning Commission, may upon written application of the subdivider, extend the approval for a one-time additional 12-month period." While a Final Plat has been filed for a portion of the subdivision, the next subsection, 5, states that "Each Final Plat of a phase on an approved Preliminary Plat shall extend the expiration date of the Preliminary Plat an additional two years from the date the Final Plat was approved by the City." In this case, a Final Plat was approved after the Preliminary Plat but it did not extend the expiration date of the Preliminary Plat beyond the 24 months already granted through its own approval on May 6, 2010. Recommendation: Staff is recommending approval of the Preliminary Plat Extension as the Final Plat that was approved for one lot in the subdivision did not extend the expiration date of the Preliminary Plat beyond the 24 months already granted.
